HomeMy WebLinkAbout2.0 Resolution 79-151Recorded a,t ._ c c1crt�____ Reception No Mildred A1sdorf, Recorder BEFORE THE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION NO. 74-/S/ BOOK 540 P,SGF436 WHEREAS, Otto Zinko has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 3n-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 170.0 acre tract described as follows: that parcel of land as described in Document No. 255294 as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of annroximately 166.51 and 3.49 acres each, more or less, which proposed divided tract is more particularly described as follows: Tract A: Beginning at a point on the North line of the Townsite of Cardiff, whence the North Quarter Corner of Section 27, Town- ship 6 South, Range 89 blest of the 6th P.M. bears South 01°26'26" West 1337.73 feet; thence along the aforesaid northerly boundary of the Townsite of Cardiff South 8Q°50'50" East 45 feet to the True Point of Beginning; thence South 89°50'5n" East 257.95 feet; thence along an existing fenceline North 26°46' West 311.0 feet; thence South 89°50'50" East 20.0 feet; thence Porth 26°46' West 70.0 feet; thence South 89°50'50" East 291.8 feet; thence North 26°53'59" West 724.73 feet; thence South 01°26'26" West 265.76 feet; thence South 88°39' East 45 feet; thence South 1°2.6'29" West 718.70 feet to the True Point of Beginning, consisting of 3.49 acres, more or less in the State of Colorado and County of Garfield; and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the oronosed division does not fall within the purposes of Part 1, Article 2.8, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is not large enough to proceed through the full subdivision review; and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a BOOK MO rdGf.437 reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existino or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definitions of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract "A" from the above described 170.0 acre tract is hereby exempted from such definitions and said tract may be divided into tract "A", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tract "A", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution..�' � Dated this3(t day of .)WiAlxru.�, A D. 1974.
