RESOLUTION CONCERED WITH GRANTING AN EXEMPTION FROM THE
GARFIELD COUNTY SUBDIVISION REGULATIONS FOR WILLIAM WIMMER
WHEREAS, William Wimmer has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d)
and 3.02.01 for the division of a 16.292 acre tract described as follows:
In document #230687 filed in the Office of Clerk and Recorder
of Garfield County, Colorado; into 3 tracts of approximately
5.573, 6.098 and 4.621 acres each, more or less, which proposed
divided tracts are more particularly described as follows:
Tract A: A tract of land in the NWQ of Section 11, T.6S. R.93W.
of the 6th Principal Meridian in Garfield County, Colorado, and
being more particularly described as follows: Beginning at a
point on the southeasterly right-of-way line of County Roa2 No.
210, from which point the Ww corner of said Section 11, a stone
monument, properly marled, and found in place, bears S.51005106"
W a distance of 2096.10 feet; thence S. 89°51'01"W 64.08 feet
to a point on the northwesterly right-of-way line of said County
Road No. 210, said point being the True Point of Beginning for
Tract A; thence S 89°51'01"W a distance of 269.87 feet; thence
N.01°13'12"W a distance of 658.30 feet; thence N.89'40'00"W a
distance of 576.60 feet to a point on the northwesterly right-
of-way line of said County Road No. 210; thence S 30°44'05"14

Beginning at a point on the southeasterly right-of-way line of
County Road No. 210, from which point the W4 corner of said section
11, a stone monument, properly marked, and found in place bears S.
51°05'06"E. a distance of 2056.10 feet, thence S. 89°29'42"E. a
distance of 653.60 feet; thence N 00°30'18"E. a distance of 414.87
feet to the True Point of Beginning of Tract C; thence N 8929'
42"W. a distance of 503.79 feet to a point on the southeasterly
right-of-way line of said County Road No. 210; thence N. 27°09'37"
E. and along the southeasterly right-of-way line of said County Road
No. 210 a distance of 33.21 feet; thence N. 30 44'05"E.and along the
southeasterly right-of-way line of said County Road No. 210 a

of said County Road No. 210 a distance of 235.60 feet; thence N
89°40'00"E. and across said County Road No. 210, a distance of
114.54 feet to a point on the northeasterly rig t -of -way line;
thence N 89°40'00"E. a distance of 14.86 feet; thence S. 00°30'18"
W. a distance of 577.43 feet more or less to the True Point of
Beginning of Tract C. Containing 4.621 acres more or less excluding
the County Road No. 210 right-of-way.
(in the State of Colorado and County of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of. Garfield County, Colorado, that the proposed
division does not fall within the purposes of Part 1, Article 28, Title 30,
Colorado Revised Statutes 1973, as amended, for the reason that the impact
created does not warrant a full subdivision review, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
B ird of County Commissioners of Garfield County, Colorado, that there is a
reasonable probability of locating domestic water on each of said tracts, that
there is adequate ingress and egress to said tracts, that the .location of
septic tanks will be per;.-i.tted by the Colorado Department of Health, that the
requested division is not part of an existing or larger development and does
not fall within the general purposes and intent of the subdivision regulations
of the State of Colorado and the County of Garfield, and should, therefore,
be exempted from the definition of the terms "subdivision" and "subdivided
land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above
described tracts "A", "B", and "C" from the above described 16.292 acre tract
is hereby exempted from such definitions and said tract may be divided into
tracts "A", "B", and "C", all as is more fully described above, and said
