PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a)-(d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984 Section
2:20.49, the undersigned OTTO H. ZINKO and CATHERINE ZINKO, also known as
Katherine Zinko, respectfully petition the Board of County Commissioners of Garfield
County, Colorado, to exempt by Resolution the division of a7.25 acre tract of land into 2
tracts of approximately 3.626 acres each, more or less, from the definitions of "subdivision"
and "subdivided land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101
(10) (a)-(d) and the Garfield County Subdivision Regulations for the reasons stated below:
1. Attached hereto as Exhibit A is a sketch map at a scale of 1 inch : 5O
feet showing the legal description of the property, dimension and area of all lots or separate
interests to be created and the access to a public right-of-way.
2. Attached hereto as Exhibit B is a xerox copy of a portion of a U.S.G.S.
Quadrangle depicting a portion of the City of Glenwood Springs, Colorado and the location
of the property to be subdivided.
3. Attached as Exhibit C is a copy of the deed dated March 19, 1972
conveying the property to Applicants.
4. Attached as Exhibit D is a list of the names and addresses of owners
of record of land immediately adjoining and within 200 feet of the proposed exemption and

of mineral owners of properties located in Sections 16 and 21 , Township 6 South, Range 89
West of the 6th P.M.
5. Attached as Exhibit E is report from the Soil Conservation Service
concerning the soil types and characteristics of said soil types on the property in question.
6. The method of sewage disposal will be by individual septic systems.
7. The property is located within the Glenwood Springs Fire Protection
District. A letter affirming this fact has been requested from the Glenwood Springs Fire
Protection District and will be furnished to you at a later date.
8. Attached hereto as Exhibit F is a certification from the City of Glenwood
Springs stating that a connection to its water system can be made.
9. The exemptlon is being requested because Applicants wish to construct
a house on Lot 2 of the property. The property is adequate to support two residences,

exists at this time as it did on March 19, 1971.

The undersigned official of the City of Glenwood Springs,
Colorado hereby certifies as follows:
1. He is authorized and empowered to sign this
Certificate on behalf of the City of Glenwood Springs.
2. Domestic water service is now being supplied to the
residence locatecl upon the property described in deed recorded in
the office of the Clerk and Recorder of Garfield County, Colorado
as Reception No. 249287 in Book 418 at Page 54.
3. The City of Glenwood Springs has available capacity
and is willing to provide domestic water service to two additional
residences which mly be located upon the property described in the
deed referenced in paragraph 2 above upon proper application being
made to the City of-Glenwooa Springs and tap fees paid as required
by the ordinances of the City of Glenwood Springs.
4. This Certificate may be relied upon the Board of
County Commissioners of Garfield County in determining whether or
not to grant an exemption for the further subdivision of the
property described in the deed referenced in paragraph 2 above into
two additional residential sites.

RE: Zinko Subdivision Exemption referral
Dear Dave:
Thanks for providing the City with the opportunity to review and
comment on the proposed Zinko Exemption. We have the following
concerns and comments.
According to the city's geologj-c hazard rnapping, the Zinko property
is located in an area of known hazards. Some of the hazards may
be severe in nature. These hazards include debris fIow, rockfall
and hydrocompactive soils.The county may want to require a
mitigation plan before approving the proposed exemption. However,
if a mitigation plan is not required as a prerequisite to the
approval of the exemption, it should be a condition of approval of
the subdivision exemption.
As you are probably aware, the city is planning to make substantial
improvements to Midland Avenue next spring and summer. We would
encourage the applicant to request and construct any utility work
prior to the resurfacing work to avoid making street cuts on the
new pavement.
Residential water service is currently available for the proposed
exemption as outlined in the agreement of oel'ober 27, 1992 signed
by Michael Copp. If the proposed residence(s) are to be located
above elevatj-on 5,875 feet, approval of City Council will be
required. The City will perform the tap connection work if the tap
is 2 inches or smaller. The City will excavate the main, tap the
main extend the service line to the property line, install a shutoff,
backfill, and restore the area excavated by the city.
There is no sewer service avaiLable in this area.

Meter will be placed next to the transformer. No fences, shrubs,
trees or other structures should be placed in the vicinity of the
transforner.
The city would like to reguest that for this and all future
subdivisions adjacent to city boundaries the County provide a mylar
copy of the approved plat for our files.

brown sandy clay loam about 30 inches thick. The sub-
stratum is very pale brown sandy clay loam to a depth ol
60 inches.
lncluded with this soil in mapping are small areas of
Olney and Potts soils that have slopes of 1 to 6 percent.
Permeability is moderate, and available water capacity
is moderate. Etlective rooting depth is 60 inches. Sur-
face runofl is medium, and the erosion hazard is moder-
ate.
This soil is used mainly for irrigated hay and pasture
and some crops. Some areas are used for grazing and
wildlife habitat.
Corrugations are the main method of applying irrigation
water. Sprinklers are also suitable. Steep slopes cause
erosion to be more rapid on this soil than on less sloping
Ascalon soils. Minimum tillage, cover crops, contour til-
lage, and grassed watenvays help to control erosion.
Drop structures are needed in irrigation ditches.
The native vegetation on this soil is mainly need-
leandthread, wheatgrasses, and sagebrush.
When range condition deleriorates, forbs and shrubs
increase. When the range is in poor condition, undesira-
ble weeds and annual plants are numerous. Properly
managing grazing maintains and improves range condi-
tion. Reducing brush also improves the range. Seeding
improves range in poor condition. Pubescent wheat
grass, western wheatgrass, and big bluegrass are suit-
able lor seeding. Preparing a seedbed and drilling the
seed are good practices.
This soil has potential as habitat for cottontail rabbit,
squirrel, pheasant, mourning dove, and wild turkey.
Steep slopes and frost action limit community develop-
ment. Cuts and fills should be minimal, and drainage is
needed for roads and structures.
This soil is in capability subclasses lVe, irrigated, and
Vle, nonirrigaled.
7-Ascalon-Pena complex, 6 to 25 percent slopes.
These moderately sloping to hilly soils are on sides of
valleys and alluvial fans. Elevation ranges from 5,000 to
6,500 feet. The soils lormed in alluvium derived from
sandstone and shale. The average annual precipitation is
about 14 inches, the average annual air temperature is
about 48 degrees F, and the average frost-free period is
about 120 days.
The Ascalon soil makes up about 65 percent of the
complex, and the Pena soil makes up about 25 percent.
The Ascalon soil is on the less sloping, somewhat con-
cave parts of the landscape, and the Pena soil is on the
steeper, convex parts.
The Ascalon soil is deep and well drained. Typically,
the surlace layer is brown fine sandy loam about 5
inches thick. The subsoil is brown and yellowish brown
sandy clay loam about 30 inches thick. The substratum
is very pale brown sandy clay loam to a depth of 60
inches.
SOIL SURVEY
Permeability of the Ascalon soil is moderate, and avail-
able water capacity is moderate. Effective rooting depth
is 60 inches. Surface runoff is medium, and the erosion
hazard is moderate.
The Pena soil is deep and well drained. Typically, the
surface layer is about 12 inches thick. The upper part of
the surface layer is dark grayish brown slony loam, and
the lower part is dark grayish brown very stony loam-
The substratum is very pale brown very stony sanry
loam to a depth of 60 inches.
Permeability of the Pena soil is moderate, and availa-
ble water capacity is low. Etfective rooting depth is 6O
inches. Runotf is slow, and the erosion hazard is moder-
ate.
lncluded with these soils in mapping are small areas of
Olney and Potts soils that have slopes of 6 to 12 per'
cent. These areas are on small, isolated mesas and
make up 5 to 10 percent of the complex.
This complex is used mainly for wildlife habitat and
limited grazing.
The native vegetation is mainly needleandthread,
wheatgrasses, mountainmahogany, and sagebrush.
When range condition deteriorates, forbs and shrubs
increase. Properly managing grazing mainlains and im-
proves range condition. When the range is in poor condi-
tion, seeding is practical. Areas must be carefully select-
ed to avoid the concentration of stones. Pubescent
wheatgrass, western wheatgrass, and big bluegrass are
suitable lor seeding. Preparing a seedbed and drilling the
seed are good practices. Controlling brush improves
areas that are producing more woody shrubs than are
normally found in the potential plant community, but con-
trolling brush may damage deer habitat.
Cottontail rabbit, squinel, pheasanl, mourning dove,
wild turkey, and some mule deer find habitat on these
soils.
Community development is limited by the steep slopes
and frost action in the Ascalon soil and by steep slopes
and stones in the Pena soil.
This complex is in capability subclass Vle, nonirrigated.
8-Atenclo-Azeltlne complex, 1 to 3 percent
slopes. These nearly level to gently sloping soils are on
alluvial fans and terraces. Elevation ranges from 5,000 to
7,000 feet. The soils lormed in mixed alluvium derived
frorn red-bed shale and sandstone. The average annual
precipitation is about 't4 inches, the average annual air
temperature is about 47 degrees F, and the average
annual frost-free period is about 110 days.
The Atencio soil makes up about 45 percent ol the
map unit, and the Azeltine soil makes up about 45 per-
cent Exposed areas of gravel make up about 10 percent
of the unit.
The Atencio soil is deep and well drained. Typicalty,
the surface layer is dark reddish gray sandy loam about
11 inches thick. The upper part of the subsoil is reddish
brown gravelly sandy clay loam about 12 inches thick,
