WHEREAS, EDDIE C. WITTE,SR. and 0.V. R0BERTSON have petitioned the Board
of County Commissioners of Garfield County, CoIorado, for an exemption under
C.n.S. (1973) Section 30-28-10l (t0).(a) - (d) as amended, and the Subdivision
Regulations of Garfie'ld'County, Co'lorado, adopted September '1, 1972 and
amended April 14, 1975, Sections 1.02.i7 (d) and 3.02.01, for the division of
a 3.]0 acre tract of land into two tracts of 2.24 and .86 acres, more or less,
and said 3.10 acre tract of'land is nnre particularly described as follow:
A tract of ]and situated in Lot 4, Section 36, Township
6 South, Range 89 l^lest, of the 6th Principal Meridian,
and Lot 4, Section l. Township 7 SoLrth, Ranqe 89 tlest,
of the 6th Principal Meridian, and nrore fully described
as follows:
Beginning at a point in the center of the Roaring Fork
River whence the -Nlorthwest Corner of said Section I
bears N. 74o 39 ' l.l., 1122.3 feet; thence N. 90 30' E.
805.4 feet; thence S.89o 55'E.,148.0 feet; thence S.
90 30'W.,860.9 feet to the center of Roaring Fork
River; thence N. 690 38' t^l., 157.85 feet along the
center of Roaring Fork River to the point of beginning,
containing 3..l0 acres, more or less.
WHEREAS, the Petitioners have shown to the satisfaction of the Board of
County Conrnissioners of Garfield County, Colorado, that currently a single-
family residence exists on each separate parcel; and,
}lHEREAS, the Petitioners have shown that they are requesting the exemption
in order to bring both tracts into conformance with the Garfield County
Subdivision Regu'lations adopted September 1, 1972 and amended April 14, 1975;
and,
I.IHEREAS, the Petitioners have denpnstrated that the existing singl e-family
residences on said tracts have Iocated domestic watei, have constructed
individual sewage disposal systens according to the applicable County regu'lations,
that adequate ingress and egress exists, and that the requested division is in
accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield except for the size of the
.86 acre tract of land not meeting the minimum lot size needed for individual
sewage treatment as outlined in the Garfield County Zoning Reso'lution;

hereby exempted from such definition and transfer of said tract nay be made by
division into two tracts of 2.24 acres and .86 acre, more or less, provided,
however, that said exemption is conditioned upon the Petitidners obtaining,
within sixty (50) days of this Resolution, d lot size variance for individual
sewage treatnent on the.86 acre tract of land from the Garfield County Zoning
Board of AdjustnEnt, and provided, further, that if such condition is not so
met, then the exemption granted hereby shall be void and of no effect. A copy
of the instrunent(s) of conveyance when recorded shall be filed with this
