A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION REGULATIONS F'OR THE TRUST OF H. P. WILLIAMS
WHEREAST The Trust of H, P. Williams has petitioned the Board of
County Commissioners of Garfield County, CoIorado, for an exemption fromthe definition of the terms 'subdivisionn and nsubdivided landn underC.R.S. 1973, 30-28-I01 (10 ) (a)-(d), as amended, and the SubdivisionRegulations of Garfield County, CoIorado, adopted ApriJ- 23, L984, Section8:00 through 8:60 and for the division of a 47.66 acre tract as describedin Book 502, Page 511, as filed in the Office of the Clerk and Recorder ofGarfield County, Colorado into three tracts of approximately 10 acres, 5acres, and two acres, more or Iess, which proposed divided tracts are morepractically described as follows:
TRACT A: See attached lega1 descriptlon for Tract A.
TRACT B: See attached legal description for Tract B.
TRACT C: See attached legal description for Tract C.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the remainder of said 47.66 acre tract has been merged withadjoining properties owned by the applicant so as not to create anyadditional parcels, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, Colorado, that theproposed division does not faII within the purposes of Part L, Article 28,Title 30, Colorado Revised Statutes 1973r ds amended, for the reason thatthe division does not, warrant further subdivision review, and
WHEREAS, Ehe Petitioners have demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, Colorado, that there isa reasonable probability of locating domestic water on each of saidtracts, that there is existing ingress and egress to said tracts, that thelocation of septic tanks wilI be permitted by the Colorado Department ofHealth, that the requested division is not part of an existing or largerdevelopment and does not, fall within the general purposes and intent ofthe subdivision regulations of the State of Colorado and the County ofGarfield, and should, therefore, be exempted from Lhe definition of theterms 'subdivision" and nsubdivided land' as set forth in c.R.S. L9731
30-28-101 (10) (a)-(d), as amended;
