Pursuant to C.R.S. (1973) , Section 30-28-101(10) (a) (d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April L4, 1975,
Sections 1.02.17(d) and 3.02.01, the undersigned, CARL O. WITTWER
and MARGARET L. WITTWER, respectfully petitions the Board of
County Commissioners of Garfield County, Colorado, to exempt by
resolution the conveyance of a 3.37 acre parcel of land owned
by petitioners, and the retention of 147.99 acres, all as more
fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S.
(L973) , Section 30-28-101 (a) (d) and the Garfield County Sub-
division Regulations, for the reasons stated below:
1. That petitioners own 145.36 acres in Garfield County,
Colorado, described as Lots 3 and 4i NEkSW%, NlrSEkSWk, WrrSW\,SE\SWra,
all in Section 30, T. 5 S., R. 92 W. of the 6th P.M.
2. That exemption is sought for the conveyance of a parcel
of land containing 3.37 acres, more or Iess, situated in said
NW%SWL, which is more specificalty described on the plat thereof
attached hereto as Exhibit rrArr and by reference made a part hereof.
3. The division of said 145.36 acre tract as proposed would
result in the creation of the above described 3.37 acre tract and
another tract consisting of the remaining 141.99 acres.
4. That the 3.37 acre tract which the petitioners propose
to convey has been surveyed and is the subject of a good and
proper lega1 description (see Exhibit rrArr attached) .
5. That a water well has been drilled and tested and presently
exists on said 3.37 acre tract. Attached hereto are Exhibits rrB'r
BEFORE
and "C", respectively, being a plat of said 3.37 acre tract
showing the location of the well and a copy of an invoice dated
JuIy L7, L976, from Glenwood Pump Company reflecting the results
of the pump test of said weIl.
6. That the Garfield County Environmental Hea1th Department
has determined that on-lot sewage disposal facilities are both
feasible and practical for servicing said 3.37 acre tract. A
copy of a letter dated March 24, 1976, from the Garfield County
Department of Health and Environmental Protection is attached
hereto as Exhbit rrDrr.
7. That said 3.37 acre tract is bounded on the east by
State Highway No. 325 providing said tract of land the necessary
access to a public road.
8. That petitioners are desirous of conveying said 3.37
acre tract to their son-in-law and daughter, Mr. and Mrs. Ken
Lowery.
9. That petitioners have no plans to further subdivide
the subject property.
