(1973) Section 30-28-l0l (.I0) (a) - (d) as amended, and the Subdivision Regulations of-Garfield County, Colorado, adopted September 1, '1972 and amended April 14, 1975, sections I .oz."l7 (d) and 3.02.0.l , for the .. division of a .l45.3 acre tract into two tracts of approximately 3.3 acres and 142 acres, more particularly described as follows: .A parce'l of land sftuated in the Nt,rl%SW% of Section 30, Township 5 South, Range 92 l,Jest of the Sixth Principal Meridian, Countyof Garfield, State of Colorado, lying Westerly of the Westerly right-of-way 1 ine of Colorado State Highway No. 325, Easterlyof the Wester'ly I ine of said Section 30 and Southerly of the East - West Centerline of said Sect'ion 30, said parcel of landis described as follows: Beginning at the l,lest Quarter Corner of said Section 30, thence N. 89o 56' 12" E. along the East-West Centerline of said Section 30,360.56 feet, more or less to a point on the Westerly right- of-way I ine of said highway; tlence a'long the l.lesterly right-of- way line of said highway S. ZSU 49' 00" hl. 171.67 feet; thence 123.00 feet along the arc of a curve to the left, having a radius of .l147.52 feet, the chord of which bears: S. 22o 44' 45" }'I. 122.94 feet; thence S. l9o 40' 3l" 1,1. 436.46 feet; thence leaving said highway right-of-way line N. l9o 19' 47" W. 93.'l5feet to a point on the Westerly line of said Section 30; thence N. 00o 0l' .l3" E. along the Westerly line of said Section 30, 661.25 feet, more or less to the West Quarter Corner of said Section 30, the point of beginning, containing 3.37 acres, moreor less. IIHEREAS, petitioners have demonstrated to the satisfactjon of the Board that there is a reasonable probabi'lity of locating domestic water on each of said 3.3 and 142 acre tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. ('1973) Section 30-28-101 (.I0) (a) - (d) as amended; WHEREAS, the granting of this request is made conditional upon the issuance of a driveway permit for said 3.3 acre parcel for ingress and egress to State Highway 325 by the.Colorado Division of State Highways. of /),k, J/r,r'zt;u-;seconded by i .,,. Zr-n--^-, - and unanimously carried said 145.3 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 3.3 acres and 142 acres, more or less, all as is more ful'ly described in the Petition pertaining hereto.
