HomeMy WebLinkAbout2.0 Resolution WolfRESOLUTION WHEREAS, MARGARET WoLF, has petitjoned the Board of County Conrn'issioners of Garfield County, Colorado, for an exemption under C.R-S. (1973) Section 30-28-l0l (.10) (a) - (a) as amended, and the Subdivision Regu'lations of Garfield County, Colorado, adopted Septenrber 1, 1972 and amended April 'l4, 1975, Sections 1.02..|7 (d) and 3.02.01, for the division of a .l.4 acre tract into two (2) tracts of approximate'ly .02 acres and .l.38 acres' more or less, and more particularly described as follows: Beginning at a point whence the StrJ corner of Lot B of said Grand Vi6w Subiivision bears South 25o l0' 45" West ?70.15 feet, also whence the SE corner of Section 34, Township 5 South, Range 89 West of the 6th Principal Merid'ian bears North 30o 0l' 00" West.l,649.6.1 feet; thence South 0lo 43' 30" West '195.82 feet to the northerly rig6t-ot-way line of U.s. H'ighway 6 & 24; thence south 810 22r !7rr East 1.l.l.87 feet along said northerly right-of-way line; thence North 01o 54r 30'r fait t96.20 feet; thence North 8lo 36' 30" West 11?.45 feet to the point of beginning, containing.50l acres) more or less; said tract of land being. the same as described in Book 393 at Page 568 of said Garfield County Records. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that she desires said exemption for the purpose of exchanging property with Mrs. Eulene Rankin, and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Cornmissioners of Garfie'ld County, Colorado, that no third- party ownership wilI be created by this exemption; and further that this exemption will not create an addjtional building site and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (.|973) Sectjon 30-28-10l (.l0) (a) - (a) as amended; NOI^J THEREFORE, uPon notion of seconded by and carried, said .l.4 acre tract of land is hereby exempted from such definition and transfer of said tract may made by division into two (2) tracts of .l.38 acres and'.02 acres, more be or less, aIl as is more fully described in the Petition relating hereto, and further that a proper legal description be prepared for said .02 acre parcel priorn to conveyan-ce, and further that said exemption will not create any third-party ownership. A copy of this instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this 25th day of Apri1, A.D. 1977.
