AND JUNE S. t'i0ODS have pet'itioned the Board of County Commissioners of Garfield County, Colorado, for an exempt'ion under C.R.S. (.l973) Sect'ion 30-28-l0l (.l0) (a)-(d) as aniended, and the Subdiv'ision Regulatjons of Garfield County, Colorado, adopted Soptenrber'l, .l972 and amended April .l4,.l975, Sections .l.02..l7(d) and 3.02.0.l, for the ciivision of a one acre tract of lancl into two tracts of approxirnately one-half acre each, more or less, and said one acre tract is rnore particular'ly described as follows A tract of land situate in the NELSI,J% of Section 2, T65, RB91,J,6th P.M., described as beginnlrrg at a po"int on a. South line of sa'id NE%Shlt6 North BBo lB' l,,test 285 feet fronr tlre southeast corner of said NEkSWr4; thence North 0o 02' lrlest 362 feet; thence North BBolB' I^lest I 20. 5 feet; thence South 0o 02' East 362 'i'ect; thence South BBo lB' East .l20.5 feet to the point of beginning, containing 1 acre, more or less. WHEREASo the Petitioners have demonstrated to the sat'isfact'ion of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re-sale into sing'le-family residential acreage; and, I,JHEREAS, the Petitioners have den'arnstrated to the satisfaction of the Board of County Commissioners of Garf"ield County, that there is a reasonable probability of locatjng domestic water on each of said tracts. that there is adequate ingress and egress to said tracts, that the'location of septic tanks will be permitted by the Colorado Department of Health, that the requested divisjon is in accordance with the general purposes and intent of the Subdiv'ision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exenrpted from the definition of the terms "subdiv'ision" and "subdivided land" as set forth in C.R.S. (.I9i3) Section 30-28-10l (.l0) (a) - (d) as amended; WHEREAS, the Petitioners have demonstrated to the Board of County Commissioners of Garfie'ld County that they have obtained a lot size variance for said .5 acre tract of land under the previous zoning from thc Garfjeld County Toning Board of Adiustment which sa'id action having taken place on August 30, .l973.
