PICE303 At a regular meeting of the Board of County Commissioners for Garfield Coln+ -y, Co1;1rado, held at the Courthouse in Glenwood Springs on Monday_, the 21st _ day Of September A.D. , 1987 there were present : Robert Richardson , Commissioner Chairman Larry Schmueser , Commissioner (absent - conflict of interest) -Marian I. Smith , Commissioner Don DeFord County Attorney Nildred Alsdorf , Clerk to the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 87- 94 RESOLUTION CONCERNED WITH VACATION OF PORT -IONS OF A COUNTY ROAD WHEREAS, representatives of the H. P. Williams, Jr. Trust have requested that the County abandon and vacate portions of County Road 138, as such lies adjacent to their property as described below; and WHEREAS, said applicants have agreed to convey property to the County for the purpose of mitigating the affect of such vacation; and WHEREAS, with such transfer the property described below is no longer necessary as a County Road; and WHEREAS, the Countv is entitled to vacate property by resolution pursuant to the provisions of Section 43-2-303(1)(b), C.R.S., as amended. NOW, THEREFORE, BE IT_ RESOLVED by the Board of County Commissioners of Garfield County, as follows: 1. That the Board of County Commissioners of Garfield County hereL)y vacate a portion of County Road 138 as such presently exists. Such vacated portion is described in Exhibit A, attached hereto. 2. That pursuant to such vacation, it is the understanding of the Board of County Commissioners of Garfield County that such property shall vest in title to the abutting property owner. 3. Such vacation does not leave, any land adjoining said roadway without any established public road connecting said land with another established public road. 4. That the County hereby reserves for continued use any existing rights-of-way or easements for sewer, gas, water, ditcr,. canal, electric, telephone and other such utility purposes.
