Dear Mr. Pollard;
This letter is provided to you as the applicant for an Amended Final Plat application
for Tracts 23, 25, 26, 28, and 39 of the Antlers Orchard Subdivision. The
application proposed an Amendment to the lot lines of the stated lots. The property
is known by Assessor Parcel Number 2127-363-00-003 and is located at 6448
County Road 233, S¡lt, CO 81652.
The Application has been reviewed in accordance with the Administrative Review
procedures contained in the Land Use and Development Code as amended. Said
provisions require a Decision by the Director of the Community Development
Department on whether to approve, approve with conditions, or deny the request.
The Director's Decision is hereby issued partially approving, with conditions, the
Application for an Amended Plat for Tracts 23,25, 26, 28 and 39 of the Antlers
Orchard Subdivision. This Decision is subject to the following Findings and
Conditions of Approval :
Findinss:
1. That proper public notice was provided as required for the Director's
Decision.
2. That the application, with the adoption of conditions, is in general
conformance with the 2030 Comprehensive Plan, as amended.
3. That with the adoption of conditions, the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as
amended.

Cond itions of Approval:
1. That all representations of the Applicant contained in the Application
submittals shall be conditions of approval unless specifically amended or
modified by the conditions contained herein.
2. Final review by the County Surveyor's Office shall be required and all edits
and corrections based on that review shall be completed prior to submittal
of the plat for signature by the Board of County Commissioners.
3. The plat shall be updated and edited prior to submittal for final review by the
Community Development Department and the County Attorney's Office as
follows (additional updates or changes may be required pending the final
review):
a. The Lienholder Consent and Subordination Certificate and the
Certificate of Dedication and Ownership shall be updated to reflect
the County Resource Guide.
b. The plat shall be updated to include the County Commissioner's
Certificate as reflected in the County Resource Guide.
c. Surveyor Note 5(c) shall be updated to correct the Reception
Number.
d. The Mineral Owners shall be included on the plat.
e. The plat shall be updated to show that Tract 39 and Tract 28 are not
being adjusted. Tract 26 shall remain in its original location, but shall
be merged with adjacent parcels as follows: the portion of Tract 26
that is south of the County Road shall be merged with the portions of
Tract 23 and 25 that are south of the County Road. The portion of
Tract 26 that is north of the County Road shall be merged with Tract
23 as shown on the submitted Plat. The remainder of the plat shall
be updated to reflect this change, including the title.
f. A plat note shall be added that states: "At time of Building Permit, the
applicant shall be required to address floodplain issues on Amended
Tract 26."
4. Once reviewed and approved for Mylar the applicant shall supply:
a. A plat Mylar with signed Certificates that include Dedication and
Ownership, County Surveyor's, Clerk and Recorder's, Taxes Paid,
County Commissioners', Surveyor, Title, and Lienholders
b. Recording Fees
The Land Use and Development Code requires notification to the Board of County
Commissioners for their review and potential call-up of the Director's Decision.
The Board review is for a period of 10 days commencing on the date of the
Director's Decision. The Amended Final Plat will be scheduled on the Board of
County Commissioner's consent agenda after expiration of the call-up period and
once all conditions of approval have been satisfied including editing of the plat and
acquisition of all necessary signatures. Please note that you will have 90 days from

the date of approval to submit a plat suitable for recording. Extensions of this time
period may be requested prior to the expiration of the original time limit.

questions regarding the Director's Decision and the next steps for finalizing your
Amended Plat.
