APPLICANT:V/allace Thatcher LOCATION:A tract of land located in a portion of Section 23, T3S, R87W of the 6ft P.M.; located approximately 7 miles west of the intersection of Sweetwater Road and the Colorado River Road in extreme, eastern Garfield County. SITE DATA:20.5 Acres WATER:Shared V/ell SEWER:Individual Sewage Disposal System (ISDS) ACCESS:Direct access to County Road 150 (Sweetwater Road). EXISTING ZONING:AiRIRD AD.IACENT ZONING:NorthÆast: O/S South/West: A/R/RD I. RELATIONSHIP TO THE COMPREHENSrVE PLAN The subject tract is not portrayed on the Garfield County Comprehensive Plan's Management Districts Map (1981; 1984 Plans), nor is it included within Study Area I (1995 Plan). il. DESCRIPTION OF THE PROPOSAL Site Description: The applicant's tract is 20.5 acres in size and located approximately one-half mile west ofthe GarfieldÆagle County line in extreme, northeastern Garfield County. County Road 150 transects the tract, with approximately 16.1 acres located north of the road and 4.4 acres located south of the road. Sweetwater Creek defines the southerly boundary of the tract and the Ide inigation ditch flows across the I A. e southerly portion. Additionally, the southerly portion has an existirtg single family dwelling and accessory dwelling, with the northerly portion largely unimproved. Slope acr.oss the tract varies; however, slope never exceeds 40Yo. See vicinity map, page' 6' Adjacent Land Uses: Land uses adjacent to and in the vicinity of the tract are largely residential and agricultural, with federal lands located in the vicinity. Development Proposal: The applicant proposes to subdivide, by exemption, the 20.5 acre tract into two (2) parcels of approximafely 16.1 and 4.4 acres each. The southerly parcel would contain the existing improvements and a new, single family dwelling would be developed on the northerly portion. See sketch map, page . ?. Itr. MAJOR ISSUES AND CONCER¡IS A.Subdivision Regulations: Section 8:52 (A) of the Garfield County Subdivision Regulations states that "No more than a total of four (4) lots, parcels, interests or dtuelling units will be createdfrom any parcel, as that parcel was described in the records of the Gørfeld County Clerk qnd Recorder's Office on January I, 1973. In order to quahfyfor exemption, the parcel as it existed on Januøry I, 1973, must høve been larger than 35 acres in size at that time and not part of a recorded subdivision; however, arry parcel to be divided by exemption that is split by a public right-of-way (State or Federal higlway, County road or railroad), preventing ioint use of the proposed tracts, and the division occurs along the public right-of-woy, such parcels thereby createdmøy, in the discretion oJ the Board, not be considered to høve been created by exemptionwith regard to thefour (4) lot, parcel, interest or ú,telling unit limitation otherwise applicable. For the purposes of definition, øll tracts of land 35 ãcres or greater in size, created after January I , I 97 3, will count as parcels of land created by exemption since January I, 1973;" The applicant has owned the land since 1952, when the tract existed of 28.1 acres. Since that time, at least two (2) property traq.fers^have occurred, reducing the property to its present size. See deeds, pæ"t J.ll However, the applicant is petitioning for exemption based on CR 150 divid^ing the tract and creating an impediment to joint ur.. S.. narrative pages l2.lI Zoning: The tract is within the A/R/RD zone district and both proposed lots are in excess of the two (2.0) acre minimum lot size requirement. Slope of the tract would not preclude development and there are no known natural hazards associated with the northerly parcel. The southerly parcel is constrained by Sweetwater Creek and the irrigation ditch; however, this parcel is not proposed for further development. Water. The existing single family dwelling utilizes a household and domestic well, approved for an annual diversion of one (1) acre foot of water. The exemption parcel B C B C -I o E D G H. is proposed to be served by a new household use well and application'has been made to the Division of 'Water Resources. This application was retur-ned-to_the applicant due to insuffcient information. See water infoimation, pagesl-1:L8. Itãppears likely that an approved augmentation plan or a change in use of irrigation water (to domestic use) would be required prior to issuance of a new or amended well permit. Soils/Sewer: The method of wastewater treatment is proposed to be the use of individual sev/age disposal systems (ISDS). According to the Soil Conservation Service, the soil on-site is classified within the Forelle-Brownsto complex, which also contains areas ofMussel and Morval soils, in the gently-sloped areas. When used for building site development and ISD systems, all soil classifications are considered to have moderate to severe constraints. Staffwould recommend a plat note indicating an engineered building foundation and engineered septic system may be required. Access: Access to the exemption parcel would be directly from CR 150 and a culvert has recently been placed in the swale on the north side of the road. During staffs site visit, Eagle County was in the process of grading its portion of the road and the Garfield County portion of the road appeared to be in very good condition. Sight distances along the county road would be sufücient and staff contemplates no serious issues associated with the access. If a driveway permit has not previously been issued by the Road and Bridge Department, staffrecommends the applicant consult with the Department regarding the access. Fire Protection: The subject tract is not located within a fire protection district. However, we have received confirmation that emergency services woul{þe provided by the Gypsum Fire Department, on a fee basis. See letter, pug"t-M:' . Staff recommends a plat note with the standard language concerning wildfire mitigation. Comprehensive Plan: The subject land is not classified within either of the existing Comprehensive Plans (1981; 1984) in effect for this area of the County. However, given its location and physical characteristics, staff suggests that the land, if classified, would have likely been considered as District D - Rural Areas/lVloderate Environmental Constraints. StaffComment: The likelihood of either a State approved water augmentation plan or a change in use of irrigation water places approval of this petition in a precarious situation. The augmentation plan would likely be costly and time-consuming and even if the change in use occurred, generally speaking, irrigation ditches do not flow year- round. Additional information relative to the water supply must be submitted prior to even a conditional approval being granted. School Site Acquisition Fees: The applicant would be required to submit $200 in school site acquisition fees, for the exemption parcel, prior to final approval. F I. Ò 5 o IV. SUGGESTED FINDINGS I That proper posting and public notice were provided as required for the meeting before the Board of County Commissioners. )That the meeting before the Board of County Commissioners was extensive yet incompletq that not all pertinent facts, matters and issues were submitted and that all interested parties were heard atthat meeting. V. RECOMMENDATION Due to the likelihood of a water augmentation plan or a change in use of irrigation water being required to amend or issue a well permit, staffrecommends this petition be continued to allow the applicant time to pursue the plan. Upon completion of the water supply, staff would recommend approval of the petition, pursuant to the following conditions: That atl representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lots, access to a public right-oÊway, and any proposed easements for setbacks, drainage, irrigation ditches, access, utilities, etc. That the applicant shall have 120 days to present aplat to the Commissioners for signature, from the date of approval of the exemption. The Board may Erant extensions of up to one (1) year from the original date of approval. That the applicant shall submit $200.00 in School Site Acquisition Fees, for the creation of the exemption parcel, prior to authorization of an exemption plat. That the recording fees for the exemption plat and all associated documents be paid to the County Clerk and Recorder prior to the signing of an Exemption Plat by the Board of County Commissioners and a copy of the receipt be provided to the Planning Department. That the exemption plat submittal include a copy of a computer disk of the plat data, formatted for use on the County Assessor's CAD system. That all proposed lots shall comply with the Garfield County ZonngResolution of 1978, as amended, and any building shall comply with the 1994 Uniform Building Code, as adopted by Garfield County. 1 2 J 4 5 6 7 ¡,/o x Prior to final approval, the Division of Water Resources shall issue the appropriate well permit and a formal, water-sharing declaration shall be submitted if the well is to be shared. If the well is not shared, the well on Lot 2 shall be drilled and pump-tested for four (4) hours duration, an opinion of the person conducting the pump test shall be submitted, stating the flow will be sufficient for the intended use(s). All information shall be submitted to the Planning Department for review. 9. That the following plat notes shall be included on the exemption plat: "The minimum defensible space distance for structures shall be 30 feet on level terrair\ plus appropriate modification to recognize the increased rate of fire spread at sloped sites. The methodology described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building envelopes in areas exceeding five (5) percent grade. " "The individual lot owners shall be responsible for the control of noxious weeds. " "One (1) dog will be allowed for each residential unit within an exemption and the dog shall be required to be confined within the owner's property boundaries, with enforcement provisions allowing for the removal of a dog from the area as a final remedy in worst cases." "No open hearth solid-fuel fireplaces will be allowed anywhere within an exemption. One (1) new solid-fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be allowed an unrestricted number of natural gas burning stoves and appliances." "All exterior lighting shall be the minimum amount necessary and that all exterior lighting be directed inward, towards the interior of the subdivision, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries." "There shall be no more exemptions from definition of subdivision allowed on any of the parcels created by this approval." "Soil conditions on the exemption site may require engineered septic systems and engineered building foundations. A single family house occupies the property. The owner of the property, Mr. Wallace Thatcher intends to convey the property on north side of the Sweetwater Road to his son, James. Jim Thatcher intends to construct a house on this land. Attached is a deed showing the parcel was in existence prior to 1973. As referenced above, the property is split by the Sweetwater Road (Garfield County Road 150). The proposed split of this property will be along this roadway. As part of the title research done in preparing this application, a Road Viewers Report fìled in the County Clerk's OfIice in September 24,1895, includes a reference to a 60 foot strip of land taken by the county from the government for the purpose of the Sweetwater Road. See attached record. The proposed exemption plat would rededicate this 60 foot wide right of way to Garfield County. We believe that this subdivision request is processed as an Exemption. The property is suitably zoned for the intended use for a single family residence. There is a reasonable location on the property to construct a house without undue earthwork and the land possesses no hazards related to its intended use. Although the property is not located within the Gypsum Fire District, the district does respond to calls in this area on a pay for service basis. All Fire Trucks responding to fires in this area carry 2,000 gallons of water and have equiprnent to pump out of nearby water sources. Sweetwater Creek is located ori Lot 1, approximately 500 feet from the proposed house location. There is a ditch running across the properfy. Mr. Thatcher owns water rights in the ditch which he has used to irrigate meadows his meadows. We have applied to the Colorado Division Of 'Water resources for a "Household Use Only'' well permit.
