Comprehensive Plan Management Districts, Map.

A. Site Dercrifrtion: The parcel is located adjacent to the Sunlight Inn, associated
#ff$ j}H::tlff.rarcel is currentlv undeveloped. A vicinitv map is

B. Project Dercrintion: Theapplicant isrequesting anexemption to split the 3.506
acre parcel into three (3) parcels of approximately .17 (7,500 sq. ft), .17 and
3.472acresin size. Theapplicants have sub^mitted asketch plan of the proposed
exemption parcel, as shown on pug\l-Z-_. ski Sunlight is requesting an
exemption to create two lots in order to build two residential town home
dwellings. One unit will be used by the resident manager, with the second unit
serving as a model for future development should the County approve a FUD
proposal to be submitted in the future.
C. Rackground: In 1988, Sunlight Inn and Realty Limited Co. received approval
for a two (2) lot exemption creating two parcels of approximately 1.752 and
3.506 acres in size. The Sunlight Inn currently occupies lhe l.7STacre parcel,
and the 3.506 acre parcel is the subject of this exemption request.
IU. MAJOR ISSUES ANN CONCFRNS
A. Subdivision Regulations. Section 8.52 of the Garfield'County Subdivision
Regulations state that "No more than a total offour (4) lots, parels, interests
or dwelling units will be created from any parcel, as that pard was dercribed in
the records of the Garlield County clerk and Recorder's Ollice on January l,
1973, and is not a part of a recorded subdivision; however, any parcel to be
diuided by exemption that is split by a public right-of-way (State or Federal
highway, Countyroadorrailroad) ornatural feature, preventingjoint useofthe
proposed tracts, and thedivision occunalong thepubticright-ofway ornatural
feature such parels thereby crcated may, in the discretion of the Board, not be
considered to have ben created by exentption with regard to'the four (4) tot,
parel, interest or dwelling unit limitation otherwtse applicabre;
As describe earlier, this parcel was subject to a two (2) lot exemption in 1988
(Reception 39077). At thetime of the 1988 exemption request, the applicant was
eligible for a four (a) lot exemption. Since no additional splits have occurred on
the property, the current request is consistent with requirements of Section 8.52.
No further exemption parcels can be created.
B. -nnin8. The C/L zone district allows for two-family and multiple-family
dwelling units. The minimum lot size within the zone district is 7,500 sqtnre
feet.
I egal Access. Ski Sunlight tnc. has agreed to grant an accesseasement to the two
parcels (see pag8 I 7 -;. The access easement will have to appear on the
Exemption Plat.
Water and Sewer. The Sunlight Ski Area has an absolute decree for water rights
that permits domestic, fi re protection, and commercial uses (Case No. W- I 2 I 6).
Based on discussions with the state Engineer's office, this meets the
requirements of both the State-jlnd the County. A copy of the ruling of the
referee is attached o., pug.'ll' .
By contract, the Sunlight Inn has the right to use the Ski Sunlight Wastewater
Disposal Facility. The facility is only at 60 percent capacity, and can handle the
two additional units (see letter from Thomas Jankovsky, General Manager onp"e€D,1.
State and Local Health Standards. No State or Local health standards are
applicable to the application.

r)rainage' No drainage easements appear to be necessary, but should be verified
on the l-reld by the applicant's surveyor.
Trire Protection. The proposed exemption is located in the Glenwood Springs
Rural Fire Protection District. Jack Jones, Assistant Chief of Glenwood
springs Department of EmergeAclServices, had no coilrments on the proposed
exemption (see letter onpug€ZO 1.

easements (if necessary) and any easements necessary

Staffrecommends APPROVAL ofthe application, subject to the following conditions:
l ' That all representations of the applicant, either within the application or stated
at the meeting before the Board of County Commissioners, shall be considered
conditions of approval.
2' A Final Exemption Plat will be submitted, indicating the legal description of the
property, dimension and area of all proposed lots or separate interests to be
created, access to a pubric right-of-way, and any proposed easements for
drainage, irrigation, access or utilities.
3' That the applicant shall have 120 days to present a platto the Commissionersfor signature. Extensions of time may be granted if requested prior to the
expiration date.
That the applicant submit $200 in School Impact Fees for the creation of each
new lot.

Enclosed you will find an application for a Floodplain Special use permit for a bridge for apriv.at-9 driveway crossing Four Mile Creek, and ior a single family resiclence that will bepartially in the floodfringe. The bridge proposed has a span of 50 feet (drawing enclosed),and the-roadway fi-ll necessary for the approiches to the bridge, as well as the abutrnents willencroach into the floodplain. No permanent structure is proposed to be place<l in t6efloodway; all proposed improvements will be located in itre hoodfringe area.
The elevations and clear opening under the bridge have been set such that no clrange in thebase flood elevation will occur. Approximately"one quarter to one third of the house isproposed to be located in the floodfringe area. However, the lowest finish floor elevatiorrwill be at least one foot above the floodplain elevation. T'lrerefore, the construction willcomply with the floodplain regulations.
We have also enclosed, .to aid your review, a portion of the Garfield County Flood InsuranceStudy base mapping. The property boundaries, clriveway, bridge, ancl hous! are all shown inrelation to the floodplain. The floodfringe is siraded yeliow, and the floodway is shadecl darkgrey' Our best interpretation of the avaiiable data iniicates that the governing flooclplainelevation for the house is 6344, and 6353for the bridge, on the Flood Insurance Studyd1'1't' (the High Country Engineering, Inc. clatum ior the site, which is based on the Cityof Glenwood springs aerial topography clatum, is seven feet higher.

Dear Mark:
l'his is a request ftrr a llorxlplain pernrit to allow three p<lnds and a concrete storage building
to be placed in the floodplain of the Roaring Fort River. The property is located along the
Rtlaring Fork River, in Section 32, Township 7 South, Range tiZ wrs[, and is found on the
Flood Insurance Rate Map, Community-Panel Number 080205-1880 (copy of pertinent
portion enclosed). 'Ihe ponds are a pennissible use untler Sections 6.09.01(2)(D) and
6.09.02(2) of the Garfield County Floodplain Regulations. 'I'he builcling is a permissible use
in the A/R/RD Zone District, and under the Floodplain Regurations.
The ponds are excavated below pre-existing ground elevation. All material excavated for the
ponds was removed fiorn the floodway. Due to the slight enlargement of the cross-sectional
flow area of the river, and the small percentage of the cross-section al'fected, the pontls will
have no impact on the established floodplain elevations.
The building is capable of withstanding the hytlrostatic and hydrodynamic loa<ls associated
with the flood waters in the flootlfringe area. The floor elevation is more than a foot above
the floodplain elevation. The builtling is for storage of nonhazardous materials antl will not
be inhabited.

This letter will describe tl"re water supply associated with the
1-7t acre parcel that you own on Missouri Ileiglrts. The propertyrs
water supply orlginated with the decreelng of the orLeary Well No.
1 for fS-qpm in Case No. 81CW137, Water Dlvision No. 5. ThaL water
right was- decreecl as the 'only well located on a 401 acre parcel to
be utilized for domestic and irrigation use (irrigation of up to l-
acre of lawn and garclen). This was decreed as a cotrditional water
right and cliligen-e has been maintained on tl're water rigtrt througlr
successlve proceedings. The next dillgence proceeding where an
Application to I{ake Absolute the subject waLer right is due to be
fiied is in December of 1993. Ilowever, recent legislation extended
the period for the finding of reasonable diligence from a four year
period to a six year period. Tl1eref ore, dh extension may be
secured in December to exLend the filing deadline to December of
1995.
A permit was originally obtained for ttris well, again, as the
only well locatecl on the 40+ acre tract wittr an explration date of
April 19, LgTB in Permit No. 83357. Subsequently, the property was
clivicled into two lots with you taking title to tl're 17* acre parcel.
Whil.e there is a good argument that can l:e made that )rou l'Iould be
errtitlecl Lo a weIl permlt under the clecreed water righb for
domestic ancl irrigation purposes, in my opitrion, you would not be
able to secure a well permit for tlre well gxempt from adrnlnlstra-
tiorr slnce ttre property is t1o longer 35 acres in size as required
under C.R.S., 37-92-602 (1) . Accordingly, a housetrold-use-on1ypermit can be obtained for the property. This will allow the
provision of water for irr-house use in one single family residence
irrd associated livestock. No on-site irrigation would be permitted
uncler a household-use weIl permit and arguabty the State could talce
the position that a caretal<er unit could not be serviced by the
well.
To avoid this scenario and provide a firm }egal water supply
for your property, w€ will be providing an Application for Water,
AIlotment Contract to the Basalt Water Conservancy District. Your
