HomeMy WebLinkAbout1.0 ApplicationBEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION • Pursuant to C.R.S. 106-2-33(3) (d) (1963), as amended, the undersigned, William M. Zilm and Charlotte B. Zilm, petition the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution a parcel of land owned by them, all as more fully set forth and described herein, and for the reasons set forth herein: 1. During the year of 1966 Petitioners purchased a parcel of land 3.19 acres in size from Chester Axthelm which parcel is outlined in red in Exhibit A attached hereto. 2. During the year 1966 a water well was drilled, which well has since been adjudicated to your Petitioners for .09 cubic feet per second of time, which well is located in Parcel No. 2 indicated on Exhibit A attached hereto. 3. During the year 1967 your Petitioners built a single family residence and located a 1,500 -gallon "poured in place" septic tank all on Parcel No. 1 indicated on Exhibit A. Parcel No. 1 is now used and shall continue to be used solely as Petitioners` own residence. 4. During the calendar year of 1968 your Petitioners caused to be prepared a survey, the result of which is Exhibit "A", dividing the property as shown. 5. During the calendar year of 1969 Charles R. Zilm and Rose M. Zilm, the parents of William M. Zilm, purchased Parcel No. 2 from your Petitioners and constructed their single family residence thereon, which residence is also•served by the well and septic tank heretofore described. No documents were placed of record evidencing the sale, but the Board of County Commissioners of Garfield County, Colorado granted an exemption for Parcel No. 2 on October 2 , 1972. 6. Although your Petitioners divided the parcel as indicated, and as evidenced by the September 25, 1968 survey, they failed to have documents recorded evidencing such division. Upon information and belief, as of this date, record title to Parcels 1 and 3 is in your Petitioners and record title to Parcel 2 is in Charles R. Zilm and Rose M. Zilm. Parcel 1 is subject to a first lien of Majestic Savings and Loan Association and Parcel No. 3 is subject to a first lien in favor of the Bank of Glenwood. c 7. The Petitioners desire to utilize Parcel No. 3 as a separate building site as originally planned and provided for in 1967 and 1968. The County Sanitarian has issued a permit for the installation of an aerobic system for sewage treatment, and the existing well on Parcel 1 has been adjudicated for .09 cubic feet per second of time or approximately 45 gallons per minute, which is more than ample for three residences. Access to the property through the Chelyn Acres Subdivision roadway easements have been existing and in use for more than four years and are adequate for the three residences herein described. WHEREFORE Petitioners request that the Board of County Commissioners of Garfield County, Colorado grant them an exemption for Parcel No. 3 as described in Exhibit "A" attached hereto. A parcel of land in Tract No. 2 of the Chelyn Acres Sub -Division situated in the WI of Section 3, Township 7 South, Range 89 West of the Sixth Principal Meridian is described as follows: Beginning at a point on the Northerly line of said Tract No. 2 whence the Southwest Corner of said Tract No. 2 bears: N.89'46'50" W. 210.90 feet and S.07'54'00" W. 309.19 feet; thence S.89'46'50" E. 221.33 feet along the Northerly line of said Tract No. 2 to a point on the Easterly line of said Tract No. 2; thence 215.00 feet along the arc of a curve to the right, having a radius of 218.45 feet, the chord of which_bears: S.01422'12" W. 206.42 feet; thence N.89"46'50" W. 245.05 feet;. thence N.07'54'00" E. 208.29 feet, to the point of beginning: The above described parcel of'land contains 1.19 acres, more or less.
