HomeMy WebLinkAbout2.0 ResolutionRESOLUTION WHEREAS, William M. Zilm and Charlotte B. Zilm have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption for one 1.19 acre tract of land under C.R.S. 106-2-33 (3)(d) (1963 as amended); and WHEREAS, Petitioners have shown to the satisfaction of the Board of County Commissioners that they desire said exemption for said 1.19 acre tract for the purpose of clarifying record title to the parcel described as Parcel No. 3 on Exhibit "A", which was separated by survey not later than 1968, and WHEREAS, Petitioners have demonstrated to the satisfaction of the Board that there are presently existing one single family dwelling on Parcels No. 1 and 2; one water well, one septic tank system, and the roadways of Chelyn Acres which are now and have been providing adequate service and access to all parcels, and WHEREAS, that the separation of Petitioners'. land is not reasonably within the purposes of the Subdivision laws of the State of Colorado or the County of Garfield and therefore said tract should be exempt from the definition of the terms "Subdivision" and "subdivided land" as set forth in C.R.S. 106-2-33 (3)(d) (1963 as amended). / NOW, THEREFORE, upon motion of L7 yf7/( 7"/ / , seconded by �•t 4!)y and unanimously carried, said 1.19 acre tract, being described as follows: PARCEL NO. 3 A parcel of land in Tract No. 2 of the Chelyn Acres Sub -Division situs ted in the W2 of Section 3, Township 7 South, Range 89 West of the Sixth Principal Meridian is described as follows: Beginning at a point on the Northerly line of said Tract No. 2 whence the Southwest Corner of said Tract No. 2 bears N. 89°46'50" W. 210.90 feet and S. 07°54'00" W. 309.19 feet; thence S. 89°46'50" E. 221.33 feet along the Northerly line of said Tract No. 2 to a point on the Easterly line of said Tract No. 2; thence 215.00 feet along the arc of a curve to the right, having a radius of 218.45 feet, the chord of which bears S. 01°22'12" W. 206.42 feet; thence N. 89°46'50" W. 245.05 feet; thence N. 07°54'00" E. 208.29 feet, to the point of beginning. Containing 1.19 acres, more or less. is hereby exempted from such definition and transfer of Parcel No. 3 may be made by William M. Zilm and Charlotte B. Zilm. A copy of the instrument of conveyance when recorded shall be filed with this Resolution. N,t_a9 i
