I RELATIONSHIP TO THE COMPREHENSTVE PLAN The subject property is located in District C - Rural Areas Moderate Environmental Constraints as shown on the Garfield County Comprehensive Plan Management Districts Map. DESCRIPIION OF THE PROPOSAL Site Descrifrtion: The subject parcel is located east of the Panorama Mesa Subdivision, on the north side of County Road 233. Improvements on the site include a 10'x 50'mobile home located at the southeastgornerof theproperty. ffi:[":".5gri:iling, with native vegeration. i.gicinity map is shown A. C. Request: The applicant is requesting to split the7.7l3 acre parcel into two (2) parcels os approximately 2.25_and 5.46 acres in size. A sketch plan of the proposed ir .t o*n on pug. 30 . UI. MAJOR ISSTIES AND CONCERNS l. Section 8:10 (Applicability-Exemptions) states that the Board has discretionary authority to except a division of land from the definition of subdivision. Following a review of the facts of each application, the Board may approve conditionally or deny an exemption request. The Board may not grant an -3b- exemption unless the applicant can demonstrate compliance with zoning, legal acrcess, adequate water and sewer, state environmental health standards, necessary road and drainage improvements, fire protection, adequate easements and school impact fees. Fremntion Criteria. Section 8:10, states that the Board may approve a total of four (4) lots parcels, interests or dwelling units, as that parcel was described in the records of the Garfield County clerk and Recorder's offrce on January l, 1973. The parcel existed asa7.713 acre parcel in July of 1966 (Book 4l2,Page 144, Reception #250502). Therefore, up to tour (4) parcels can be created through the exemption process, although the size of the parcel would only allow three (3) parcels under the A/R/RD zoning. Water and Sewer. The applicant has applied for a well permit for the exemption parcel. An existing well is located on the property serving the existing mobile home. The existing well did not have a permit, and the applicant has also applied for a permit to legitimize the existing uses. Planning staff referred the application to the State Engineer's Offrce on June 22nd, 1994. To date, no response has been received. Staff would suggest that a positive response be a condition of approval. In addition, any conditions\ imposed by the State will also be a condition ofapproval, including possible plat notes. Sewage disposal will be handled by ISDS. Predominate soil on the site is the Potts type (#55). Soils within this classification are considered to have or*t moderate constraints for ISDS, due to slow percolation rates. At the time of ' building permit, the County will verify site-specil.rc conditions on the site. Natural Hazards. The site is not identified as have soil, slope or ISDS constraints by the Lincoln-Devore Hazards Mapping. Therefore, no plat notes or conditions of approval are necessary. Existing Ditches. The deed submitted with the application identifies existing ditch easements on the property. Staffwould suggest that all easements for the use and maintenance of the existing ditch rights shall be shown on the hnal exemption plat. The applicant should contact the Farmer's Irrigation Ditch Company regarding specifi c easement requirements. w.STTGGESTED FTNDTNGS The proposal is in general compliance with the Garfield County Comprehensive Plan and the Garfield County Zoning Regulations. The proposed land use would be consistent and compatible with the existing surrounding land uses. The proposal is in best interest of the health, safety, morals, convenience, order, prosperity and welfare ol the citizens of Garlielcl County. 2. 4. 5. l. 2. 3. o e7' v.RECOMMENTTATION v APPROVAL, subject to the following conditions: l. 8. o 2. All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (1) year. The applicant shall submit $200 in School Impact Fees, prior to the signing of an exemption plat. A final exemption plat will be submitted, indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access and utilities. A driveway permit, if necessary, shall be obtained from the Road and Bridge Department prior to signing of a flrnal plat. Control of noxious weeds is the responsibility of the property owner. A favorable response from the State Engineer's Offrce shall be received by the Planning Department prior to the signing of a final Exemption Plat. USFS Wildflue Protection Guidelines shall be followed for all structures. Easements for the use and maintenance of the existing ditches shall be shown on the hnal plat. 3. 4. 5. 7-C?
