Dear Dave,
We are in receipt of the subdivision exemption referral lor a 7.713 acre parcel located on
Garfield County Road 233, approximately 1.5 miles north of Silt. The applicant is proposing to
split this parcel into two parcels of 2.25 acres and 5.46 acres. An existing well, permit no. 63980,
appears to be located on this 7.713 acre parcel and is proposed as the water supply for one of
the parcels. A new well is proposed for the other parcel.
The existing well, permit no. 63980, was issued for domestic purposes on September 5,
1972. The use of this well cannot be expanded and is limited to historic use only. The
availability of a well permit for the other parcel is subject to the following conditions:
The Colorado River system and its tributaries at this location are over-appropriated. As
such, well permits applications in new subdivisions must be evaluated to determine if other water
rights would be injured considering the cumulative etfect of all proposed wells. lt is likely that
in many circumstances well permits could not be issued by our otfice without a water court
approved plan for augmentation. However, under current statutes, if the Garfield Board of
County Commissioners approves this split by exemption as defined in Section 30-28-101(10)(d)
C.R.S., our otfice must evaluate the well permit applications as if the division of land occurred
prior to June 1 ,1972.
Under current laws, Section 37-92-602(SXbXllXA) C.R.S., and hydrologic conditions, it
appears that our otfice could in this circumstance approve a well permit for ordinary household
purposes inside a single-family dwelling provided that the well would be the only well.on the
individual parcel, return flow would be to the same stream system in which the well is located via
a non-evaporative disposal system, and that evidence is submitted showing that the County has
approved the parcel as an exemption. Absolutely no outside uses, including irrigation and the
watering of animals, are allowed under this type of permit.

Dear Ms. Thunder:
We have received the information you resubmitted concerning the above referenced
applications. As previously stated in my December 16, 1994 letter to you and in my July 29, 1994
letter to Garfield County, well permits may be available if only one well will be located on each
parcel. According to the exemption plat you submitted, it appears both wells will be located on
lot 2. (l-he waterline easement indicated on lot 2 does not constitute a separate parcel.) ln order
for us to issue the requested permits, the well for lot 1 must be located on lot 1. Two possible
options are as follows:
1. Amend the proposed well location for application receipt no. 373650-A (lot 'l) to place
the well on lot 1. This will require a new well be constructed on lot 1 and one of the two
wells on lot 2 must be plugged and abandoned.
2. Amend the property lines for lots 1 and 2 so each of the existing wells are located on
a separate parcel. You will need to submit a copy of a County approved plat that shows
.the change in the property lines. The location of each of the two wells should be located
on the plat to indicate that the wells are on separate parcels.
Make sure all corrections and/or additions made to the application forms are typed or
printed in BISCK INK and dated and initialed by the applicant. or the authorized agent of the
gppL!9al!. A letter of authorization, siglted by the applicant, is required if scmeone other than
the applicant will make the changes.

Dear Ms. Thunder:
Thank you for submitting a copy of the Garfield County Resolution for the Thunder
Exemption. The Resolution indicates that 7.36 acres was split into two lots of 4.80 acres (lot 1)
and 2.56 acres (lot 2). As previously requested, please amend item #7 on both applications to
reflect the new parcel sizes. Also, make sure to indicate the lot number in item #6 on both
applications to clarify which application applies to which lot. Finally, the proposed well locations
(item #6) on the applications appear to place both wells on the eastern lot (lot 1). lt is unlikely
that two permits could be issued for the same lot. Please check the proposed well locations and
amend as needed to place each well on the correct lot. lt would be helpfulto submit a copy of
the final exemption plat.
Make sure all corrections and/or additions made to the application forms are typed or
