RELATTONSHIP TO THE CO},IPREHENSIVE PLAN The site is located in Dj-strict C, Rural Areas with Minor Environmental Constraints, as designated on the ComprehensivePlan Management District's Map. rT. DESCRIPTION OI' THE PROPOSAI A. Site Description: The site is in a gently stoping ruralresidential area of the County. There are a number ofsingle family homes in the vicinity of this tract. Thereis an existing house on the property. The remainder ofproperty consists of grazing lands. B. Project Description: The applicants are proposing todivide a 29 acre tract into four (4) parcels, two (2) atnine (9) acres each and 2 at five (5) acres each. Theexisting residence is served by an existing well. Theapplicants have applied to the Divisi5n of WaterResources for 2 additional we1ls. If approved, there would be three (3) wells serving the four parcels, one(1) well for each of the 5 acre parcels and one wellsplit between the 2 nine acre parcels. Sewage disposalwould be accomplished by individual septic tank/Ieachfield systems. 3 of the 4 lots have direct access onto County Road 100. The fourth lot will be served by aprivate ingress/egress easement. (See map on page. -? ) III. MAJOR ISSUES AND CONCERNS: 1. Staff has investigated the history of the subjectproperty with records available at the County Assessor,soffice. The property has existed in its currentconfiguration since prior to January 1, L973. No splitsby exemption have been made. 2- The soils information indicates that the area is werlsuited for homesite development. There are suggestionsfor pre-wetting the foundation area to minimize theshrink/swell potential and that the I.S.D.S. absorption field may need to be slightly enlarged due to moderatepermeabitity. Neither of these issues are a serious concern that would limit the development. The applicants have applied to the Division of YIater Resources for a permit to construct 2 wells on the newly created parcels. If the Board of County Commissioners authorizes the creation of 4 parcels, it should be notedthat both State Statutes and Garfield County Subdivision Reg"ulations require that the Board receive verificationof adequate domestic water prior to the approval of theresolution and recordation documents creating the newIots. No environmental constraints, including topography andsoils, would preclude the development of the property for residential and associated uses. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided asrequired by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that aII pertinent facts,matters and issues were submitted, and that aLlinterested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of thecitizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the applicant submit evidence of a domestic water source for each of the proposed parcels, consisting ofwell permits or other verification acceptable to the Board of County Commissioners, prior to any formalresolution creating the tracts. 2. That the applicant obtain driveway access permits, or aIetter stating the permits would be issued, from the County Road and Bridge department for all new accesspoints onto County Rd. 100. 3. That the applicant prepare an acceptable ingress/egress easement providing access to the interior 5 acre parcel and that this easement be properly documented on the exemption plat. 4. That the applicant submit $500 in School Impact fees forthe creation of 3 new lots. 5. That aII representations of the applicant, either withinthe application or stated at the meeting of the Board of County Commissioners, sha1l be considered conditions ofapproval. 6. That the exemption plat include the following note:a) No further divisions by exemption wiII be allowed. 7. A plat shall be presented to the Board of County Commissioners within 180 days of approval. Failure tosubmit a plat within the required period wirr reguire anapproved extension of time. 3. 4. -2-
