RE: Tassada Subdivision Exemption Conditions of Approval
Dear Ms. Tassada:
On April 6, 1998 the Board of County Commissioners conditionally approved the Exemption from
Subdivision for John Bershenyi. The approval was subject to the filing of an exemption plat and
completion of the following conditions:
1. That all representations of the applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions of
approval.
2. A Final Exemption Plat shall be submitted, indicating the legal description of the
properly, dimension and area of the proposed lot, and any proposed easements for
setbacks, drainage, irrigation, access or utilities. The well easement shall be a minimum
of 10 ft. wide along the water line and 20 ft. square around the well.
3. That the applicant shall have 120 days to present a plat to the Commissioners for
signature from the date of approval of the exemption.
4. That the applicant shall submit $400.00 in School Site Acquisition Fees for the creation
of the exemption parcel and $5600.00 for rcad imFact fees prior to the approval of an
exemption plat.
5. That the following plat notes shall appear on the Final Exemption Plat:
"Control of noxious weeds is the responsibility of the property owner."
"One (1) dog will be allowed for each residential unit wittrin a subdivision and the dog
shall be required to be coofined within the owners property boundaries."

"No open hearth solid-fuel fueplaces will be allowed anywhere within an exemption.
one (1) new solid-fuel btrming stove as defied by c.R.S. 25-7-401, et. seq., and the
regulations promulgated theretrnder, will be allowed in any dwelling unit. All dwelting
units will be allowed an unrestricted number of natural gas burning stoves and
appliances".
"All exterior lighting be the minimum amount necessary and that all exterior lighting be
directed inward, towards the interior of the subdivision, except that provisions may be
made to allow for safety lighting that goes beyond the property boundaries".
"Soil conditions on the site may require engineered septic systems and building
fotrndations."
"All residential construction will be consistent with the Colorado State Forest Service
(CSFS) recommendations for construction of homes contained in the CSFS publications
"Wildfue Protection in the Wildland/Urban Interface" and "Model Regulations for
Protecting People and Homes in Subdivisions and Developments."
"The legal and adequate source of domestic water for lots

"Garfield County has adopted a "Right to Farrn" provision in the Garfield County Zonng
Resolution in Section 1.08, which states among other things, that "residents and visitors
must be prepared to accept the activities, sights, sounds and smells of Garfield Courty's
agricultural operations as a normal and necessary aspect of living in a County with a
strong rural character and a healthy ranching sector."
That all recorlmendations contained in a February 4, 1,998 letter of the Rifle Fire
Protection District related to the posting of an address, road construction and constuction
materials, will be considcred conditions of approval.
Prior to the approval of an exemption plat, the applicant will demonstrate that the well
will meet the following:
That a fow (4) hour pump test be performed on the well to be used;
A well completion report demonstrating the depth of the well, the
characteristics of the aquifer and the static water level;
The results of the fou (a) hour pt'mp test indicating the p"mping rate in
gallons per minute and information showing drawdonm and recharge;
A written opinion of the person conducting the well test that this well
should be adequate to supply water to the nunber ofproposed lots;
An assumption of an average or no less than 3.5 people per dwelling unit,
using 100 gallons of water per penrcn, per day;

Enclosed please find a well test done by Samuelson Pump Co. and a water quality test done by Grand
Junction Laboratories. I believe that Frank Harrington from High Country Engineering has already delivered the
mylar to your ofEce. Donna Tassada will bring by a check in the amount of $6,000.00 to cover the road impact
fees of $5,600.00 and School site acquisition fees of $400.00.

After reviewing your letter with the County Attomey, your client's cotrcems regarding his ability
to exempt parcels from his ownership, there does not appear to be a remedy. The exemption
process does not have a provision in the regulations dealing with who has the right to request the
exemptions from the definition of subdivision. As such, the Cormty has dealt with this tlrpe of
application on a first come, first serve basis. ., ,,

Our client. Kevin Wheeler. personal representative of the Estate of Max Wheeler, who owns
the property situate immediately East of that which is the subject of this application,
requests that you deny the application insofar as it would create more than two (2) parcels
out of the existing 65 acre tract.
Mr. Wheeler's estate owns a 51 acre parcel which was held jointly with the Tassada property
until division earlier this year. It appears the original tract of approximately t1O icres
should be exempted from subdivision into not more than a total of four (4) separate tracts.
The present request would use up the remainder of the possible exempted parc-els. This will
detract from the value of the Wheeler Estate property which has equil or better basis to be
divided into two (2) tracts than does the Tassada parcel into three (3) tracts.
