RELATIONSHIP TO THE COMPREHENSIVE PLAN The proposal is located in a section of Garfield County Lhat has not been assigned a management district designation' II. DESCRIPTION OF THE PROPOSAL A. Site Description: The parcel is a relatively flat bench, meadow area just above the Sweetwater Creek drainage. B. project Description: The 40 acre parcel has four cabins on it, presentiy. the proposal is to create 4 tracts on which the cabins are iocated , for the- pulpose of selling direct interest ownership. Direct interest ownership i; the same as snaring or interval ownership. III. II{AJOR CONCERNS AND ISSUES A. Comprehensive PIan: If the project were prosposing to increase density in the area by creation oi additionil fots for dwelling unit purposes, then it would be appropriate for the Planning Commission to evaluate and assign a management district. In this instance, it does not seem necessary. Staff Comments: I. This proposal is unique to Garfielo County in that the applicants are technically creating 2OB separate interest via the creation of ',direct interest ownership" in the four existing cabins. Because there are separate interests being created, the project falls under the definition of a subdivision as a result of the separate interests created. It is the recommenoation of the County Attorney that the Commissioners use the authority in Section 3t Resolution No. 80-65, to exempt the Sweetwater Wilderness Ranch from the definition of subdivision since the proposal does not increase densities beyond what is already existing. 2. The application includes a survey that includes Parcels 1r 2,3, 4 and tract 40. The creation of the Parcels Lr 21 3 and 4 would constitute a subdivision and would normally require subdivision review. The creation of interval or direct interests in Tract 40 is not considered a subdivision that requires regular subdivision rev iew . 3. Environmental Health has indicated that the existing septic system should be inspected to determine whether or not it is adequate. B. -6- IV. RECOMI'IENDATrON: The Board approve an exemption from the definition of the "Tract 40u andthe creation of direct interest or interval interest ownership subject tothe following conditions: 1. That the proposed survey be for the purposes of defining the locationof Parcels 1, 2, 3, and 4 and that the total land separated equaleight (8) acres, such that each parcel has two (2) acres. 2. That, within L20 days, the Environmental Health Office inspect theexisting septic system and if upgrade or replacement of the system is recommended, the appropriate permits be obtained. 3. That the corporation be Iiable for aII tax assessments and that the County Attorneyrs office review the lega1 documents creating thecorporation and documents that will be used to convey individualinterests in the corporation. 4. That County Road 150 be improved by the developers to the satisfactionof the Board of County Commissioners and the County Road Supervisor. 5. That any further subdivision of this property shall go through fullsubdivision review. -7-
