MackleyElmer (Buckey) ArbaneyDon DeFord0when the following proceedings, among others were had and done, to-wit:RESOLUTION NO96-ttA RESOLUTION CONCERNED WITH AMENDING RESOLUTION NO. 93-071, WHICHAPPROVED AN EXEMPTION FROM THE DEFINTIION OF SUBDTVISION FOR THESUNLIGHT INN AND REALTY LIMITED ßIC., SUNLIGHT INNWHEREAS, SUNLIGHT INN petitioned the Board of County Commissioners of GarfreldCounty, Colorado, for an exemption from the def,rnition of the terms "subdivision" and'subdividedland" under C.R-S. 1973,30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations ofGarlreld County, Colorado, adopted Aprit 23,lg9[,Section 8:00 through 8:60 and for the division ofa 3.506 acre tract as described in Reception 390977, as filed in the Offrces of the Clerk and Recorderof Garfield County, Colorado, into three parcels ofapproximately 9083 sq. ft., l043i2sq. ft., and 3.06açres each, more or less, with the s¡emption parcels more practically as follows:Lot 2R (see attached)Lot2A (see attached)Lot 2B (see attached)(in the State of Colorado and the County of Garfield); and\MHEREAS, the Petitioners have dernonstrated to the satisfaction of the Board of CountyCommissioners of Garfield County, Colorado, that the proposed division does not fall within thepu'rposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reasonthat the division does not warrant further subdivision review; andIVHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of CountyCommissioners of Garfreld County, Colorado, that there is a reasonable probability of locatingdomestic water on each of said parcels, that there is existing ingress and egress to said parcels, that thelocation of septic tanks will be permitted by the Colorado Department of Health, that the requesteddivision is not part of an existing or larger development and does not fall within tl.e general purposes--t)- vav\,\t Lu¡ù - -^- uiaJtlr1.u.
