The Territories Mountain Club property is approximately 40 acres located near Fourmile Park
above Sunlight Ski Area. This subdivision exemption is being requested to create 4 lots that
are7.5 to 15.5 acres in size fbr future sale as residential building sites.
Access to the property is from Fourmile Road as shown on the enclosed Sketch Plan. Access
easements will be provided for the existing private access road. Any necessary utility
easements will also be provided. The homeowners will participate in an agreement or
association to maintain the private access road.

Water supply will be from a shared well; the location of the well is shown on the Sketch Plan.
The well pump test results and water quality analysis indicate that the well has sufficient water
of acceptable quality. Wastewater treatment and disposal will be with individual sewage
disposal systems.

property, dimension and area of all lots or separate interests to be created, access to
a public right-of-way, and any proposed easements for drainage, irrigation, access or
utilities; and
vicinity map at a minimum scale of l"=2000'showing the general topographic and
geographic relation ofthe proposed exemption to the surrounding area within two (2)
miles, for which a copy of U.S.G.S. quadrangle map may be uied; and
Copy of the deed showing ownership by the applicant, or a letter from the properry
owner(s) if other than the applicant; and

200 feet ofthe proposed exernption, mineral owners and lessees of minerals owners

APPLICABILITY
The Bgard of County Commissioners has the discretionary power to exempt a division of Iand from
the definition of s.rbdivision and thereby from the procedure in these Regulations, provided the Board
determines that such exemption will not impair or defeat the stated purpose-of the Subdivision
Regulations nor be detrimental to the general public welfare. The Board shall make exemption
decisions in accordance with the requirements of these regulations. Following a review oi the
individual frcts of each application in light of the requirements of these Regulatiois, the Board may
approvg conditionally approve or deny an exemption. An application for exemption must satisfy, at
a minimum, all of the review criteria listed below. Compliance with the review criteria, howeuer,
does not ensure ocemption. The Board also may consider additional factors listed in Section 8:60
of the Subdivision Regulations.
A No more than a total of four (4) Iots, parcels, interests or dwelling units will be created
from any parcet as that parcel was described in the records of the Garfield County Clerk
and Recordeds Office on January l, 1973. In order to qualiff for exernptiorl the parcel as
it existed on January l,lg73, must have been 35 acreeor greater in size at that time and
not a part of a recorded zubdivision; howwer, any parcel to be divided by exemption that
is split by a public right-of-way (State or Federal highway, County road or railroad),
prweming joim use ofthe proposed tracts, and the division occurs along the public right-of-
way, such parcels thereby created may, at the discretion of the Board, not be considired to
have been created by oremption with regard to the four ( ) lot, parcel, interest or dwelling
unit limiution othenuise ap'plicable. For the purposes of definition, all tracts of land 35 acres
or greater in size, created after January l, 1973 will count as parcels of land created by
exemption since January l,1973.

This deep, well drained, rolling soil is on alluvial fans and
sides of valleys. Elevation ranges from 5,000 to 6,500
feet. This soil formed in alluvium derived from red-bed
shale and sandstone. The average annual precipitation is
about 14 inches, the average annual air temperature is
about 46 degrees F, and the average frost-free period is
about 120 days.
Typically, the surface layer is reddish brown channery
loam about 13 inches thick. The substratum is reddish
brown, light brown, and pink very channery sandy loam
and very cobbly sandy loam to a depth of 60 inches.
lncluded with this soil in mapping are small areas of
Begay and Morval soils. The Begay soils have slopes of
6 to 12 percent. The Morval soils are in higher lying
areas and have slopes of 3 to 12 percent. These areas
make up 10 to 15 percent of the map unit.
Permeability is moderately rapid, and available water
capacity is moderate. Effective rooting depth is 60
inches or more. Surface runotf is slow, and the erosion
hazard is moderate.
This soil is used mainly for wildlife habitat and grazing.
The native vegetation on this soil is mainly wheat-
grass, needleandthread, and sagebrush.

alluvium derived from red-bed shale and sandstone. The
average annual precipitation is about 14 inches, the
average annual air temperature is about 46 degrees F,
and the average frost-free period is about 120 days.

and large stones. Cut slopes should be revegetated im-
mediately to reduce erosion and prevent gullying.
This soil is in capability subclass Vle, nonirrigated.
16-Clmarron loam, 2 lo 12 percent slopes. This
deep, well drained, nearly level to undulating soil is in
narrow mountain valleys and drainageways. Elevation
ranges from 7,500 to 9,000 feet. This soil formed in
alluvium derived from basalt. The average annual precipi-
tation is about 18 inches, the average annual air tem-
perature is 39 degrees F, and the frost-free period is less
than 75 days.
Typically, the surface layer is dark grayish brown loam
about 4 inches thick. The subsoil is grayish brown silty

clay loam and silty clay about 29 inches thick. The sub-
stratum is dark gray silty clay to a depth of 60 inches.
lncluded with this soil in mapping are small areas of
Cochetopa .and Jerry soils on small hilly undulations
within the drainageways. Slopes are more than 12 per-
cent. These areas make up 5 to 10 percent of the map
unit.
Permeability is slow, and available water capacity is
high. Effective rooting depth is about 60 inches or more.
Primary roots that reach below a depth of '16 inches
follow cracks in the soil. Surface runotf is medium, and
the erosion hazard is moderate.
This soil is used mainly for limited grazing and wildlife
habitat.
The native vegetation on this soil is mainly ldaho
fescue, bromes, wheatgrasses, and sagebrush.
When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, undesira-
ble weeds and annual plants are numerous. Reducing
brush improves the range. Properly managing grazing
maintains and improves range condition. Seeding im-
proves range in poor condition. Preparing a seedbed and
drilling the seed are good practices. Mountain or smooth
brome, intermediate wheatgrass, and pubescent wheat-
grass are suitable for seeding.
Elk, deer, black bear, and grouse find habitat on this
soil.
Use of this soil for community development, for sani-
tary facilities, and as a source of constructicn material is
limited by the high clay content, which causes a high
shrink-swell potential, slow permeability, and low
strength. Special designs for foundations and septic tank
absorption fields overcome these problems.
This soil is in capability subclass Vle, nonirrigated.
'|7-Gochetopa loam, 9 to 50 percent slopes. This
deep, well drained, rolling to steep soil is on mountain-
sides and alluvial fans. Elevation ranges from 7,000 to
9,500 feet. This soil formed in basaltic alluvium. The
average annual precipitation is about 20 inches, the
average annual air temperature is about 38 degrees F,
and the average frost-free period is less than 75 days.
Typically, the surface layer is dark grayish brown loam
about 21 inches thick. ln some areas an organic layer as
much as 4 inches thick is on the surface. The subsoil is
brown stony clay loam and stony clay about 24 inches
thick. The substratum is pinkish gray stony clay to a
depth of 60 inches.
lncluded with this soil in mapping are small areas of
Jerry and Lamphier soils. The Jerry soils are stony on
the surface and make up 10 to 15 percent of the unit.
The Lamphier soil is stone-free and has a cover of
aspen.
Permeability is slow, and available water capacity is
high. Etfective rooting depth is 60 inches or more. Sur-
face runotf is slow, and the erosion hazard is severe.
SOIL SURVEY
This soil is used mainly for limited grazing and wildlife
habitat.
The native vegetation on this soil is mainly Gambel
oak, bromes, and elk sedge.
When the range condition deteriorates, forbs and
shrubs increase. When the range is in poor condition,
Kentucky bluegrass, undesirable weeds, and annual
plants are numerous. Properly managing grazing main-
tains and improves range condition.
Elk, mule deer, blue grouse, and snowshoe hare find
habitat on this soil.
Community development is limited by the shrink-swell
potential caused by high clay content, low strength, and
steep slopes. Building foundations, roads, and sanitary
facilities can be designed to overcome these limitations.
Keeping cuts to a minimum and placing them carefully
help to lessen soil slumping. Drainage and structures to
control runoff from snowmelt help to avoid deep satura-
tion of the soil around construction sites and roads.
This soil is in capability subclass Vlle, nonirrigated.
I8-Cochetopa-Jerry complex, 12 to 25 percent
slopes. These moderately steep to hilly soils are on
mountainsides. Elevation ranges from 7,000 to 9,500
feet. The soils formed in alluvium derived from sand-
stone, shale, and basalt. The average annual precipita-
tion is about 20 inches, the average annual air tempera-
ture is about 40 degrees F, and the frost-free period is
less than 75 days.
The Cochetopa soil makes up about 50 percent of the
map unit, and the Jerry soil makes up about 40 percent.
The Cochetopa soil is deep and well drained. Typical-
ly, the surface layer is dark grayish brown loam about 21
inches thick. The subsoil is brown stony clay and clay
loam about 24 inches thick. The substratum is pinkish
gray stony clay to a depth of 60 inches.
Permeability of the Cochetopa soil is slow, and availa-
ble water capacity is high. Effective rooting depth is 60
inches or more. Surface runotf is slow, and the erosion
hazard is moderate.
The Jerry soil is deep and well drained. Typically, the
surface layer is dark grayish brown stony loam about 3
inches thick. The subsoil is yellowish brown and light
brown cobbly clay loam about 37 inches thick. The sub-
stratum is light brown cobbly clay to a depth of 60
inches.
Permeability of the Jerry soil is slow, and available
water capacity is high. Etfective rooting depth is 60
inches or more. Surface runoff is slow, and the erosion
hazard is moderate.
lncluded with these soils in mapping are small areas of
Lamphier, Bucklon, and lnchau soils that have slopes of
more than 25 percent. These areas make up about 10
percent of the map unit.
This complex is used mainly for grazing and wildlife
habitat.
NIFLE ABEA, COLORADO
The native vegetation on these soils is mainly Gambel
oak, elk sedge, and bromes.
When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, Kentucky
bluegrass, undesirable weeds, and annual plants are nu-
merous. Properly managing grazing maintains and im-
oroves range condition. Seeding improves some less
stoping areas of range in poor condition. Preparing a
seedbed and drilling the seed are good practices. Moun-
tain or smooth brome, orchardgrass, and intermediate
wheatgrass are suitable for seeding.
Elk, deer, black bear, and grouse find habitat on these
soils.
Community development is limited by the high clay
content, low strength, and steep slopes. Building founda-
tions, roads, and sanitary facilities can be designed to
overcome these limitations. Drainage and structures to
control runotf from snowmelt are needed to avoid deep
saturation of the soil around construction sites and

and .lasalt. The average annual precipitation is about 20
inches, the average annual air temperature is about 40
degrees F, and the frost-free period is less than 75 days.
The Cochetopa soil makes up about 50 percent of the
map unit, and the Jerry soil makes up about 40 percent.
The Cochetopa soil is deep and well drained. Typical-
ly, the surface layer is dark grayish brown loam about 21
inches thick. The subsoil is brown stony clay and stony
clay loam about 24 inches thick. The substratum is pink-

20-Cryaquolls, nearly level. This broadly defined
unit consists of poorly drained soils in swales and on
bottom land of valleys. Elevation ranges from 7,000 to
9,500 feet. The average annual precipitation is about 18
inches, the average annual air temperature is about 39
degrees F, and the average frost-free period is less than
75 days.
These soils range from sandy loam to clay throughout
and are commonly stratified. The surface layer is black
to very dark brown. ln places an organic mat is on the
surface. Sand and gravel is at a depth of 2lo 4 feet in
some places.
Permeability is moderate. Surface runoff is slow, and
the erosion hazard is slight. The water table is at a depth
of 10 to 24 inches at some time during the growing
season. These soils are subject to annual flooding.
lncluded in mapping are small areas of peat and
marsh.
These soils are used mainly for wildlife habitat. Some
areas are used for irrigated hay and pasture.
The cold climate and short growing season limit pro-
duction of introduced grasses. lnigation water should be
managed to prevent ponding. Subsurface drainage and
fertilizer are needed to maintain production of hay. Slen-
der wheatgrass, smooth brome, and creeping meadow
foxtail are suitable for seeding.
The native vegetation includes tufted hairgrass, slen-
der wheatgrass, sedges, rushes, reedgrass, willows,
shrubby cinquefoil, and numerous forbs.
The total annual production of air-dry forage averages
2,500 pounds per acre. Nitrogen and phosphorus fertiliz-
er is needed late in spring to replace nutrients lost during
spring snowmelt.
These soils are typically wet and produce abundant
wetland vegetation. Mallard, teal, shorebirds, beaver,
mink, and muskrat find habitat on these soils. Shallow
water developments increase the use of the areas by
wetland wildlife. To manage these soils for wetland wild-
life, grazing by livestock should be controlled and fences

4. Deqtes and Delivery: Exchange releases made by the Distict out of storage fiom Rudi Reservoir and Green
Mountain Resenroir, or other works or facilities of the District, or fiom other sources available to the District, shall be delivered to the
Applicarf at lhe outld wsls ofsaid $aagp ftcilities a d the decreed point of diversion fm said other sources, and release a delivery of water
at sudr ordrtaproints shall constitrte perbrrmncc ofthe District's total obligation- klivery ofwater by the District fiom Ruedi Resenoir

15. Restuidiqrs: Aplicant shall rcstrict actual diversions to nd exceed the Cqrtact/Lease amount, wtrich provides
water (on the formula ofone acre foC per drreUing) fm ordinary household purpc€s inside one single family dwelling the uatering of
domestic livestoclq fire protectiorq and the inigation of up to 6,ffi0 square fwt of lawn and garden.
Applicant shall also comply with all restricions and limitations s€t forth in the well permit obtained frorn the Colorado
Divisior of Water Resources.
Watering of livestock shall be restided to Applicant's domestic anirnals not to be used frr comrnercial purposes unless
Applicant obtairc approml furn tre Colfrado Divisisr ofWaH Resources for conrmercial use/livestock watering at a horse boarding facility,
provided that in no svent shall actual diversions exoeed the amount ofrvater provided by this Curhacf/I-ease.
Violation ofthis paragraph 15 shall be deerned to be a material brerch ofthis Contact/t ease.
16. Well Permit If Applicart irilEnds to divert through a well, then Applicant must provide to District a copy of
Applicanfs valid well p€rmit bcfor€ District is obligated to deliver any water hereud€r.

Applicants cmtract/lease h€r€in in a wat€r cqrt filing for alternate point of diversion or plan of augmentation, then Applicant hereby agrees
to pay to the Disnicg when assesse4 an additiqral fee representing tre District's actr.ral and reasonable costs and fees for Applicant's share
ofthe proceedings. Applicant shall be assessed a pro-rata share ofrhe t@l cost incurred by the Disfiict in preparing filing and pursuing to
decree the water court case. The prorata share shall be calculated by dividing such total cost by the number of contracteeVlessees included
in ffrs filing; To $e aGlilhat fte Diseict is caused additional mts because of objection filed specifically due to the inclusion of Applicanfs
contracMlease in the filing, such additiqral costs may bo dmrged spcifically to Applicant and not shared on a pro-rata basis by all

I have reviewed the enclosed well test for the Mountain Club Well conducted by Aqua-Tec
Systems. The results of the well test indicate that this well should be adequate to supply 350

I have reviewed your proposal for fire protection for the Hilton subdivision exemption consisting
of a letter dated August 29h and a Fire Protection Plan dated August 28n,2000.
In order for final approval to be given the following changes must be made to the Fire Protection
Plan.
1. Agreements and Maintenance
The property owner shall agree to submit plans for approval to the Glenwood Springs Fire
Department on all items listed in the Fire Protection Plan prior to construction. The Fire
Protection Plan shall be made apart of the plat notes of the approved plat recorded in Garfield
County.
I look forward to receiving the final Fire Protection Plan for this property with the required

1. Water Supply
Water supplies for fire fighting shall consist of a minimum 3000 gallon storage tank from which the
fire department can take suction or receive water under positive pressure. This storage tank shall be
separate from domestic water supply. Outlets for these tanks shall be a standa rd 4 Yz-inch hydrant
connection. A4%-inchto2/z-inch connection shall also be provided. Venting and piping shall be
arranged so that a minimum flow of S00 gpm shall be maintained.
Outlets from these tanks shall be in a location approved by the fire department. The location shall be
no more than 150 feet from the building envelope or fire sprinkler connection if the residence is so
equipped.
2. Automatic Fire Sprinklers
Each residential structure shall have an automatic fire sprinkler system conforming to NFPA 13D.
Normally these systems have a duration requirement of ten minutes. Because of the remote location
of these residences, the sprinkler system shall be connected to the tank providing water for fire
protection.
3. Road and Access Requirements
Road and access requirements shall be in conformance with Article g of the UFC and requirements
contained within the Glenwood Springs Emergency Services development guidelines. Knox boxes
shall be provided at any gates that might block access. Maximum road grade shall be 10%. Any
variance from these requirements shall be reviewed and approved by Emergency Services.
4. Fire Alarm Systems
The fire department will respond to activation of automatic fire alarms only when:
A. A flow switch on the fire sprinkler system is activated.
B. A RP for the residence or a runner for the fire alarm company has confirmed an emergency.
5. Wild Fire Protection
Chapter 8 of NFPA 299 shall be used as a guide for structural location, design and construction. A
site analysis by the colorado State Forest service shall be requested.
6. Agreements and Maintenance
The property owner shall agree to provide their systems for the benefit of others when needed by the
fire department. The property owner shall provide yearly inspection reports that the required
systems and wild land mitigation requirements are maintained as required.

RE: Territories Mountain Club Subdivision Exemption Application
Dear Mr. Belau,
The Garfield County Planning Deparbnent has completed an initial review of the Territories Mountain Club
Subdivision Exemplion application and has determined that the application is not in technical compliance with our
regulations. As such, the following issues need to be addressed:
1. Section 8:41 of the Garfield County Subdivision Regulations state, An applicationfor exemption shall be
accompanied by the following maps:
A. Sketch map, at a minimum scale of l":200', showing the legal description of the property,
dimension and area of all lots ot sqatate interests to be created, access to a public right-of-way,
and any proposed easemmtsfor drainage, irrigation, access or utilitiq; Bolding added for
emphasis.
The dimensions of all four (4) proposed lots have not been included on the submilted map. Please
note that the private road cannot be included as part o16[s dimensions or area of any of the
proposed lots. In addition, proposed or existing easements for drainage, irrigation, access or utilities
inc[uding their dimensions have not been indicated on the submitted m4p. If some of these do not
exisg or are not proposed please indicate as such. Please include this information on the map and
submit it to the Plarining Department. Since access to the proposed lots is to be via a private road,
this private road right-of-way needs to include a full legal description with dimensions on the map.
It appears on the submitted map that proposed lot 4 does not atut the private road. Please indicate
ho*lot 4 would gain access to the private road. In addition, since a well is to be shared by the four
(4) proposed lots, an easement, with a legal description including dimensions, mu{ b9 included on
the map to provide water from the well to all proposed lots. Please also indicate all other necessary
easements for utilities including but not limited to electricity.
2. Section 8:42 of the Garfield County Subdivision Regulations states, The following supplemental
information regarding the proposed exemption shall be filedwith the application:

Although school fees will be determined and paid prior to any plat being recorded, proof of taxes
paid up-to-date is required at this time. Please submit inforrnation from the County Treasurer's
office to this effect.

ADDITIONAL CONSIDERATIONS
In the evaluation ofeach petition for exemptioq and in addition to the review criteria
in Section 8:52, the Board shall consider the following:
A. General conformance with the Garfield County Comprehensive Plan;
B. Compatibility of the proposed exemption with existing land uses in the
surrounding area;
C. Recommendations of any municipality within two (2) miles ofthe proposed
exemptiorq or within ttree (3) miles, if the municipality has a major street
plan;
D. Recommendations of any state or local agency or organization whose opirion
the Board determines is necessary or appropriate;
E. Suitability ofsoil, water, vegetatiog geologic and topographic characteristics
of the land for the type of division proposed;
F. Number of lots and/or multiple-dwelling units created by the proposed
exemption;
G. Provision for open space within the proposed exemption;
H. Proposed density and provisions for adequate off-street parking; and
L Covenants and plat notes, restricting the lots to the following:
l. One (l) dog will be allowed for each residential unit within a
subdivision and the dog shall be required to be confined within the
ownet's property boundaries. The requirements shall be included in
provisions allowing for the removal of a dog from the area as a final
remedy in worst cases;
2. No open hearth solid-fuel fireplaces will be allowed aqrwhere within
an exemption. One (1) new solid-fuel burning stove as defined by
C.R.S. 25-7401, et. sew., and the regulations promulgated
thereunder, will be allowed in any dwelling unit. All dwelling units
will be allowed an unrestricted number of nattrral gas burning stoves
and appliances; and
