Last week I was assisting my mother in listing her property, commonly known as 845 County Road 296, Rifle, Colorado,
for sale with a real estate agent. This property is identified by PIN 212936100008. My mother, Gloria Kay Elliott, has
requested that I contact you on her behalf regarding this matter'
During this process we discovered that the property was listed on the County map as residential urban rather than
commercial. ln l-9g0, my parents entered into a joint effort with Rifle Fireside, lnc., now known as the bowling alley, to
have both properties rezoned to commercial. This rezoning request was granted. The bowling alley is designated
correctly on the map. We have been advised that somewhere along the line, the county had a scrivener's error in the
mapping and that while the property is properly zoned as commercial, it is not properly reflected on your maps or other

records, lt is our understanding that the county is willing to correct their scrivener's error at their expense and that this
may require public notices, for which the county will cover all expenses.
The county has permission to place any notice signs needed on the property or in the newspaper to corrcct thic
scrivene/s error and ensure the property is properly documented on any and all of your maps and records.

AMENDMENT TO THE GARFTELD COUNTY ZONING RESOLUTTON REQUESTED
BY TIRESTDE, INC,, AND JACK ELLTOTT AND GLORIA ELLTOTT.
?IHEREAS, Rifl-e Fíreside , T;\c. , and Jack and Gloria
Elliott have filed a petition with the Board of County com-missioners of Garfield County to rezone the herein described.property in Garfield County from Agricultural,/Residential/Rural Density Zone District to Commercial/General zoneDistrict; and

CERTIFICATION OF MINERAL OWNER RESEARCH
This form is to be completed ond submitted with øny application for o Lond Use Chonge Permit'
Mineral interests may be severed from surface r¡ght interests in real property. C.R'S' S 24-65.5-IOL, et seq,
requires notification to mineral owners when a landowner applies for an application for development from a
local government. As such, the landowner must research the current owners of mineral interests for the
property.
The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4-101(EXLXb)(4) requires
written notice,to owners of mineral interests in the subject property in accordance with C'R.S. S 24-65.5-t0t'
et seq, "as such owners can be identified through the records in the office of the Clerk and Recorder or
Assessor, or through other means." This form is proof of applicant's compliance with the Colorado Revised
statutes and the LUDC.

required pursuant to C.R.S. 5 24-55.5-10 !, et seq, and Section 4-101 (EX1l(bX4) of the Garfield County Land
