WHEREAS, LAWRENCE C. TAYLOR, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-
28-101(10) (a) - (d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections
1.02.17 (d) and 3.02.01, for the division of a 1,040 acre tract into four tracts
of 10, 10, 10, and /olo acres, more or less, and said _/,040 acre tract i:s'
more particularly described as follows:
Township 6 South, Range 92 West of the 6th Principal Meridian.
Section 27: SW -1, except approximately 17 acred conveyed by
Document No. 53155 and by Document No. 57472 of the Garfield
County Records and except also approximately 8 acres conveyed
by Document No. 57472 of the Garfield County Records. Section
33: East 2 and SE4NW4, Section 34: West 2 and SE -14, Section
35: SW, of SW'4
WHEREAS, Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners that said 10 acre tracts are currently developed with
single-family residences, that the said 10 acre tracts have individual sewage
treatment systems which were constructed at the time of initial construction of
the single-family dwellings, and that each 10 acre tract has access to an
adequate supply of portable water, that the requested subdivision is in accordance
with the general purposes and intent of the Subdivision Regulations of the State
of Colorado and the County of Garfield and should, therefore, be exempted from
the definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended;
NOW THEREFORE, upon motion of p6lvPv.,_ e_a�` seconded by
�rvLSg acs and carried, said ,040 acre tract is hereby exempted
from such definition and transfer of said tract may be made by division into
four (4) tracts of 10, 10, 10, and 1,010 acres, more or less, all as is more
fully described above, and further that said exemption is conditioned upon the
granting of the necessary easements for the purpose of delivering domestic water
to each site and that said water be delivered to each 10 acre parcel, and also
that a proper legal description be prepared for each 10 acre site prior to its
conveyance. A copy of the instrument(s) of conveyance when recorded shall be
filed with this Resolution.
