"(47-/.74 WHEREAS, Janet F. Kistler has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d) as amended, and the Sub- division Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 40.0 acre tract into three (3) tracts of approximately 10.0 acres, 10.0 acres, and 20.0 acres more or less, and said tracts. "A", "B" and "C" are more particularly described as follows: Tract "A" The NW1/4NW3 NE' of Section 23, T.7S., R. 88W. of the 6th P.M. Tract "B" The SW'NWt NE' of Section 23, T.7S., R.88W. of the 6th P.M. .1441 Tract "C" The EkiN NES of Section 23, T.7S., R.88W. of the 6th P.M. All in the State of Colorado and County of Garfield. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that she desires said exemption for the purpose of resale of said tracts into single-family residential acreage. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general, purposes and intent of the Subdivision Regulations of the State of. Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d) as amended; N04•4, THEREFORE, upon the motion of seconded by (i'2- and carried, said 40 acre tract :vided; tract may be conveyed i:n the form of such smaller tracts withou' urther compliance with the aforesaid subdivision statutes and regulations , rovi:ded, however, that said exemption i:s conditioned.: on the Petitioner a%nin. roper: ;legal description of .;.said: tracts.. prior to .any.. nveyance thereof Further, this exemption is •granted, on the condition with .the express'understandi.ng and :agreement of the Petitioner that further:: exemptions; be.: allowed;.;on:'said; trac 5, :...: Copy, -.of: the nstrument or -instruments of. conveyance when ,recorded 'shall e filed with:•this Resolution.
