subdivision exemption application was complete, except for lhe informadon rcquested in
paragraphs 4, 5 and 8 of John Barbee's May 24, 1999lener. The purpose of rhis tener is to
provide the missing informadon-
First, with respecr ro paragraph 4, ir is my undersranding thar Virginia did submir a
receipr indicating thar the Fire Districr impacr fees have been paid. Subsequenr ro our
Ielephone conversation, I undersrand rhat you confirmed with Virginia that you had reccived
rhat receipl.
With res;rct ro paragraph 5, Lines in Space has se you a revised exemprion plat
showing all of the Wilson pmperq, as one Eact and depicting rhe subdivision of Lors A,
B and C. In addition, the revised plar includes plar notes requested io Mr. Barbee's lecer.
I asked Marge ar Lines In Space to forward rJre revised plat directly ro Mr. Phelps so thar he
can begin his requircd review ofthe plat as soon as possible.
Wirh respect Io paragraph t, I am enclosing infonoarion from Collins Well Drilling &
Pump Co. sening fonh all of rhe infonnation you requested. The enclosed Well Consrrucrion
and Test Repons for cach well sets forth the deprh of rhe wcll, the static watcr levcl. thc
rcsuls of the four hour pump tcst, and lhe characterisdcs ofrhe aquifer. The enclosed
Oqober lE, 1999 lener ltom Dennis Whi[le Io Mark Bean ses fonh the draw down and
recharge rates. Finally, the December 6, 1999 lener from Bill Collins conrains a wricen
opinion rhat the wells are adequale ro supply waler to no less than 3.5 persons per dwelling
unir using 100 gallons of watcr per person per day.

This serves to confirm our telephone discussion yesterday. Not having received
the requested prior notice of the Wilson Exemption and Resolution on the County
Commissioner's Agenda, speaking for my client, I requested that the Commissioners
continue the ltem allowing time to confirm that the tendered plat conforms with their
conditions. Those conditions include compliance with the legal description of the prior
settlement agreement between the parties.
Without the prior notice, I was unaware of the pending closing and other matters
scheduled for this week requiring the Commissioners' approval of the resolution and
plat. I spoke with Mr. Colin Diehl, attorney for the Wilson project, and he assures me
ihat the plat conforms with the terms of the seftlement. Should any amendments to the
plat be required, of necessity, Mr. Diehl further agrees to cooperate in obtaining those.

Dear Applicant,
This letter is to inform you that your request for a Subdivision Exemption has been
approved by the Board of County Commissioners with the following conditions:
That all representations ofthe applicant, either within the application or stated at
the meeting before the Board ofCounty Commissioners, shall be considered
conditions of approval.
A Final Exemption Plat shall be submitted, indicating the legal description olthe
property, dimension and area ofthe proposed lot, 25 ft. wide access to a public
right-of-way, and any proposed easements for setbacks, drainage' irrigation. access
or utilities.
That the applicant shall have 120 days to present a plat to the Commissioners for
signature from the date ofapproval ofthe exemption.
That the appticant shall submit prior to recordation ofthe final plat, $235.00in
Fire District Impact Fees for the creation ofthe exemption parcel.
That the following plat note shall appear on the Final Exemption Plat:
"Control ofnoxious weeds is the responsibility ofthe property owner."
"One (l) dog will be allowed for each residential unit within a subdivision
exemption and the dog shall be required to be confined within the owners
property boundaries. "
"No open hearth solid-fuel fireplaces will be allowed anywhere within an
exemption. One (1) new solid-fuel burning stove as defied by C.R.S. 25-7 -401,
et. seq., and the regulations promulgated thereunder, will be allowed in any
dwelling unit. All dwelling units will be allowed an unrestricted number of
natural gas burning stoves and appliances'.

'All exterior lighting be the minimum amount necessary and that all exterior
lighting be directed inward, towards the interior of the subdivision exemption,
except that provisions may be made to allow for safety lighting that goes beyond
the property boundaries'.
"Garfield County has a Right-to Farm-and-Ranch regulation, which recognizes
the important contribution agriculture makes to this County. Nuisance
complaints made against customary and legal agricultural operations and
practices will not be pursued."
"Specific geological hazards may be encountered during the placement of
structures and septic systems. Site specific analysis for placement may be
required. "
The applicant shall conform to the requirements for fire protection as indicated in the
2123196letter, and obtain a new evaluation ofthe proposal from the Carbondale and Rural
Protection District prior to recordation ofthe final plat.
The applicant shall provide a well sharing agreement prior to recordation ofthe final
exemption plat.
Prior to the approval of an exemption plat, the applicant will demonstrate that all wells
will meet the following:
1)That a four (4) hour pump test be performed on the well to be
used:
A well completion report demonstrating the depth of the well, the
characteristics of the aquifer and the static water level;
The results of the four (4) hour pump test indicating the pumping
rate in gallons per minute and information showing drawdown
and recharge;
A written opinion of the person conducting the well test that this
well should be adequate to supply water to the number of
proposed lots;
An assumption of an average or no less than 3.5 people per
dwelling unit, using 100 gallons of water per person, per day;
The water quality be tested by an approved testing laboratory and
meet State guidelines concerning bacteria, nitrates and suspended
solidsl
If any well is to be shared, a water sharing agreement will be
filed with the exemption plat that defines the rights of the
property owners to water from the well.
