SUBJECT: Zilm Senate Bill 35 Exemption Request
As per your request, I have reviewed the above referenced subiect
and have the following comments:
Inspection by the Colorado Department of Heaith on September 9'
i982 reported both the water and wastewater facilities were in
compl iance with existing reguiations.
The treatment capacity of the sewerage facility is I isted as
adequate and the addition of two additional single family dwell ings
is not expected to have an adverse effect to the system.

Enclosed for information is a copy of a Quit Clain Deed by
which witliam M. ZiIm is guit clairning to himself a parcel of
land containing 2.018 acres, more or less, for ultinate
conveyance to a third party. This parcel is shown as Parcel 1 on
a Lot Boundary Adj ustnent uap which Dr. Zilm recorded on January
13, Lgg4, in Ltre ottice of the clerk and Recorder, as Reception
No.457944.
Parcel 1 is a portion of the property which was the subject
of Garfield County Resolution No' 83-42, granting a subdivision
exenption to Dr. zi1m. The boundary of the property has been
aajultea as reflected by the adjustment map' a copy of which I
understand Dr. zilm has delivered or will be del j'vering to you.
In accordance with our telephone conversations on January 10
and 11, Igg4, no boundary line adjustrnent docurnentation has been
filed and recorded, other than the above-referenced map. You
indicated that, since the remaining property which $ras the
subject of Resolutj-on No. 83-42 had never been deeded out,
adj ustrnent within the context of the exernption without further
recordings would be acceptable. The enclosed deed and the nap
will cornplete your file in this regard.

Dear Mr. & Mrs. Zilm:
Recently, a homeowner in the Sunlight View subdivision questioned our ofllce about a l '0 acre
lot offered for sale in the Glenwood Post. After reviewing a 1983 subdivision exemption file
in which you created three parcels o12.0, 7.8 and 37.8 acres, it appears that the proposed 1.0
acre lot is in the same area. If this is correct, please be advised that the A,/R/RD zone district's
minimum lot size is 2.0 acres. Thus the creation ol a 1.0 acre tract would not be legal'

lt appears that you are proposing to reduce the 7.8 acre site in size and increase the remaining
lot in size. This is possible to do, provided the new lots meet the minimum lot size requrrements
of the zone district. If you have any questions about this issue, please call me or Dave
