well drained, moderately sloping soil is on mesas. bench-
es, and sides of valleys. Elevation ranges lrom 5,OOO to
7,000 feel. This soil formed in alluvium derived from
sandstone, shale, or basalt. The average annual precipi-
tation is about 14 inches, the averaga annual air tein-perature is.about 46 degrees F, and the average frost-
free period is about 120 days.
Typically, lhe surface layer is brown loam about 4inches thick. The subsoil is reddish brown clay loam
about 24 inches thick. The substratum is pinkish white
loam to a depth of 60 inches.
lncluded with this soil in mapping are small areas of
Olney, Kim, and lldefonso soils thai have slopes of 3 to
6 percent. These areas make up 10 to t5 percent of the
map unit.
Permeability is moderate, and available water capacityis high. Efiective rooting depth is 60 inches or hore.
Surface runoff is slovv, and the erosion hazard is moder-
ate.
. This soil is used mainly for inigated crops and hay andIor dryland farming (fig. 10). Atfatfa, sma grains, andgrass-legume hay are grown. Small areas are used lor

. These soils are usually irrigated by ,looding. Drop
structures in irrigation ditches, grassed waterways, and
minimum tillage prevent serious erosion. lnigation water
should be caretully managed to avoid piping ind erosion.

Pheasant, mourning dove, cottontail rabbit, some mule
deer, and squirrel find habitat on this soil.

The Potts soil makes up about 60 percent of the map
unit, and the lldefonso soils makes up about 30 perceni.
The Potts soil is on sllgh y concave positions, and the
llderonso soil is on lhe breaks ol steeper slopes.
The Potts soil is deep and well drained. iypically, the
surface layer is brown loam about 4 incheC thick. The
subsoil is reddish brown clay loam about 24 inches thick.
The substratum is pinkish white loam that exlends to a
depth ot 60 inches.o

State Engineer's Oflice; and
WHEREAS, the Owner d€sires to s€t forth in writing the conveyance ofrights to and the
agreement concemiflg the ownership ofthe wrll and rerated improvements, the use and maintenance ofthe Well, and the rights and obligations ofthe futurc partiG conceming theWell and the use ofthe
water therefrom.
NOW, THEREFORE, for and in consideration ofthe mutual promises contained herein, thc
parties agree ar follows:
1. Lot I owner, Lot 2 owner and Lor r owner slnll each own an undivided lR interest in said wcll,
rclated irprovementsod wate. right associated lherewith. The Lot 2 Owner hereby quitclaims tol,ot I Ownerand Lor.3 Owne.r, each an undivid€d l/l interct in said well, related imirovements
and water right associated therewirh. The intent ofthe foregoing conveyance to be thir the rhree
future Lot Owners shall each have an equal right to use an iqual arnount ofthe water produced
from the well to provide domesric water supply for one singti family residence on each ofthe
respective Lots to the extent permitted by law.
2. Thereaffer, any Lot Owner shall have the right to rrdertalc, without the consent of the other
panies' all repairs and improvements reasonably required to alleviate an emergency whe.eby water
supplies are threatened or curtailed by emergency reasoos or factors. Non-emergency repairs,
re!,lacements, improvements and activitier shall be made by rnutual agreement. In the event that
parties can not mutually decide upon what improvement, operation, m-aintenance, or replacemort
rctivities are necess.r.y and proper, any party may provide notice in writing ofa iist of repairs,
improvements or re!,lacements, together with a budget ther€fore. Unless tie other parties object in
writing within founeen ( I4) days ofreceipt ofsaid Notice, consent to such shall be deemed
conclusively given. tn the event objection is timely made, the parties agree to mutually select one
qualified professional engineer or well driller to make recommefldationJand a budget and ro be
bound by such recommendstions and budget.
3. Each Lot owner connected to the well agers thar the combined outside usage ofwate. production
from thc Well shall be limited to the inigation ofnol more thar 43,560 squaic feet of lawn and
gardens (14,520 sq. ft. each to Lot I, Lot 2 and Lot 3) supplied by the W;ll (wirh each party
sharing in such proportionately subject lo the reasoflable in-hous€ requiremens ofeach lot,
together with car washing aod other incidenlal uses).
4. Out sidc water hydra,ts may be install€d aod tsed as long as the use doesn,t adversely effect the
waler pressure and/or supply to any other party. Once hydrants are in place, they musi be
maintained at the expense ofthe parcel owner where the hydrant is located. Written permission
must be graflted before a hydrant may be placed on a water tine belonging to anothe, party. Afre,
installation, ifthe hydrants are not properry maintained a request ofmutuil consent ofhvo ofthe
three lot Owners may be made in writing to have fte hydrant removed at the users expense
5. In the event that any party experiences water pressure or quantity problems, that party may give
notice to the other parties oftheir intent and desire to increase well pump capacities and,/oi ro
constnrct up to 1000 gallons ofunderground wat€r storage wilhin thc easements described in

paid on s monthly basis. (ln the event Parcel I is not conneded lo thc well, parcel I shall not
panicipate in the Llsocialed maintenance costs.) This amount may bc adjusted annually upon the
rcquest ofmutual consent of twD ofthe lhrec lot O*ners. This allow&ce is determined by an
Etimated cost of well operation from the utility company.
There is a circular easemcnt with a radius of ten feet (l O') around the Well for the purpose of
providing access to, replacement of, and operation, mait,tenance, and improvcmeniof, the Well.
This earement is describ€d in Exhibir "A".
t0. Except as provided in paragraph 6 above, each party shall be solcly rcsponsible for all operation,
maintenance and capital costs associated with the delivery ofwater from the Well to lheir
rcspective Lots.

Re. Donaghue Amended Plat Application; Lots 2,{ and 3{ Tassada Exemption
Dear Sirs
Ms. Donaghue is requesting a second amendment to change the lot lines between Lots 2 and 3
ofthe Tassada Exemption. The Tassada Exemption was originally approved in 1 998 with Lots 2 and
3 consisting of 28and 23 acres respectively. In 1999, Ms. Donaghue purchased Lot 2 and an
Amended Plat was granted that transferred 5 acres from Lot 2 to Lot 3. Ms. Donaghue has now
purchased Lot 3, now owning both Lol2 and 3. She is now requesting to expand Lot 2 to 45 acres
and reduce Lot 3 to 5 acres adjacent to CR 320. No new lots are being created. Both lots will
continue to share the water well located on Lot 2 for domestic water supply and Taughenbaugh Ditch
for irrigation water. No changes to lnt I are requested. This Amended Plat will seft€ to cluster
residential improvements on Lots 2 and 3 adjacent to each other and CR 320. and create a larger area
retained in agricultural usage.
