1. The Applicant has submitted to the County an application for the following Project:

2. The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure,
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

Project Description
Parachute/Battlement Mesa Park and Recreation District
Recreation Center Pond
The Parachute/Battlement Mesa Park and Recreation District (District) proposes to
construct a water storage structure on its property with Assessor Parcel Nos. 2407-172-09-001
and 2407-172-09-002. The storage structure will provide a gravity -fed supply option for the
sprinkler irrigation system at the Battlement Mesa Golf Club, which the District owns and
operates. The storage structure will also provide a raw water irrigation alternative for
approximately 5.8 irrigated acres at the District's recreation center at 398 Arroyo Drive,
Parachute, CO 81635 that is presently irrigated with potable water from the District's municipal
tap provided by the Battlement Mesa Metropolitan District.
As presently designed, the storage structure will be a regulating structure intended to
provide water to the golf course sprinkler system at night during peak demands and store water
during the day. The storage structure is currently designed to have a surface area of
approximately 1.0 acre and a volume of approximately 7.5 acre-feet (2.5 million gallons).
Attached are a map and the initial engineering design for the storage structure.
Construction of the water storage structure is necessary for various reasons, including
that the pond will accommodate future upgrades to the golf course sprinkler irrigation system
and reduce the District's reliance on municipal potable water for purposes of irrigation at the
District's recreation center, which will have the corresponding effect of saving the District
money.

Center Pond
Dear Mr. Hooper:
This letter and the attached documents are intended to respond to your letter dated
November 24, 2019. Per your request, in addition to the copy of this letter and attachments that
is being emailed to you, three paper copies will be delivered to your office.
Comment 1: A completed and signed copy of the Certification of Mineral Owner Research
Certification is required. See attached.
Response: Attached is an executed copy of the Certification of Mineral Owner Research.
Comment 2: The adjacent property owner mailing address for the parcel 240 71 71 01 004 is
incorrect. Please revise.
Response: Attached is an updated list of names and owners of property within 200 feet of the
subject parcels.
Comment 3: The application material is unclear as to the source of the water for the pond
facility. Please clarify.
Response: The water rights that will be used to fill the pond are the Districts' direct flow rights
in the Huntley and Dobey Ditches that divert from Battlement Creek and were decreed for uses
at the Battlement Mesa Golf Club in Case No. 05CW281, Water Division No. 5. Water diverted
under said water rights flow down the existing Studt Gulch Pipeline from which the water will be
diverted into the pond.
The Pond will act as an equalization storage pond to store the direct flow deliveries during the
day and then provide peak irrigation system demands associated with golf course irrigation
timing at night. The pond will also provide a raw water irrigation alternative for the irrigated

acreage at the District's recreation center. This type of pond is typical to golf course operations
and is a common water rights administration tool as outlined in the Division of Water Resources
"General Administration Guidelines for Reservoirs," which provides:
Temporary Detention (72 -Hour Rule)
Direct water rights may be temporarily detained for up to 72 hours in order to allow
more efficient or effective beneficial use of the water. Examples of such detention
would be ponds used to receive delivery of a direct flow irrigation water right that
is then applied by a sprinkler or temporarily detained and slugged out through a
ditch (operational, head stabilization, equalization or flow regulating ponds), or the
use of forebays or regulating structures associated with municipal operations. A
specific storage right generally will not be required as long as the water is held for
Less than 72 hours and the detention is for purposes of allowing for more efficient
or effective beneficial use of the direct water right. Absent a storage right, free river
conditions, or the use of a Post Wildland Fire Facility, as addressed by SB15-212
(section 37-92- 602(8), C.R.S.), all water, including storm water, must be released
within 72 hours.
The District reserves the right to store water that is available under free river conditions
and store any other water that is permitted to be stored after going through any necessary water
court proceedings.
Continent 4: It appears that the dam itself will be entirely earthen, with no additional rock or
built structure. Is that accurate?
Response: The dam will be a compacted earthen dam designed by a Professional Engineer. The
dam design will be a non -jurisdictional structure (as defined in Colorado's Rules and
Regulations for Dam Safety and Dam Construction) and a Notice of Intent to Construct will he
provided to the Dam Safety Division of the Colorado Division of Water Resources.
Comment 5: Please identify the source of the water for filling the pond.
Response: See the response to Comment 3 above.
Comment 6: The data structure, accessory improvements and impounded water will span three
separate parcels (Lot 1, 13.6 acre Designated Open Space parcel and 2.88 acre Designated
Open Space parcel). Some form of easement for the construction, operation and maintenance
across these property lines is necessary. While these three parcels are currently under one
ownership, separate parcels mean they can be transferred without further review.
Response: As an initial matter, to clarify, the proposed water storage structure will span portions
of only two parcels. Those parcels are Parcel Nos. 2407-172-09-001 and 2407-172-09-002,
which are shown on the attached parcel map. It will not cross onto the 2.88 acre parcel

designated on the Final Pat for Town Center Filing 4 as "Drainage, Utility & Access Esrnt.
Designated Open Space 2.88 acres.
As to the request to encumber the properties with an easement at this time, as we discussed, the
District legally cannot convey itself an easement. Instead, if and when the District conveys out
one of the parcels, which it has no present plans to do, an easement will be reserved at that time
for the water storage structure and its operation. Reservation of easements for water
infrastructure is common practice and it is the simplest and easiest solution in this situation.
Comment 7: The focus of the Location & Extents Review approval is compliance with the
County Comprehensive Plan. The brief generalized statements of compliance to the Plan should
be expanded to include compliance to specific goals and policies. These should include the
goals, policies and strategies of Section 5 — Recreation, Open Space and Trails; Section 7 -
Water & Sewer Services; and Section 8 — Natural Resources.
Response: Attached is an updated Comprehensive Plan Analysis.
Comment 8: It appears that there are no existing flood hazards associated with this section of
Studt Gulch. Will the addition of the storage pond have any impact upon upstream or
downstream flood zones?
Response: The dam will include an emergency spillway designed to bypass a 100 -year storm
event. The spillway and temporary detention of any 100 -year flood runoff will slightly reduce
the flood flow amounts and hazards to the downstream gulch.
We look forward to the finalization of your completeness review and getting on the
Planning Commission agenda as soon as possible. Should you have any questions, please give

Comprehensive Plan Analysis
Parachute/Battlement Mesa Park and Recreation District
Recreation Center Pond
The Parachute/Battlement Mesa Park and Recreation District's (District) proposed water
storage structure is consistent with Garfield County's Comprehensive Plan for various reasons, a
few of which are discussed below.
Section 5 of the Comprehensive Plan makes clear that the recreation industry is to be
"encouraged and supported," and it identifies a goal of "preservation of recreational resources."
Comprehensive Plan at 53-54. As described in the Project Description, this water storage
structure will directly benefit continued operations at the Battlement Mesa Golf Club and the
District's recreation center, both important recreational amenities in Parachute/Battlement Mesa.
Also, the Comprehensive Plan recognizes that tourism is an important aspect of the
County's economy and that the growth of tourism continues to diversify the County's economy.
Id at 50. The Comprehensive Plan notes that the tourism industry is enhanced by recreational
opportunities. Id. The Battlement Mesa Golf Club and the District's recreation center are
important recreational assets and the proposed water structure will assist with continued and
improved operations.
The Comprehensive Plan also focuses on the protection of limited water resources. Id. at
59. An important aspect of the proposed water storage structure is that it will provide an
alternative supply of raw water for approximately 5.8 irrigated acres at the District's recreation
center. Reliance on the District's own water rights for irrigation at the recreation center instead
of the potable municipal supply from the Battlement Mesa Metropolitan District will ease the
demand on the important and valuable municipal supply.
The proposed water storage structure will also serve the goal set forth in Section 7 —
Water and Sewer Services to promote the legal, adequate, dependable, cost-effective and
environmentally sound water service. Comprehensive Plan at 59. The water storage structure
will facilitate the more efficient use of the District's irrigation water both at the Battlement Mesa
Golf Club and the District's recreation center.
Additionally, the proposed water storage structure will support goals set forth in Section 8
— Natural Resources. The proposed dam site will only use a very small portion of the open space
parcel ensuring that the large majority of the natural, scenic, ecological and wildlife habitat in the
open space parcel is left unaffected. Also, a stated goal in Section 8 is to avoid subjecting areas
to an increased potential for damage due to flooding. The dam will include an emergency
spillway designed to bypass a 100 -year storm event. The spillway and temporary detention of
any 100 -year flood runoff will slightly reduce the flood flow amounts and hazards to the
downstream gulch.
For the reasons discussed above, the proposed water storage structure is consistent with
the Comprehensive Plan.

3. Pay the agreed amount for the estate or interest to be insured.
4. Pay the premiums, fees, and charges for the Policy to the Company.

Colorado Division of Insurance Regulation 8-1-2, Section 5, Paragraph F provides: "Whenever a title entity provides the closing and
settlement service that is in conjunction with the issuance of an owner's policy of title insurance, it shall update the title
commitment from the date of issuance to be as reasonably close to the time of closing as permitted by the real estate records. Such
update shall include all impairments of record at the time of closing or as close thereto as permitted by the real estate records. The
title insurance company shall be responsible to the proposed insured(s) subject to the terms and conditions of the title

time of closing." Provided Commonwealth Title Insurance Company of Garfield County, Inc. conducts the closing of the insured

Pursuant to Colorado Division of Insurance Regulation 8-1-2, notice is hereby given that affirmative mechanic's lien protection for
the prospective insured owner may be available upon compliance with the following conditions:
A. The land described in Schedule A of this Commitment must be a single family residence, which includes a condominium or

Company may refuse to delete the exception. No coverage will be given under any circumstances for labor or material for which the

Pursuant to Colorado Division of Insurance Regulation 8-1-3, notice is hereby given of the availability of a Closing Protection Letter
which may, upon request, be provided to certain parties to the transaction.
Pursuant to C.R.S. §10-11-122, notice is hereby given that:
A) The subject real property may be located in a special taxing district; B) A Certificate of Taxes Due listing each taxing jurisdiction
may be obtained from the County Treasurer's authorized agent; C) The information regarding special districts and the boundaries of

Pursuant to C.R.S. §10-11-123, notice is hereby given:
This notice applies to owner's policy commitments containing a mineral severance instrument exception, or exceptions, in Schedule
B, Section 2.
A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise conveyed from the surface estate
and that there is a substantial likelihood that a third party holds some or all interest in oil, gas, other minerals, or geothermal energy

Comprehensive Plan Analysis
Parachute/Battlement Mesa Park and Recreation District
Recreation Center Pond
The Parachute/Battlement Mesa Park and Recreation District's (District) proposed water
storage structure is consistent with Garfield County's Comprehensive Plan for various reasons, a
few of which are discussed below.
As described in the Project Description, this water storage structure will directly benefit
continued operations at the Battlement Mesa Golf Club and the District's recreation center, both
important recreational amenities in Parachute/Battlement Mesa. Section 5 of the Comprehensive
Plan makes clear that the recreation industry is to be "encouraged and supported."

Also, the Comprehensive Plan recognizes that tourism is an important aspect of the
County's economy and that the growth of tourism continues to diversify the County's economy.
Id at 50. The Comprehensive Plan notes that the tourism industry is enhanced by recreational
opportunities. Id. The Battlement Mesa Golf Club and the District's recreation center are
important recreational assets and the proposed water structure will assist with continued and
improved operations.
The Comprehensive Plan also focuses on the protection of limited water resources. Id. at
59. An important aspect of the proposed water storage structure is that it will provide an
alternative supply of raw water for approximately 5.8 irrigated acres at the District's recreation
center. Reliance on the District's own water rights for irrigation at the recreation center instead
of the potable municipal supply from the Battlement Mesa Metropolitan District will ease the
demand on the important and valuable municipal supply.
For the reasons discussed above, the proposed water storage structure is consistent with
the Comprehensive Plan.
