This letter is intended to provide to you a list of the owners of any subsurface mineral interests. I reviewed the deeds from the original patent issued by the U.S. Government to Thomas McClure dated June 30, 1892, to the deed to the current owner of the property. There are only two documents of record that create a reserved right in mineral interests. These are as follows. 1. The Warranty Deed dated December 29, 1943, and recorded in Book 208 at Page 584 as Reception No. 105766 whereby the Property was conveyed from Posie Cerise and 011ie Cerise to Margaret Phipps. In that deed, Posie Cerise and 011ie Cerise reserved to themselves an undivided one-half interest in all oil and gas rights in or under the Property. There is no address given for the holders of the reserved interest and we are unable to locate any further conveyances of this reserved interest. A copy of this deed is attached. 2. The Quit Claim Deed dated February 20, 1961, and recorded in Book 333 at Page 302 as Reception No. 213359 whereby a very small portion of the Property was conveyed from Oscar Cerise and Wilma Cerise to Posie Cerise and 011ie Cerise. In that deed, Oscar Cerise and Wilma Cerise reserved to themselves an undivided one-half interest in all oil and gas rights in or under the Property. There is no address given for the holders of the reserved interest and we are unable to locate any further conveyances of this reserved interest. The property conveyed by this deed was primarily the Glenn Hartmann November 20, 2019 Page 2 adjacent property known as the Catherine Trailer Park immediately to the northwest of the Property. However, a small portion of the property transferred by such deed was within the boundary of the Property as it exists today. A copy of this deed is attached. I am aware that in a letter provided to you dated October 10, 2017 with a prior application related to the Property there was a reference to reserved mineral interests in another deed. The additional deed referenced in that letter was a Deed from Margaret Phipps to Oscar Cerise and Wilma Cerise recorded in Book 257 at Page 110 as Reception No. 175244. However, that deed did not include a new or different reservation. That deeds states that "there is also excepted and reserved herefrom all oil and gas heretofore reserved by instruments of record." That language means that the Property was being transferred subject to the prior reservation of a one-half interest in all oil and gas pursuant to the deed described in No. 1 above — this was not a new or different reservation.
