DESCRIPTION OF PROPOSAL - REQUEST The applicants are requesting an Amendment to Lot 3 of the Vix Ranch Subdivision Exemption. This amendment would adjust the northern property boundary and increase the acreage of Parcel 3 from 2.03 to 2.308 acres The Amendment is being requested as two structures were built by the applicant on the adjoining property. The applicant has represented that these structures are agricultural. There is another shed on the parcel that does not require a building permit because of its size. Additionally, the applicant is including a 30' Access and Irrigation Easement, as well as a Well Access and Maintenance Easement in the proposal. Vix Ranch Subdivision Exemption was approved in 2001 and created Exemption Parcel 3. The applicant is also required to go through a Boundary Line Adjustment process with the County Assessor's Office in order to adjust the lot line with the property to the north. This property is identified as the parent parcel in the Vix Ranch Subdivision. The parcel has multiple structures on the property. The applicant has indicated that two of the structures are agricultural which is why there is no building permit. The third structure is a manufactured home. Public notice is required in accordance with Sections 4-103 and 4-101 and the Applicant has provided documentation that all required public notice has been completed. III. PUBLIC AND REFERRAL COMMENTS No public comments were received as a result of public notice. Referral Comments received on the Application are attached as Exhibits and summarized below: 1. Garfield County Surveyor: Indicated that there were no comments 2 IV. STAFF ANALYSIS 1. The applicant's proposal was reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: a. Does not increase the number of lots; and The proposed Amended Final Plat does not increase the number of lots. b. Does not result in the major relocation of a road or add any new roads; or The proposed Amended Final Plat will not result in a major relocation of a road or add new roads. It does add an additional access easement across the lot, but this is not the primary access to the northern property as that was determined by the Subdivision Exemption plat. The applicant indicated that the access easement will be used to access the agricultural field to the north. c. Will correct technical errors such as surveying or drafting errors. The Amended Final Plat has not been proposed to correct technical errors. 2. No conflicts with the existing underlying zoning have been noted including lot size and setbacks. The applicant provided a surveyed site plan indicating that the adjusted lot line would allow the structures to be compliant with setback requirements in the Rural zone district. 3. The applicant has indicated that no changes or impacts are anticipated with regards to Article 7 Divisions 1-3 of the Land Use and Development Code. 4. The applicant has been in contact with the County Assessor's Office to address the required Boundary Line Adjustment. 5. The Amended Final Plat will allow the structure constructed by one of the applicants to be located on the correct parcel. 6. The applicant has represented that the two accessory structures on the parcel are agricultural and therefore no building permit is needed. Another shed on the site does not meet the square footage requirements for a building permit. Assessor records indicate that the manufactured home on the property was constructed in 1968, but the Assessor does not have records indicating when the structure was installed on the property. The structure was mentioned during the approval of the Subdivision Exemption in 2001 and no issues were raised regarding its construction or status at that time. 3 V. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that the Amended Final Plat Application for Lot 3 of the Vix Ranch Subdivision Exemption meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C) and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval and findings. Suggested Findings 1. That proper public notice was provided as required for the Director's Decision, 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's decision. 3. That for the above stated and other reasons, the proposed amended plat is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Recommended Conditions of Approval 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The proposed plat shall be updated and edited prior to submittal for final review by the Community Development Department and the County Attorney's Office as follows: a. The Certificate of Dedication and Ownership shall be updated to match the language in the County Resource Guide. The County Commissioner's Certificate and the County Surveyor Certificate, consistent with the County Resource Guide shall be included on the plat. b. All color shall be removed from the plat. c. The applicant shall update the plat with the legal description for the Amended Parcel 3. d. The Plat shall be updated to remove "to be" in the statements of Boundary Line to be Adjusted and the Parcel to be Conveyed. 4 e. Parcel 2 shall be removed from the Final Plat f. The applicant shall include a plat note indicating that future development may be subject to applicable floodplain regulations. g. Adjacent property owners shall be removed. h. A plat note shall be included indicating that all easements listed in the Title Commitment are shown on the plat. i. An additional Lienholder Consent form shall be included. The existing and new Lienholder Certificates shall be updated to match the language in the County Resource Guide. 3. The Applicant shall submit an updated electronic copy to the County for Final Review once the updates have been completed. Additional updates or changes to the plat may be required as part of this additional review. Once approved for Mylar the applicant shall supply: a. A plat Mylar with signed Certificates that include Dedication and Ownership, County Surveyor's, Clerk and Recorder's, Taxes Paid, County Commissioners', Surveyor, Title, and Lienholders b. Recording Fees 4. The applicant shall work with the County Assessor's Office to prepare the appropriate documentation for the Boundary Line Adjustment (BLA).
