HomeMy WebLinkAbout4.0 Director's Decision 12.05.2018Garfield County Community Development Department December 5, 2018 David Carlson and Jean Hudson 1781 County Road 241 New Castle, CO 81647 Vix Ranch Co Dianne Shaw 111 Douglas Drive Mabank, TX 75157 RE: Vix Ranch Subdivision Exemption Amended Final Plat — Parcel 3 (File No. FPAA-08-18-8667) Dear Mr. Carlson, Mrs. Hudson and Mrs. Shaw; This letter is provided to you as the applicant for an Amended Final Plat application for Lot 3 of the Vix Ranch Subdivision Exemption. The application proposed an Amendment to the northern property line of Parcel 3. The property is known by Assessor Parcel Number 2125-131-00-038 and further described as Parcel 3 of the Vix Ranch Subdivision Exemption Plat, according to the Plat Recorded as Reception No. 576753. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving with conditions the Application for an Amended Plat for Parcel 3 of the Vix Ranch Subdivision Exemption. This includes a finding that the Application meets the requirements and standards of the Garfield County Land Use and Development Code as amended including the Review Criteria contained in Section 5-305 (C). The approval is subject to the following conditions of approval. 1 That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. Page 1 of 4 2. The proposed plat shall be updated and edited prior to submittal for final review by the Community Development Department and the County Attorney's Office as follows: a. The Certificate of Dedication and Ownership shall be updated to match the language in the County Resource Guide. The County Commissioner's Certificate and the County Surveyor Certificate, consistent with the County Resource Guide shall be included on the plat. b. All color shall be removed from the plat. c. The applicant shall update the plat with the legal description for the Amended Parcel 3. d. The Plat shall be updated to remove "to be" in the statements of Boundary Line to be Adjusted and the Parcel to be Conveyed. e. Parcel 2 shall be removed from the Final Plat f. The applicant shall include a plat note indicating that future development may be subject to applicable floodplain regulations. g. Adjacent property owners shall be removed. h. A plat note shall be included indicating that all easements listed in the Title Commitment are shown on the plat. i. An additional Lienholder Consent form shall be included. The existing and new Lienholder Certificates shall be updated to match the language in the County Resource Guide. 3. The Applicant shall submit an updated electronic copy to the County for Final Review once the updates have been completed. Additional updates or changes to the plat may be required as part of this additional review. Once approved for Mylar the applicant shall supply: a. A plat Mylar with signed Certificates that include Dedication and Ownership, County Surveyor's, Clerk and Recorder's, Taxes Paid, County Commissioners', Surveyor, Title, and Lienholders b. Recording Fees 4. The applicant shall work with the County Assessor's Office to prepare the appropriate documentation for the Boundary Line Adjustment (BLA). The plat shall reference the Reception Number of the BLA. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 days commencing on the date of the Director's Decision. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit.
