THE RAPIDS ON* THE COLORADO
PLAT NOTES:
1. Utility, drainage and irrigation easements are located 70
feet adjacent to all lot lines and 20 feet adjacent
to Paddle Wheel Lane, Rapids View Lane and White
Water Lane and 30 feet adjacent to the County Road ; 355
right--of—way.
2. Lot line setbacks for buildings are a minimum of 50 feet
from front lot lines 25 feet from side lot lines and 25
feet from rear lot lines.
3. Buildings on Lots 1 through 20 must be located within the
designated building envelopes (see detail).
4. Leachfields for the disposal of treated wastewater must be
located o minimum of 50 feet from stream or welter course
an Lots 1 through 20 and on Lots 26, 27, 30, 37,
32, and 33 must be located a minimum of 200 feet
from all existing domestic water wells.
5. The lowest floor, including the basement, of any new
building designed for residential occupancy shall be at
least 1 foot above the maximum water level of the 100 year
flood as determined by Colorado River and Tnbutaries,
FLOOD PLAiN STUDY, prepared for Garfield and Mesa Counties,
Colorado in cooperation with Colorado Water Conservation Board,
Denver Colorado, December-, 1982
6. The minimum defensible space distance shall be 30 feet on
level terrain, plus appropriate modification to recognize
the increased rate of fire spread at sloped sites. The
methodology described in Determining Safety Zone
Dimensions, Wildfire Safety Guidelines for Rural
Homeowners," (Colorado State Forest Service) shall be used
to determine defensible space requirements for the
required defensible space within building envelopes in
areas exceeding five(5) percent grade.
7. Upon adoption of road ithpact fees by the Board of County
Commissioners, AO lots created by this exemption shall be
subject to paying the fees, paid at the time of building
permit application, paid by the bu►ig permit applicant,
unless said fees hove been paid by the developer. There
shall be a credit given to the Building Permit Applicant in the amount
of $3582.00 per lot against said road impact fees for the monetary
amount spent on providing the required acceleration and
deceleration lanes..
8. The individual lot owners shall be responsible for the
control of noxious weeds and the Homeowners Association
shall control noxious weeds on all Open Space/Park/and
portions.
9. Prior to the issuance of a building permit, the owner of
each lot shall prepare and submit a soils and foundation
report, on 1.5 0.5. design, and a grading and drainage
plan prepared and certified by a professional engineer.
All improvements shall be constructed in accordance with
such measures, which shall be a condition of the building
permit.
10. All lot owners shall comply with the provisions under
which the wellpermits far the subdivision were approved.
No lot shall irrigate more than 10,000 square feet of
land with water from the central, domestic system, and
all waste water disposal systems shall have non—
evQporctive leach fields.
11. This: coded final plot amends the configuration of the common
open .space and Lots 24, 27 and 28 as shown on the original plat.
