Above named Applicants propose to merge two parcels of appx. 1.08 and 1.1 acres into one lot.
We are proposing to merge the lots, to create a lot greater than 2 acres, which would allow us to
pursue a second application for an Accessory Dwelling Unit on that property.
Access to the propenry is through a dedicated easement over RR and RFTA owned property. The
developed site is currently improved with an existing single-family dwelling unit and a storage building.
The propefi is served by an existing well, with an additional water allotment for an ADU and an OWTS.
The other parcel is an undeveloped lot.
The addition of a requested ADU will not result in any changes to drainage, access utility services and
any other applicable Subdivision and Article 7 topics.

Diversions are to be from an existing well (Permit No. 39575-F) located in the NW1/4 SE1/4 of Section 28, Township 7
South, Range 88 West, of the 6th P.M. at a point 1,700 feet from the South section line and 2,100 feet from the East
section line. The Applicant will need to amend their well permit to reflect the additional uses if the contract is approved.
Contract No. 84 is also associated with this Broperty; however, the contract cannot be amended as is included in the
Ðistrict's 98CW026i9WCW089 (consolidated) batch plan decree.
A copy of the water requirement table and calculation sheets are attached along with a BWCD map showing the

ALSO an underground pipeline (size of pipe to be determined by
The Anschutz Corporation) with Division Head Gate running south'
westerly of and perpendicular to said Aspen Branch main track "
opposite Mile Post 371 plus 3,695 feet as shown in blue on the

privatê way for the following purpose and for no other, to.wit: Ingress and egress to.

And said term shall include such grading, approaches, planking, ditches, drâin,
tiling, drain boxes, culverts, cattle guards,-wing fenıès and fences, gatès with proper
hinges and latches, raising of telegraph, telephone and signal wires for proper clearance,
and such signals, bells, sign post and signs and other safety devices as shall in the par-
ticular instance be required by the Licensor, or which may now or hereafter be prescribed
and required by any law, State or Federal, or by any ordèr of any officer or regulatory
board, State or Federal, having jurisdiction over such matters.
The underground waier pipeline referred to herein is for the transport of water only
from the Anschutz Ditch. Its use is also to be a strictly private one and is not intended fo-r
public use; Licenses agre€s to use laid pipeline for the fıllowing purpose and for no
other, to wit: to transport water to private residential property owned by Licensee.

Thank you for your patience in attending to this application. The following addresses the
numbered items in your October 3, 2018.
1.Parcel B has several tax liens on the property as shown on Schedule B, Section 2, Items
18-22 on the submitted title commitment. These will need to be dealt with and removed
prior to the plat amendment.
At this point the issues with the tax liens have been resolved with the IRS and the County
Attorney’s office. Attached is the form of consent approved by both. In addition, the IRS
requested a copy of the plat to review. We have not received any comments from the IRS and
will amend the Attorney Signature Block as follows:

or agent authorized by a title insurance company, do hereby certify that I have
examined the title to all lands shown upon this Plat and that Title to such land is
vested in ____________________________, free all liens and encumbrances
(including mortgages, deeds of trust, judgements, easements, contracts and
agreements of record affecting the real property in this Plat), except for a United
States Department of Treasury, Internal Revenue Service, Certificate of Federal

Tax Lien recorded September 6, 2011 and recorded at Reception No. 807744, such
Lien being amended by a Certificate of Release of Federal Tax Lien recorded April
8, 2019 at Reception No. 918973.
2. The submitted access license does not grant permanent and perpetual access to the
property. A recorded easement granting permanent access will need to be submitted prior
to the plat amendment.
RFTA’s Access Control Plan (ACP) does not provide for the grant of an easement to a private
crossing per Section 10 and 13 of the ACP.
10.0 Types of Crossings and Encroachments Defined
A. Private Crossings and Encroachments shall include:
1. Private Road Crossing - means a crossing of the Railroad Corridor by a private
driveway or road at a single point for ingress and egress to an adjacent property for
a homeowner and/or business. A private driveway or road must be approved by
RFTA and granted by a license, lease, or contract. Failure to 18 obtain approval
from RFTA for the encroachment, failure to pay the license, lease, contract fee, or
failure to comply with RFTA DG guidelines may result in RFTA pursuing all
available remedies. Failure to pursue a remedy in no event shall be construed as an
approval of a crossing or as a waiver of RFTA’s rights.
13.0 Design Guidelines for Proposed New Crossings or Up-Grading, Modifying, and
Improving Existing Crossings.
C. Private At-Grade Vehicle Crossings. Private at-grade vehicular crossings may
require safety improvements in accordance with the RFTA DG. Such
improvements shall, insofar as reasonably necessary and possible, be constructed
and maintained in conformance with this ACP and the DG; are subject to review
and approval by RFTA; and shall also require a license, lease, or a contract
agreement with RFTA.
3. Lot 19 has a lack of recorded access as shown on the submitted title commitment. Access
to this parcel must be proven through a recorded easement prior to the plat amendment.

Lot 19 and Lot 21 will merge with the plat amendment so that the need for separate access
to Parcel 19 will be unnecessary.

In response to your email of June 19, 2020 we have updated the Title Certificate language with the
following referencing the IRS consent:
“I, _______________, an attorney licensed to practice law in the State of Colorado,

examined the Title to all lands shown upon this Plat and that title to such land is
vested in _____________________, free and clear of all liens and encumbrances
(including mortgages, deeds of trust, judgments, easements, contracts and
agreements of record affecting the real property on this Plat), except for a United
States Department of Treasury, Internal Revenue Service, Certificate of Federal
Tax Lien recorded September 6, 2011 and recorded at Reception No. 807744, such
lien being amended by a Certificate of Release of Federal Tax Lien recorded April
8, 2019 at Reception No. 918973” (emphasis added).
With regard to the RFTA access license we are constrained by the access control plan adopted by
RFTA (https://www.rfta.com/wp-content/uploads/2018/12/2018-01-11-access-control-plan-with-
appendices-1.pdf). While I worked on the RFTA access control plan on behalf of Glenwood
Springs on public crossings I do not recall if Garfield County challenged the use of licenses for
private crossings during the review and public comment. Currently access licenses are used
throughout Garfield County along the RFTA corridor to access private properties. If these are
insufficient it would imperil current private uses relying on the license agreements. I would
encourage the County Attorney to discuss this matter with RFTA’s attorney Paul Taddune.
Unfortunately, at this point it is not something the applicant can change regarding access.
