4.09.01 The applicant must begin development of the PUD within one (1) year from the time of its final zone change
approval; provided, however, that the PUD may be developed in stages and the Board may approve the
commencement of development activity beyond one (1) year. The applicant must complete the development of
each stage and of the PUD as a whole in substantial compliance with the development schedule approved by the
County Commissioners. (A. 97-109)
The applicant requests that the conditions of this section be satisfied by the submission of a
Preliminary Plan application for the entire PUD within one (l) year of the date of the approval of
this amendment by the Board of County Commissioners.
The phasing as defined herein is the currently anticipated sequence of development of the PUD.
However, market conditions and construction implications may cause the Applicant to modify the
sequence of the development of these phases. The configuration of the described phases allows
for utilities and roads in a manner such that if subsequent phases are not developed for some
time, the completed areas of the development will function effectively.
The applicant requests that with the approval of the Elk Meadows PUD, the sequence of phasing
construction may be modified through the subdivision review process and not require an
amendment of the originally approved PUD
4.09.02 If the applicant does not comply with the time limits imposed by the preceding subsection, the
County Commissioners shall review the PUD in a public hearing noticed as required in
Section 10.04.01, and may revoke approval for the uncompleted portion of the PUD, or
require that the PUD be amended, or extend the time for completion of the PUD one (I) time,
for a period not to exceed one (1) year from the expiration of the original time limit. (A. 97-

4.09.03 Each stage within a PUD shall by so planned and so related to existing surrounding and
available facilities and services that failure to proceed to a subsequent stage will not have a
substantial adverse impact on the PUD or its surroundings.
The configuration of the herein described phases allows for utilities and roads in a manner such
that if subsequent phases are not developed for some time, the completed areas of the
development will function effectively.
4.09.04 If a PUD contains nonresidential uses, they may by constructed in advance of residential uses if the County
Commissioners find that such phasing is consistent with sound principles of ordered development and will have
no substantial adverse effect on the quality or character of the PUD.
No nonresidential uses are proposed.
4.09.05 The development and construction of and within all PVDs shall be done in such manner and fashion that
minimizes disturbance to adjacent land uses and owners. Access for all construction equipment shall be
designated within the PUD proposal and shall bear a logical relationship to any proposed phasing of the
development.
During construction of the proposed new alignment of Four Mile Road temporary access points
from the existing Four Mile Road will be identified during the subdivision process. Subsequent to
completion of the new four Mile Road alignment, all construction access to the project will be at
the proposed new intersection with Four Mile Road. All adjacent land uses are buffered such
that construction activities will not have a detrimental impact on surrounding residents.
