Revised called from Kurt on 5/1/2020 Buffalo Valley Stands $9,056.00 **See New Terms and Conditions Job Development Client provided dimensions and Aspen Welding will not produce shop drawings. Materials $2,376.00 2 x 2 x 1/4 Angle 1/4"x4FB Fabrication $6,680.00 Fabricate 54 total stands based on drawing dimensions. 38 only at 33" L x 18" W x 6" H with support 8-1/2 OD to CL. 5 only 48" L x 20" W x 37-1/4" H with support at 8-1/2" OD to CL. 10 only at 46" L x 20" W x 37-1/4" H with a support at 8-1/2" OD to CL. 1 only at 56" L x 22" W x 44-1/4" H with a support at 8-1/2" OD to CL. All frames to include 4 x 4 x 1/4 FB legs with 1 hole with 7/16" diameter Primed Delivery only. Client will install Due to COVID-19 pandemic, Aspen Welding will be requesting that an adequate schedule be provided to where only the team of Aspen Welding will be on premises of the project location. Failure to do so could and will result in rescheduling or delay of installation. 1 (End of Scope of Work) TERMS AND CONDITIONS 1. The Agreement. This Agreement constitutes the complete and exclusive agreement between Aspen Welding and Client with respect to the service outlined above on this estimate. 2. Skills and Personnel. Aspen Welding shall provide the skills, equipment and staff necessary to perform the service in a professional manner. 3. Price. The price for the services shall be the amount quoted on Aspen Welding's Estimate or if no such estimate was provided, Aspen Welding's then current standard billing rate is reflected on Aspen Welding's invoice. Changes in quantities of/or materials or scope of work will require a re -estimate_ All estimates have a 15 day steel and decking price guarantee due to fluctuation in mill steel prices. If approved after 15 days, Aspen Welding will re -estimate all material prices. 4. Deposits Payment. All approved estimates requires a 50% deposit to start any job, regardless of any draw policy with client. Deposit payment should be the whole entirety without any retainage. 5. Billing Invoices. Client shall pay Aspen Welding for the services within (30) days of the invoice date. Payments should reach our bank account within the 30 days of invoice date. If the invoice is not timely paid, then the following provisions shall apply: a. 3 % LATE FEE for all balances past due. Statements will be emailed on the first day of each month. bAspen Welding may suspend all services until payment are brought current for past due amounts longer than 60 days, and client shall have no liability to client for any delay occasioned thereby. c. Aspen Welding reserves the right to place mechanical liens on the property, client, and owner for past due balances past 120 days. d. Aspen Welding shall be entitled of reimbursement of all costs and expenses, including, but not limited to, court costs, and attorneys' fees, incurred in collecting payment of such unpaid invoices. 6. Retainage. Invoices shall be pay to Aspen Welding in full upon completion of the entire scope of work stated in this estimate, including any retainage amounts withheld on previous billing invoices. 7. Shop Drawing Packages. Shop drawings are defined as how material is to be prepared, assembled, finished, and/or erected according to the contract documents. Aspen Welding is not responsible for finding errors on the contract drawings provided by Client. Aspen Welding is not responsible of design of steel connections or supplying calculations unless noted in the scope of work on the estimate. If client provides their own shop drawings, Aspen Welding will require a complete package (fabrication and erection/installation set) before commencing any job. Any shop drawings that have been submitted that are incorrect or acquire additional changes will be the responsibility of Client for change order cost. a. Design Package. This package includes working alongside with the Client, Architect and/Structural Engineer, provide concept drawing set, 3D rendering and modeling in our design software, meetings, and two revisions. 2 b. New Construction Package. A new construction constitutes of an entirely new structure or extensions to an existing structure. This package for shop drawings includes creating a fabrication and erection/installation set based on the contract documents provided by Client, Architect and/or Engineer, 3D modeling, and includes one revision. c. Remodel Package. This package includes field measurements and coordination with the Client, Architect and/or Engineer, fabrication and erection/installation set, 3D modeling, and one revision. d. Phase Package. This package allows client to split the project either by building levels, or item/pieces. 8. Client's Responsibilities. a. Client is responsible to provide sign and approved copies of estimate, and terms & conditions. b. Client is responsible for any inspection fees. c. Client must provide a clear area for installation. If area is not ready, or if there is heavy traffic by other trades that would impede working consistently, Aspen Welding will return another day and client will acquire additional cost for the return day. d. Any finished areas (walls, floors, etc.) must be protected by client. e. If boom crane is to be used, client must have a designated clear area and permit from the city on scheduled date. f. Notify Aspen Welding of any changes immediately by phone and email. Any changes will be subject to change order time and material cost. g. Notify Aspen Welding of schedule with plenty time to allow Aspen Welding to accommodate crew and equipment. h. Approve and sign all shop drawing package. No approval will delay project 9. Insurance. Aspen Welding provides certificate copies of liability and worker's compensation insurance upon request. Any additional insured or special requirements needed to be included in the certificate copies must be specify in writing with the subcontractor agreement. Special insurance limits that are additional to Aspen Welding, will be the sole responsibility of the client to incur those charges. 10. Warranty. The standard warranty for produced items by us is 12 months from date of installation or delivery. Aspen Welding does not accept responsibility for any damage that may occur due to causes over which it has no control, unless due to the proven negligence of its employees. When work is carried out in sections, the warranty period shall commence from completion of each section. In the event the product is moved to another location, the warranty is void. The standard warranty is excluded for items not produced by Aspen Welding, this includes but not limited to, prefabricated materials or parts. In order to maintain a healthy working relationship, Client must agree to these terms and conditions by Aspen Welding. Client acknowledges that this agreement is between Aspen Welding and Client and no other party associated. Accepted By Accepted Date 3
