Box 1227 Glenwood Springs, CO 81601 RE: Director Decision Brown 2-Unit Dwelling (File No. GAPA-06-19-8734) Dear Robert: This letter is in regard to the Director's Decision for your Administrative Land Use Change Permit Application for a 2-Unit Dwelling on the property owned by Hector Brown located at 172 Darrow Street (aka County Road 160), Glenwood Springs, CO 81601, and known by Assessor Parcel #218527106003. Your Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is based on the following findings: 1. That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were given the opportunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons, the proposed addition of 2-Unit Dwelling to the second floor of the existing commercial building is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use 1 and Development Code, as amended. The Director's Decision is hereby issued approving the Brown 2-Unit Dwelling Application subject to the following conditions: 1. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. An approved Building Permit in compliance with IBC 2015 shaii be required prior to construction of the 2-Unit Dwelling. Construction plans shall demonstrate compliance to Section 707, Fire Barrier of the IBC 2015, or alternatively, the construction plans include a fire suppression system. 3. A wet sealed copy of the Zancanella & Associates, Inc. septic report shall be provided prior to issuance of a Building Permit for the 2-Unit Dwelling. 4. The existing septic system shall be properly serviced and maintained. The applicant must obtain a permit prior to Installing, altering, or repairing a system if changes will be made. 5. The 4 new residential parking spaces and 2 existing commercial asphalt parking spaces at the front of the commercial building shall be delineated. The proposed Site Plan (revised 7-8-19) shall be corrected to state that there are 6, not 7, asphalt parking spaces at this location. 6. The Applicant shall comply with the City of Glenwood Springs conditions of approval for the expansion of the municipal water service to the proposed new 2- Unit Dwelling, as stated in the April 17, 2019 letter from Brad Zachman, Water & Wastewater Superintendent, including: a. Applicant must agree to and sign a City of Glenwood Springs pre - annexation agreement. b. Applicant must submit a utilities plan for the City's review and approval. c. Applicant must contact the Glenwood Springs Fire Department to confirm that the existing water supply in the area is adequate for the proposed improvements. The applicant should be aware that the water main that serves the properties along County Road 160 is undersized (4-inch). d. Water services must meet all applicable Municipal Code, Water/Wastewater Department, and Engineering Department Rules and Regulations. e. All applicable tap and system improvements fees, as calculated by the City's Community Development Department, shall become due and payable prior to activating service to the new residential units. 2 f. All water uses must be metered by a City -approved water meter. Meters must be inspected and approved by the Water/Wastewater Departments prior to activation. g. A water account must be set up with the Finance Department prior to the service(s) being energized. h. Following completion of project, an as -built drawing of the services and associated appurtenances shall be submitted for review and approval by the City. Submittals shall be made in PDF (.pdf) and/or AutoCAD (.dwg) file formats. 7. The Applicant has one year within which to satisfy conditions of approval and obtain a building permit for the construction of the 2 new dwelling permits. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on September 21, 2019. Once the call-up period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved the Land Use Change Permit will be issued. Pursuant to the Land Use and Development Code, the Applicant has one year from the date of the Director's Decision to satisfy all conditions of approval or request an extension.
