HomeMy WebLinkAboutDirector's Determination 08.17.2020Exhibit A August 17,2020 Brad Jordan PO Box 1031 Glenwood Springs, CO 81602 DTRECTOR DETERMINATION - Jones Secondary Dwelling Unit (GAPA-O6-20-8792) Dear Mr. Jordon, This letter is in regard to the Director's Decision for your Administrative Land Use Change permit Applicatioñ for a Secondary Dwelling Unit on your client's property located at 6809 County nòaO 214, New Castle, CO 81647, also known as Parcel No. 2181-042-00-223. your Âpplication has been reviewed in accordance with the Administrative Review proceOúres contained in the Land Use and Development Code as amended. Said þrovisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is based on the following findings: 1. That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's decision. 3. That for the above stated and other reasons, the proposed Land Use Change is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in general conformance with the 2030 Comprehensive Plan, as amended. 1 Garfield Coülnty LAND USE CHANGE PERMIT for A 29 Acre Parcel of Land owned by AbigailJones Located at 680g cR 214, legally described as Lof 1 Hayes Exemption recorded at Reception Na.398015 (Assessor's Parcel No. 21 81 -042-00-229) ln accordance with and pursuant to provisions of the Garfield County Land Use and Development Code oÍ 2O13, as amended, the Director's Decision Letter Dated August 17,2020 is hereby authorized by Land Use Change Permit for: A Secondary Dwelling Unit (GAPA-06-20-8792) This Land Use Change Permit is issued subject to conditions of approval as set forth in Exhibit "A". The Permit shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Land Use and Development Code, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. That with the adoption of the proposed conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended' The Director's Decision is hereby issued approving the Jones SDU Application subject to the following conditions: 1 . prior to issuance of the Land Use Change Permit, the Applicant shall submit to the County documentation from the Colorado Division of Water Resources that the well is permitted and adequate for the addition of the proposed SDU. 2. prior to issuance of the Land Use Change Permit, the Applicant shall submit to the County the following for the well serving the SDU: a. A current pump test that meets the standards in Section 4-203.M.1.b.5'a. LU&DC The pump test shall include representation by a qualified professional that the pump rate is adequate for the proposed uses. b. A well water quality test that meets the standards in Section 4- 203.M.1.b.5.a. LU&DC. This test shall include a report from a qualified water quality professional which identifies any water quality exceedances and recommendations for steps necessary to bring the water quality into compliance with quality standards' 3. prior to issuance of the Land Use Change Permit, the Applicant shall submit to the County evidence that the driveway meets the applicable roadway standards of Section 7-107 LUDC, or obtain approval of a waiver request that meets the requirements of Policy 01-14 Road Submittals and Waivers, see attached. Operational Conditions: 4. Any new building permit or grading permit must be accompanied by a geo-hazard invêstigation in ìonformance with the requirements defined by Section 7-207, LUDC and prepared by a qualified licensed engineer which provides recommendations for any necessary mitigation measures. 5. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 6. At the time of Building Permit the Applicant shall submit a grading and drainage plan that is acceptabie to the Building Department verifying that the grading and drainage is Practical. 7. A site plan acceptable to the Building Department shall be submitted with the Building permit iliustrating that the proposed site development complies with the requirements of 2 parking spaces per the standards of Section 7-302. 2 L The SDU shall be subject to all Garfield County Building Code Requirements. The property owner shall obtain all necessary Garfield County Building Permits for new construction, modifications and/or expansions to the structure. 9. Allexterior lighting shall be downcast and shielded and comply with SectionT-3O4, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 10.The Applicant shall maintain compliance with all Additional Standards for Residential Uses contained in Section 7-701.8, Secondary Dwelling Units, of the Land Use and Development Code o12013, as amended. The Land Use and Development Code requires notification to the Board of County Commissioners fortheir review and potentialcall-up of the Director's Decision. "l-he Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on August 26th, 2O2O. Once the call-up period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved, the Land Use Change Permit will be issued. Pursuant to the Land Use and Development Code, the Applicant has one year from the date of the Director's Decision to satisfy all conditions of approval or request an extension.
