HomeMy WebLinkAbout4.0 Director's Determination 06.28.2019Garfield Coúlnty Community Development Department June 28,2019 Eric Rudd Rudd LLC and CCC-B LLLP 132 Park Ave. Basalt, CO 81621 RE Rudd Minor Modification Application to a Floodplain Development Permit Approved by Resolution No. 99-14 (File No. SUAA-O4-19-8725) Dear Eric This correspondence is being provided to you as the authorized representative for the Rudd LLC and CCC-B LLLP Application for a Minor Modification to a Special Use Permit for the purposes of clarification that the Special Use Permit issued for Dredge and Fill within the floodplain of Cattle Creek, pursuant to Resolution No. 99-14 was approved to include the issuance of building permits for construction of structures on the area of fill. The Applicant's property is located at62 County Road 113, Carbondale, CO 81623 and known by Assessor's Parcel Numbers 2393-181-00-358 and 2393-181-00-359. pre-application meetings with the Applicant provided direction to process the request as a minor modification and provided direction on the submittals requirements. pursuant to the Minor Modification process contained in Section 4-106 (BX1Xa) of the Land Use and Development Code, a Director's Decision is hereby issued approving the Minor Modification subject to the following findings: A. That the Application for Minor Modification to the approved Floodplain Special Use permit was filed for the purpose of clarifying that the Resolution approved by the Board of County Commissioners set forth conditions or requirements for new construction or substantial improvements that must be met to obtain a building permit in the fill area. 108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (e70) e4s-8212 B. That an updated site plan is attached documenting the locations of three existing structures labelled Buildings E, F, and G, and six proposed structures to be built on the area of fill labelled Buildings A, C, D, AA, CC, and l, including the minimum finished floor elevations for each structure. C. That the Minor Modification request meets the Minor Modification Criteria in Section 4-106 (C). D. That the issuance of Building Permits for Buildings E, F, and G were in compliance with the conditions contained in Special Use Permit 99-14 and that future Building Permits for Buildings A, C, D, AA, CC, and I shall be subject to compliance with the Amended Floodplain Special Use Permit. That the Director's Decision is íssued subject to the following conditions: 1. All previous conditions of approval contained in Resolution No. 99-14 shall remain in effect and the Applicant shall comply with the comments contained in the referral letter from the County's Consulting Engineer, Michael Erion, Resource Engineering dated June 27,2019. 2. That the Applicant shall provide as-built elevation certificates for all existing and proposed structures to confirm compliance with the elevation requirements set forth in Resolution No. 99-14. 3. That all representation of the Applicant including those contained in the Application Submittats, Engineering Reports, and Supplements shall be conditions of approval unless modified herein, including the representation that the Applicant is in the process of initiating a Letter of Map Revision (LOMR) with FEMA for the property and will submit the LOMR Application no later than December 31,2019 and shall complete the LOMR, subject to FEMA scheduling and timelines. An amended Special Use Permit will also be issued pursuant to this Director's Decision Letter.
