APPLICANT/OWNER: Town of Carbondale REPRESENTATIVE: PROPERTY: LEGAL DESCRIPTION ZONING: Jeff Jackel, Carbondale Recreation Director Chris Lehrman, SGM Gus Darien Riding Arena, located approximately 1 mile east of the Town of Carbondale off of County Road 100. The property is known by Assessor's Parcel No. 2393-354-00- 035. The site is 6.78 acres in size. A tract of land situation in Lot 12, Section 35, Township 7 South, Range 88 West of the 6th Principal Meridian, and more fully described in a Quit Claim Deed recorded at Reception No. 425129 with the Garfield County Clerk and Recorders Office. Rural (R) I. BACKGROUND - DESCRIPTION OF PROPOSAL The proposed structure is a roof to be constructed over the existing main grandstand. lt will consist of new 4" slab foundations, studded walls and floor beams to support the roof. No expansion of the seating is proposed and the roof is for spectator protection from inclement weather or sun exposure. There are no other changes to the existing type of uses occurring on the rodeo property at this time. Minor modifications to the announcer's booth are also proposed. The improvements will provide weather protection for the announcers and electrical equipment including windows and a door. lmprovements will also include upgrades to ensure building code compliance. Access to the Rodeo Grounds is existing off of County Road 100 and includes a paved apron at the driveway access along with pavement on the first approximately 200 ft. of the driveway. Restrooms exist on the site and additional portable facilities are brought to the site for special events. Most parking areas and internal circulation are compacted d¡r1 or gravel. Additional parking is available on an adjacent propefty for special events. II. AUTHORITY - CRITERIA A. The request is being considered in accordance with Gadield County Land Use and Development Code, Section 4-111Location and Extent Review. The review criteria for a location extent is noted below. Location and Extent Review Criteria - Section 4'111 (C) The Planning Commission shall determine whether the project is in general conformance with the Comprehensive Plan. B. Decision making authority for Location and Extent Review is with the Planning Commission and the Commission may approve or disapprove of the request based on the above criteria. A finding of disapproval may be appealed in accordance with the Colorado Revised Statutes. A Planning Commission Resolution formalizing the Commission's action will be prepared. C. The basis for the Location and Extent Review is found in the Colorado Revised Statutes (530-28-110(1Xa)) that requires ...Whenever any county planning commission...has adopted a master plan of the county...no road, park, or other public way, ground, or space, no public building or structure, or no public utility, whether publicly or prívately owned, shall be constructed or authorized in the unincorporated territory of 2 VICINITY MAP Rodeo Grounds the county until and unless the proposed location and extent thereof has been submitted to and approved by such county planning commission. D. Typically a Location and Extent Review does not include conditions of approval based on the single review criteria and finding, Additional review with the County Attorney's Office has determined that conditions of approval relevant to the review criteria may be appropriate and can be included in the Planning Commission decision on the Location and Extent Review. III. STAFF REVIEW AND ANALYSIS 1. Public notice required for the Location and Extent Review included publication, posting, and certified mailing to property owners within 200 ft. and mineral right owners. No public comments have been received at this time. 2. The Garfield County Comprehensive Plan 2030 designates the site Residential Medium High (RMH). lt is also located within the Town of Carbondale Urban Area of lnfluence. Excerpts from the Comprehensive Plan are outlined below in italics with staff analysis shown in bold. An excerpt from the Comprehensive Plan Future Land Use Map is also provided. Chapter 3 Urban Growth Areas and lntergovernmental Coordination Issue No. 3: Ensure that county land use policies and development approvals are compatible with the existing zoning and future land use objectives of the appropriate municipality. 3 Strategies/Actions No. 7: Work cooperatively within the region on issues that transcend political boundaries such as housing, transit and economic development. The proposal is presented by the Town of Carbondale and is an upgrade to an existing facility that is an important amenity for the residents of Carbondale and Garfield Gounty. The Rodeo Grounds are noted in the Carbondale Comprehensive Plan in the Parks and Open Space Chapter (4.13) under the inventory of existing open space (Table 4.35) and under planned improvements (Table 4.37). The plan includes "Gus Darien Riding Arena lmprovements and Expansion" Chapter 3 Section 3 Transporiation Goal No. 2: Support public transit seruices as well as alternative modes of transportation, when and where feasíble. The riding arena is primarily accessed by vehicles and the site plan provides significant areas for parking. The site is also accessible by bicycle or by foot via the Rio Grande Trail which is located on the south side of County Road 100. The Town should continue to promote alternate modes of transportation for access to the facility. The current operation plans include traffic control at the County Road crossing for pedestrian and bicyclist safety during special events. 4 EXCERPT FROM COMPREHENSIVE PLAN FUTURE LAND USE MAP Rodeo Grounds TAN YELLOW PALE YELLOW GREY RED BAND YELLOW BAND PINK ASTERISK TAN ASTERISK = RESIDENTIAL MEDIUM HIGH = RESIDENTIAL MEDIUM = RESIDENTIAL LOW = URBAN GROWTH AREA = URBAN AREA OF INFLUENCE = CITY LIMITS = RURAL EMPLOYMENT CTR. = VILLAGE CENTER The proposed structural improvements will not increase the capacity of the facility and will not in themselves generate additional traffic. Chapter 3 Section 4 - Economics, Employment and Tourism lssue No. 6: The growth of tourism in Gartied County continues to diversity the county economy. Tourism based commercial activities are an important part of the commercial economic sector, and tourism based employment provides jobs for Garfield County residents. The Townns rodeo facility is an important local amenity and a draw for tourists. The proposed structure will improve. the quality of the spectator's experience. Chapter 3 Section 5 Recreation, Open Space and Trails Goal No. 3: Provide opportunities for the tourism industry to utilize recreational resources as well as to preserue recreation resources for local access. The Town's rodeo facility is an existing recreational resource and the proposed improvements will enhance the quality of the facility and its operational infrastructure. The facility is extensively utilized for Iocal events. 5 Chapter 3 Section 6 Agriculture Issue No. 2: Agrículture is strongly associated with the western heritage and rural impact of the unincorporated areas of the county. The Town's rodeo events are a significant way to support, educate about, and enjoy the County's western heritage and rural character. The facility provides a venue for events that is not generally available elsewhere on the eastern end of the County. Chapter 3 Section 7 Water and Sewer Services Goal No. 1: Ensure the provision of legal, adequate, dependable, cost-effective and environmentally sound sewer and water seruices for new development. The water and sanitation provisions at the rodeo facility are typical of this type of rural event center. Provision of portable toilets for special events should be carefully monitored by the Town to ensure that adequate numbers are provided. The existing permanent toilets are served by an onsite waste water treatment system that should be proactively managed with scheduled maintenance and pumping. The Town's Application was referred to the County Road and Bridge Depaftment They indicated no issues with the facility. 4. The Applícation was also referred to the Sheriff's Department, Carbondale Rural Fire Protection District, and County Environmental Health to assess if there were safety concerns. No comments were received. 5. The conceptual designs for the roof structure indicate a building height of approximately 26 ft. to the midpoint of a sloped roof and 32 ft, to the highest point of the roof. The conceptual plans are in compliance with the rural zone district maximum building height of 40 ft. for a non-residential structure. 6. The new construction will be required to obtain building permits from the County and comply with all building code requirements. 7. Use of non-glare finishes on the proposed roof is recommended to help reduce the potential for visual impacts. IV. SUGGESTED FINDINGS FOR APPROVAL The following suggested findings for approval of the Location and Extent request make reference to the approval criteria contained in Section 4-111 (C) of the Land Use and Development Code: Location and Extent Review Criteria - Section 4'111 (C) The Planning Commission shall determine whether the project is in general conformance with the Comprehensive Plan. Suggested Findings for Approval 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, approval of the Location & Extent request by the Town of Carbondale for a public structure and related improvements at the Carbondale Rodeo Grounds is in the best interest of the health, safety, and welfare of the citizens of Garfield County. 4. That the Location and Extent request has been determined to be in general conformance wíth the Comprehensive Plan 2030, as amended. 7 S. That the Location and Extent request is in conformance with the Review Criteria contained in Section 4-111, Location and Extent of the Gadield County Land Use and Development Code, as amended. 6. The determination of General Conformance is based on the Applicant's representations in their Application submittal and at the public hearing before the Planning Commission. V. PLANN¡NG COMMISSION ACTION Staff supports Planning Commission approval of the Town of Carbondale Location and Extent Request for improvements at the Carbondale Rodeo Grounds subject to the suggested findings and the following conditions of approval. A resolution of the Planning Commission will be prepared consistent with the Commission's motion and the Commission's action is the final decision unless appealed. The Commission's motion should include authorization for the Chairman and Secretary to sign the resolution. 1. That all representations made by the Applicant in the Application shall be conditions of approval unless specifically altered by the conditions of approval contained herein. 2. That the Facility shall be operated in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 3. That the roof structure and improvements to the announcer's booth shall comply with all building code requirements and obtain building permits through the Community Development Department as applicable. 4. The facility shall utilize non-glare finishes or neutral colors to lessen visual impacts of the proposed roof structure. F. In accordance with state law, the Planning Commission has adopted a Master Plan. The Master Plan applicable to this Petition is the Comprehensive Plan. G. The Commission opened a public hearing on May 25,2016 upon the question of whether the proposal is in general conformance with the Comprehensive Plan. H. A few things the applicant should note: 1. The onsite wastewater treatment system (OWTS) should be regularly inspected and maintained, as the applicant has indicated they already do. Maximum flows should be monitored to ensure the system is not overwhelmed during larger events. 2. Regular testing of the drinking,water should occur to ensure it is meeting regulations and is of high quality, and treatment should be installed if necessary. 3. Dirt parking lots and roads surrounding the property should be sprayed with water as needed if dust emissions from the site become an issue. Our office has not received any complaints about this from neighboring homes, so I am assuming it has not been a problem to date. 4. Animal refuse that could contain E. coli or nitrates should be properly disposed of for protection of ground and surface water in the area. We are supportive of the Carbondale rodeo as an economic and recreational attraction for the community and want to see it be a safe and enjoyable venue. Please feel free to óontact me with questions.
