Pursuant to the Attached Minutes the request to rescind the Notice of Violation and
reverse the Director's Decision failed by a vote of 3 - 2 (Approval by 4 members is
required by code).
The Director's Determination and NOV were upheld and will remain in effect.

Brad Jordan called the August24,2020, Board of Adjustment meeting to order.

3. Approval of Minutes from Mav 28. 2020:
Minutes for the May 28,2020, Board of Adjustment Meeting were approved as submitted
4.Public Hearinq:
a. PRESENTER(S): Glenn Hartmann & Sheryl Bower
b. APPLICANT: Bedrock Resources, LLC
c.REQUEST: Public Hearing for Consideration of an Appeal of a Notice of
Violation and Request that the Notice be Rescinded, associated with Water
Storage Tanks being Stored on the property located at 560 County Road 315,
Silt, Colorado, an approximately 35.72 acre tract in Section 18, Township 6
South, Range 92 West.

Principal Planner Glenn Hartmann advised that Staff published notice of the meeting and
provided the appropriate notice documentation to the Garfield County Attorney's office.
Assistant County Attorney Kelly Cave advised that staff did provide adequate notice for the
meeting.
Staff and the Board of Adjustment discussed the procedure for the meeting and introduced the
applicant and their representative, Haley Cramer with Garfield & Hecht.
DanielAdams made a motion to limit public comment to 2 minutes. Jarman Smith seconded the
motion.
The motion failed with a roll callvote
Russell Talbott made a motion to not include public comment or accept recent public exhibit
#12,for the purpose of this hearing. Jarman Smith seconded the motion.
The motion passed with a roll call vote.
Glenn Hartmann presented exhibits #1-11. Chairman Brad Jordan accepted all exhibits into the
record.
Garfteld County
Mr. Hartmann presented an over-view of the proposed appeal to the notice of violation, as well
as staff analysis and recommendations.
The Board of Adjustment and Garfield County Staff discussed the application to appeal to the
notice of violation and whether or not the notice of violation was issued in good faith.
Russell Talbott made a motion to close the public portion of the hearing.
Russell Talbott made a motion stating the Garfield County Staff was in error in their
administrative decision to issue a Notice of Violation to the applicant and would like to reverse
the decision. DanielAdams seconded the motion. The motion failed with a 3-2 vote.

No other members of the Board of Adjustment wished to make another motion, changing their
stance on the appeal to the notice of violation. Therefore, the appeal to the Notice of Violation
failed. The Director's Determination and NOV were upheld and will remain in effect.
4. Other Business
Jarman Smith and Daniel Adams asked about having a meeting to review the BOA by-laws.
After a brief discussion regarding dates, Garfield County Staff advised they would like to try and
schedule the meeting on October 26th.
