Appeal of Notice of Violation
Greetings:
As you know, this law firm represents Bedrock Resources, LLC ("Bedrock"). Bedrock is
the record title owner of the property located at 560 County Road 315, Silt, Colorado (the
..property"). Bedrock received a Notice of Violation from Garfield County dated June 17,2020
(ttre i,¡fotióA'). On ¡¡¡¡e 26,2020, Bedrock frled an appeal of the Notice. A meeting before the
òu.ftrlC County Board of Adjustment is scheduled for August 24,2020, to consider the appeal.
The purpos¿ of this letter is to note Bedrock's objections to certain procedural nìatters related to
the appeal.
As an initial matter, it is not clear from the Garfreld County Land Use and Development
Code ("LUDC") that the Notice was properly issued in the first instance or that the administrative
interpietation appeal procedures apply. According to LIIDC Section l2-103(B), a Notice of
Violation may b" Irsued when the Enforcement Offìcials have personal knowledge of any violation
of this LUDC. Tþe Notice Bedrock received does not identify a violation of the LUDC' Instead, it
alleges thar the Property is being used in violation of the Land Use Change Permit ('Permit")
issuãd for the property pursuant to Garfield County Resolution No. 2012-85. The Permit is not the
LIIDC. Similarb, puisuant to Section l2-106(CX1), the Board of Adjustment considers appeals
of administrative interpretations made by Enforcement Officials, i.e,, LUDC interpretations, not
land use change p..*lt interpretations. The review criteria set forth in LUDC Section 4-117(C)
regarding administrative interpretation appeals further indicates that such appeal procedures are
nol int*nd.d for permit violations. Specifically, those criteria include the following: (l) the
technical meaning of the provision being appealed; (2) evidence as to the past interpretation of the
provision; and 1:l the effect of the interpretation on the intent of the LUDC. The circutnstances
identifiedin the Notice and the actions taken by the County under the LUDC to address them are
incongruous al best.

The propriety of the issuance of the Notice and the pending appeal aside, Bedrock objects
to any publiı cómmãnt being taken during the appeal proceedings. The LUDC does not state that
the Boàrd of Adjustment wl-l issue its deıision after a public hearíng. To the contrary, the Board
oiÀOjustment,s'Bylaws simply state that its meetings must be open to the public. A public meetìng
is noi the same as a public hearing. Additionally, the noticing requirements for an appeal to the
Board of Adjustmenlare not consistent with what is typically required for a noticed public hearing

published notice is required ior anailministrative interpretation appeal. In any event, the Board of

process concerns.

l. Applicable Code Sections
Article 4-117 (A) An appeal may be taken to the Board of Adjustments by any person
aggrieved by a final written Administrative lnterpretation of this Code by the Director.
Article 1-203 (B) (2) ln order for the Board of Adjustment to grant an appeal that overturns
an administrative interpretation, at least 4 members of the Board of Adjustment must
vote in favor of the aPPlicant.

the following criteria in hearing an appeal of an administrative lnterpretation of this Code:
1. The technical meaning of the provision being appealed.
2. Evidence as to the past interpretation of the provision: and
3. The effect of this interpretation on the intent of this Code'
I¡. APPEAL - REQUEST
The Applicant has submitted a formal request to appeal the issuance of a Notice of
Violation associated with the use of the subject property for the storage of water storage
tanks. The Notice of Violation indicated that the use was out the scope of the Land Use
Change Permit for the property approved by Resolution No. 2An-85. The Appeal
represents that the placing of empty water tanks on the property is consistent with the
Land Use Change Application and Permit.
III. BACKGROUND
A. On September 4, 2012, the Garfield County Board of County Commissioners heard
a request by Bedrock Resources to consider their application for a Major lmpact Land
Use Change Permit for a Contractor's Yard for the Operation of an Asphalt Paving
Business and Related Accessory Uses. Within the application and during the public
hearing the applicant (or their representative) consistently referred to the proposed
use as being associated with an asphalt contractor business for Frontier Paving, lnc:
The Application included a detailed outline of the proposal (see attached
excerpt, correspondence dated 5125t20 from Jefferey Simonson, SGM).
Within that application, Mr. Simonson states, "As we had discussed in the pre-
app¡cation conference, the uses anticipated far fhis sife will be in support of
the asphalt/contractor business for Frontier Paving,lNC'"
The application materials also include, "To restate fhe uses. [with] slightly
more detail as follows:
a. affice Space
b. A shop for vehicular/equipment and truck repair
c. A covered Parking/starage area
d. Storage of materials used in the asphalt/cantracting business such as
recycle asphalt, millings, road base, rock, pit run, concrete, etc'..
e. Some crushing activity of the stored materials such as rock, asphalt and
concrete witt be performed (portable and limited seasonal)

f. Storage of landscaping materialsuch as topsoil and rock for use by the
business (no vegetation-landscapi ng contracting).
A site plan and landscaping plan are provided for reference and make no mention
of storage of water tanks as the proposed/permitted use.
ln addition to the application materials plainly stating that the approval sought was
for a contractors yard associated with an asphalt business, the notice that went
out to the paper along with the adjacent property owners specifically stated that
the proposal was for a "Contractor's Yard in suppart of the Applicant's
asphatt contractor business". The text from the public notice included under
the Description of the Request Section is provided in the excerpt below:
Request: The Apptication requesfs Maior lmpact Review approval for a
Contractors Yard in support of the Applicant's asphalt contractor
þøsrness. The uses witt include office Epace, a shop for vehicle/equipment
and truck repair, a covered parking/storage area, storage of material used
in the asphatt/contracting busrness, some crushing activity of the sfored
materials such as raek, asphatt and concrete, and storage of landscaping
materials such as topsoit and rock for use by the business. The overall
property sLe rs approximately 35.72 acres. The property is Zoned Rural.
The Applicant's designated representatives are Damien Ellsworth, Vice
President, Jefferey Simonson, Schmueser Gordon Meyer, lnc., David H.
McConaughy and David D. Smith, Garfield & Hecht, PC.
A review of the audio from the Septembe r 9,2012 public hearing (Garfield County
does not prepare written minutes), has the applicant representing on the record
the proposed use is for a contractor's yard in support of the asphalt/contracting
business.

At no time during the meeting or within the application material did the applicant mention
that the site might also be used for other uses, specifically and solely the storage of water
tanks.
B. The Application was approved by Resolution No.2012-85. The Resolution (see
attached) includes in the title the following text (see box below).

To clarify, the title of the Resolution (as is typically the case) provides generic language
of what is being approved pursuant to the specific cite in the Land Use Table 3-403.
Because this is not an as of right use, the details of what was approved are covered in
Condition #1 which reads as follows:
,,That all representations made by the Applicant in the application, and at the
public hearing before the Board of County Commissioners shall be conditions of
approval, unless specificatty altered by the Board of County Commissioners. "
Clearly, what the BOCC (and the public) were being asked to review was a contractor's
yard with the necessary structures, parking, storage and crushing associated with an
asphalt business and not with a tank storage facility. The condition also requires that if
the applicant wants to make changes to those representations that the Board of County
Commissioners would need to be the entity altering that approval. (lt should be noted
that staff has had a number of meetings with the applicant, providing them with the
procedure and information they would need to bring their request back to the BOCC to
consider changes to allow the property to be used as a tank storage yard. The applicant
has opted not to follow the processes laid out by staff and instead seek to argue that
staff erred in interpreting the language of the approval)'
IV. NOTICE OF VIOLATION ISSUED
ln21lg the County received complaints from an Adjacent Property Owner regarding the
subject property being used to store water tanks along with screening concerns. These
complaints were investigated by County Code Enforcement Officer, Wade Patton. Mr.
Patton found that the property was being used to store approximately 50 empty industrial
water storage tanks. (see attached photographs)'
On June 17 , 2020, a Notice of Violation (NOV) was issued to Bedrock Resources LLC,
indicating that the use of the property for water tank storage was not consistent with the

approvals granted through Resolution 2012-85, specifically for Condition #1 regarding
all representations of the Applicant.
V. STAFF ANALYSIS
Criteria to consider:
1. The technical meaning of the provision being appealed.
To fully understand why the current use of the property is inconsistent with its Major
lmpact Land Use Change Permit approval, one needs to understand the nature of Major
lmpact review and approval processes. Uses listed as "Major lmpact" are not uses
"permitted as right", Major lmpact Uses, require the review and consideration by the
BOCC to determine if the use is compatible with the surrounding area and to hear
testimony by the public on potential impacts that can be associated with a specific
request. ln order to make that determination and apply conditions that ensure that the
proposed use is compatible with the general area, the BOCC asks the applicant to
describe exactly what they plan on doing. The BOCC approval along with the conditions
included within the resolution are based on the specific request. including the
application and any representations made by the applicant at the public hearing. All
Major lmpact Land Use permits approved by the County include a condition that says:
,, That all representations made by the Applicant in the application, and at the
public hearing before the Board of County Gommissioners shall be conditions of
approval, unless specifically altered by the Board of Gounty Commissioners. "
The appellant's attorney argues that:
,4s sfafed in the Permit and the Resolution, the Permit allows a contractar's yard and
accessory uses including, among ather things, storage of machinery, equipment, or
products to occur on the Property. The LIJDC defines "storage" as "an area used for'storing
machinery, equipment, minerals ar other products." Placing empty water tanks
on the Property falls squarely within that definition. lt is a/so consrsfent with Bedrack's
application for the Permit.
lf it was not for the condition that states that all representations made by the applicant
are conditions of approval, staff might agree with the Appellant's attorney, however you
can't ignore that condition. That condition places very specific limits on what can and
cannoi be done under the approval and who must approve the alteration (The BOCC),
irregardless of any language within the resolution that might indicate othenvise. The
appìication submitted and the statements made at the hearing to consider the request,

laid out a very specific use of the properly, "Contractor's Yard in support of the
Appticant,s aípnatt cantractor business". While staff is sympathetic to the appellant's
Oeéire to change what they want to do on the property (staff has met with the applicant
a number of times since last fall to specifically lay out what is needed to request a
change),changing the use from one associated with the applicant's asphalt contractors
business to the storage of water tanks in the absence of "specifically [being] alterg_d
by the Board of Couity Commissioners" is not in compliance with Resolution 2012-
85.
2. Evidence as to the past interpretation of the provision.
As mentioned previously, Major lmpact Uses are not permitted as of right (as of right
uses require no Planning Division review), all are reviewed and approved based on the
specific details of the proposed use. Every resolution approving a Major lmpact Land
Use Change Permit contains the condition that:
" That all representations made by the Applicant in the application, and at the
public hearing before the Board of County Commissioners shall be conditions of
approval, unless specifically altered by the Board of Gounty Commissioners' "
The BOCC includes Condition #1 to tie the approval to the specific development as
described through the application and statements made by the applicant at the hearing.
Because the Code recognizes a contractors yard as a use that has the potential of having
major impacts, the BOCC reviews and applies conditions based on those specific
impacts. lnstead of specifically detailing all the information that formed the basis for the
BOCC review within the resolution, the Board relies on the catch all language in
Condition #1, which basically says: we are issuing an approval for what you specifically
said you were going to do on the property and if you want to do something else come
back to us and we'll consider altering it. There is no provision in the Code, for an applicant
to make the type of changes that have occurred on the Bedrock Resource LLC property
in the absence of amending their approval (Res.# 2An-85)'
Staff has consistenfly required applicants that have Major or Minor lmpact Approval (and
old Special Use permits) to apply for a major or minor modification to their approval if
they want to do something different than what was represented in their application. ln
cases where the property owner does it in the absence of the proper approvals and is
not willing to go through the code required approval process, Notice of Violations have
been issued. The following are examples:

. Telecommun¡cation towers that propose changes to the number of antennas on
their tower or the height of their tower.
o Mining operation that look to change the type of material being produced/mined.
o Accessory dwelling unit approvals that are proposing to change their
representations as being seasonal use only to year-round use.
o Oil and Gas operations that are proposing to change their point of access onto
their well Pad.o Log Home contractor business that is looking to change to a dirt processing and
grading contractor's oPeration.
(lf the Board of Adjustment wants specific examples staff is prepared to provide them at
the meeting).
3. The effect of this interpretation on the intent of this Gode.
The condition being applied to this (and every) major impact approval is very clear in its
meaning and intent (you are approved to do what you indicated you plan on doing)' lf
the Board of Adjustment, determines that staff has applied the condition of approval
language in an inappropriate matter it would have the devastating effect of putting into
question all major impact approvals. lt would also undermine the BOCC'S role in the
approval process and be a disservice to the public as it would allow for development that
could be very different from what was presented.
Allowing such changes could lead to significant unintended consequences and impacts
not properly vetted in front of the BOCC at a public hearing.
VI. SUGGESTED FINDINGS - STAFF RECOMMENDATON
The Staff Recommendation is for the Board of Adjustment to formalize a motion
upholding the Director's tnterpretation of the Land Use and Development Code
including the Bedrock Resources Land Use Ghange Permit and the issuance of a
Notice of Violation for the property and denvinq the Applicant's Appeal.
Staff recommends that the motion include direction for Staff to prepare an appropriate
Resolution to include the following suggested findings #1 -#4 . The motion should also

The Garfield County Community Development Department has reason to believe a possible

Appeal of Notice of Violation
Greetings:
This law firm represents Bedrock Resources, LLC ("Bedrock"). Bedrock is the record title
owner of the property lôcated at 560 County Road 315, Silt, Colorado (the "Property"). Bedrock
has receive¿ á Noticé of Violation from Garfield County dated June 17 ,2020 (the "Notice"). The
Notice alleges that the Property is being used in violation of the Land Use Change Permit
(.,permit,,) Issued for the Pioperty pursuant to Garfield Cor"rnty Resolution No. 2012-85 (the
ìResolution"). Specifically, the Notice states that water storage tanks are being stored on the
property, which is outside ih. r.op. of the uses authorized under the Permit. Bedrock disputes that
u uiolution of the permit has occured and therefore appeals the Notice pursuant to Article 12 of
the Garfield County Land Use and Development Code ("LUDC")'
As stated in the Permit and the Resolution, the Permit allows a contractor's yard and
accessory uses including, among other things, storage of machinery, equipment, or products to
occur on the Property. The LUDC defines "storage" as 'oan area used for storing machinery,
equipment, mineräls ór other products." Placing empty water tanks on the Property falls squarely
*ithln that definition. It is also consistent with Bedrock's application for the Permit.
First, the land use application form submitted as part of Bedrock's application identified
,,storage of machinery, equipment, or produçfs"-¿ use listed in the 2008 LUDC use table-as one
of the-requested usãs fôr-the Property. Second, among the specific uses referenced in the
application cover letter was, as noted in the Notice, a 'ocovered parking/storage area." The
apptication did not further qualify what would be stored there, so storing the water tanks in that
uiéu ir not in conflict with the application. Third, the application only specified the types of
materials that would be stored on the Property (i.e., "materials used in the asphalt/contracting
business such as recycle asphalt, millings, road base, rock, pit run, concrete, etc."), but it did not

attempt to define or limit what types of equipment or other products would be stored on the site.
Fourtñ, the site plan that is included as an exhibitto the Permit and to the Resolution only identifies
.ostorage areas" on the Property and does not include any examples of what would be located in
those ãeas. Fifth, neither the Permit nor the Resolution exclude certain products, materials, or
equipment from being stored on the Property. Finally, empty water tanks are not inconsistent with
thè fypes of products and equipment that may be used in connection with an asphalt/contractor
business, so they should be permitted to remain on the Properly.
For the reasons stated in this letter, Bedrock asks that the Notice be rescinded and that the
use cited in the Notice be allowed to continue as it is consistent with the Permit.

involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the

Submission Clarification on Application
Dear Glenn,
The purpose of this letter is to provide you mory insight on the recent application
that you have started reviewing for Bedrock Resources, lnc. on their property
adjaóent to Mamm Creek and the Garfield County Airport. As you areaware, this
application has been prepared on the heels of the BOCC denial of Bedrock's
piibr apptication that consisted of the office, shop, material storage, contractor's
yard, equipment, machinery and product storage, recycling processing facility
ând perhaps the most contentious use, an asphalt batch plant. As we had
discussed in the pre-application conference, the uses anticipated for this site will
be in support of the asphalUcontractor business for Frontier Paving, lnc. To
restate the uses, those mentioned in your Pre-application Conference Summary
are restated and slightly more detailed as follows:
a. office space
b. a shop for vehicle/equipment and truck repair
c. a covered Parking/storage area
d. storage of materials used in the asphalUcontracting business such as
recycle asphalt, millings, road base, rock, pit run, concrete, etc...
e. some crushing activity of the stored materials such as rock, asphalt and
concrete will be pertormed (portable and limited - seasonal)
,f . storage of landscaping materials such as topsoil and rock for use by the
business (no vegetation - landscape contracting)
As the previous application considered the above uses in conjunction with the
asphalt batch plant, this application removes the asphalt batch plant and
therefore the intensity of use to the property such as continuous/daily truck traffic
hauling asphalt out and "ingredients for asphalt paving" in. However, the
occasiınal traffic needed to move the other materials in and out are needed to be

anticipated. The only "daily" employee anticipated at the site on the upper mesa
will be that of a mechanic. There will also be occasions when a crusher will be
brought in to "process" those materials listed in item d., above. These are likely
times of the year when the asphalt business is "shut down" for the season or
during inclimate times for paving.
As noted previously, the major change in the application submittal is that of
removing the contentious use, the asphalt batch plant. ln this manner, we are
able to reutilize nearly every report previously prepared as the remaining uses
sought for this application are less intensive from an impacts standpoint.
Note that as the prior application dealt with the machinery and equipment
associated with the batch plant, such issues as needing to modify the FAA
avigation easement are not necessary as the batch plant was the controlling
factor from a height standpoint. This application remains consistent with the
conditions of approval required therein. Likewise, the City of Rifle watershed
permit is not necessary to be adjusted as the conditions of approval of the prior
defined uses remain applicable and more easily attainable as the concerning
aspect of the prior application, the asphalt batch plant, has been removed.
Likewise, the drainage grading and best management practices for stormwater
management remain às previously proposed even thought the grading plan now
impacts less area.
The prior application was riddled with concerns over the air quality aspects and
emissions from the asphalt batch plant. ln addition, as there was an asphalt
batch plant, the APEN permit was a requirement. Now, the area of disturbance
and the fact that no asphalt batch plant is proposed, there is not a need for an
APEN.
We have adjusted the Noise Assessment Report (prepared by Engineering
Dynamics, lnc.) and the Traffic Study (prepared by SGM). Obviously, in both
cases, the respective concerns and impacts have lessened as the batch plant
has been removed.
Such reports aS the erosion control plan, weed management plan,
archaeological, cultural and wetland reports remain effective for this project as
with the prior and therefore, have not been modified even though the uses are to
be less intense from a land use standpoint. For the landscape plan, the grading

permit application previously submitted by Bedrock Resources contains such and
is required to be executed regardless of the outcome of this land use action.
Finally, as with the prior application (and processing/review thereof), you will find
that Divisions 2 and 3 of Article 7 of the County's Land Use Resolution are
addressed throughout the application as the application has been prepared in
accordance with the outline as provided in the Pre-application Conference
Summary of 3l2AI12

FËE SCHEDULE
Garfietd County, pursuantto Board of County Gommissloners ("Board") Resoltttlon No.
98-09, has established a fee structure {"Base Fee") for the processing of each type of
subdivision and land use applications.
The Base Fee is an estimate of the average number of hours of staff tima davoted to
an application, multiplied by an hourly rate for the personnel involved. The Board
recognized that the subdivision and land use application processing time will vary and
that an applicant should pay for the total cost of the review which may require
additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of
the respective positions combined with an hourly overhead cost for the office will be
used to establish the actual cost of County staff time devoted to the review of a
particular project.
Actual staff time spentwill be charged againstthe Base Fee. Afterthe Base Fee has
been expended, the applicant will be billed based on aetual staff hours accrued. Any
bilting shall be paid in tull prior to final consideration of any land use permit, zoning
ameñdment or subdivision plan. lf an applicant has previously failed to pay application
fees as required, no new or additional applications will be accepted for processing until
the outstanding fees are Paid.
Checks, including the appropriate Base Fee set fo¡th below, must þe çubmitted with
each land use application. and made payable to the Garfield Çounty Treasurer.
Applications will not be accepted without the required application fee. Base Fees are
non-refundable in full, unless a written request for withdraw from the applicant is
subrnitted prior the initial revíew of the application materials"
Applications must include a Payment Agreement Form ('Âgreement") set forth below.
The Agreement estaþlishes the applicant as being responsible for payment of all costs
associated with processing the application. The Agreement rnust be signed by the
party responsibte for payment and submitted with the application in order for it to be
accepted.
The following Base Fees shall be received by the Coun$ at the time of submittal of
any procedural application to which such fees relate. $uch Base Fees shall be in
addítion to and exclusive of any cost for publicâtion or cost of consulting service
determined necessary by the Board for the consideration of any application or
additional County staff time or expense not covered by the Base Fee, which have not
otherwise been paid by the applicant to the County prior tÕ final actlon upon the
application tendered to the County.

1. All applications shall be submitted with a signed Agreement for Payment form set
forth below.
2. County staff shall keep accurate record of actual time required for the processing
of each land use application, zoning amendment, or subdivision application. Any
additional billing will occur commensurate with the additional oosts inourred by
the County as a result of having to take mote time that that covered by the base
fee.
3. Any billings shall be paid prior to fÏnal consideration of any land use permit,

4. Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be

5. ln the event that the Board determines that special expertise is needed to assist
them in the review of a land use perrnit, zoning amendment, or suþdivision
application, such coss will be borne by the applicant and paid prior to the final
consideration of the application. All additional æsts shall be paid prior to the
execution of the written resolution confirming action on the application.
6. lf an application involves multiple reviews, the Applicant shall be charged lhe
highest Base Fee listed above.
7. Types of "Proçedures" not listed in the above chart will be charged at an hourly
rale based on the pertinent planning slaff rate listed above.

NARRATIVE OF APPLICATION PURPOSE
The purpose of this application is to seek land use approval under the Major
lmpact Review criteria of the Garfield County Unified Land Use Resolution of
2008 (ULUR).
Bedrock Resources, LLC has purchased the subject property for relocation of
their asphalt paving and construction business to a currently undeveloped
property located approximately 113 of a mile south of the 170/Mamm Creek
interchange, east of and along side of Mamm Creek Road (CR 315) and
approximately 1/3 of a mile east of the Garfield County Airport. As the property is
currently used as inigated and grazed agricultural land and as the property is
zoned aS "Rural" under the ULUR, the proposed uses for the property are subject
to the Major lmpact Review as noted in Table 3-501 of the ULUR.
The relocated business generally includes a contractor's yard with processing
and storage of natural resources. An office is intended to be located on the lower
portions of the site (immediately accessible to CR 315) while the stock piles,
processing and storage of natural resources, equipment sheds and shop will be
on the bluff out of view of CR 315. An internal roadway is proposed between the
bluff and the office with grades under 10% lo provide safe access for the uses
intended.
