The applicant is working with Garfield County to expand the County Road 109 right-of-way in
order to install a trail that is part of the Safe Routes to School system. No other changes are
proposed as part of the application.
The existing property is currently vacant and bordered by the Roaring Fork River. The parcel was
originally part of the Rose Subdivision Exemption, which created the lot pursuant to Resolution
(82-18). ln 1984, a portion of the property created by the Subdivision Exemption was transferred
to the Board of County Commissioners for right-of-way. ln addition to documenting the current
transfer, this Plat corrects the Warranty Deed transfer to the BOCC in 1984, which had some
surveying issues as identified on the Plat.

The parcel is located south of the Roaring Fork River and east of County Road L09. No dwelling
unit is located on the property. The parcel is relatively flat in the area where the lot line will be
amended, with some slope down from the County Road. Along the road the parcel is developed
with native vegetation.

III. APPLICABLE REGULATIONS
The Amended Final Plat Application is processed in accordance with Section 5-305, Amended
Final Plat Review and Tables 5-103 Common Review Procedures. Section 4-103 and 4-101 address
details of the review procedures.
The Application has been determined to be complete including the waiver requests addressing
the fact that an lmprovements Agreement is not warranted for the Plat Amendment Request.
Public notice was required for the Director's Decision in accordance with Sections 4-103 and 4-
101. The Applicant has provided evidence of completion of the required notice for the Diréctor's
Decision.
IV. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. No public comments were received as a result of the
public notice. Referral Comments received on the Application are attached as Exhibits and
summarized below:
Garfield County Surveyor (Exhibit 7): No issues were identified by the County Surveyor.
STAFF ANALVSIS AND CRITERIA
L The Applicant's proposalwas reviewed against the Amended Final Plat Criteria contained
in Section 5-305 (C), as follows:
a) Does not increase the number of lots
- The proposed Amended Plat will not increase the number of lots.
b) Does not result in a major relocation of a road or add any new roads; or
- The proposed Amended Plst will not result in o major relocation of a road or
odd new roads. The County Rood right-of-way will be increased, but the road
will remoin in its current location.
c) Will correct technical errors such as surveying or drafting errors'
- The Amended Finol Plot indicates thot the survey is fixing certain errors from
the original Subdivision Exemption survey.
2. The area of the amended lot will be greater than the 2-aue minimum required in the
Rural Zone District.
3. No changes to existing utility locations are proposed as part of the amended plat process.
Staff understands that the applicant is working with Garfield County Road & Bridge to
redesign the existing driveway for easier access onto the County Road.
4. The provided Title Commitment indicates that there is a Deed of Trust for the property
from Alpine Bank. The applicant shall either provide documentation that the mortgage is
paid off or update the Plat with a Lienholder's Certificate.

5. The Plat identifies a surveying issue that was created when a portion of the property was
deeded to the BOCC as part of a previous right-of-way transfer. This issue is addressed by
the Surveyor in Plat Note #2. The Surveyor provided an updated Plat Note clarifying the
intent as follows:
THAT DOCUMENT RECORDED AUGUST 23, L984IN BOOK 655 AT PAGE 1-08 AS RECEPTION
NO. 355047 CONTAINS APPARENT MATHEMATICAL ERRORS IN THE DESCRIPTION. IN ORDER
TO RESOLVE THE ERRORS, THIS SURVEYOR HELD THE POINT OF BEGINNING, STATED AS THE
INTERSECTION OF THE EAST LINE OF SECTION 35, TOWNSHIP 6 SOUTH, RANGE 89 WEST AND
THE EASTERLY BOUNDARY LINE OF RIVER RIDGE SUBDIVISION, ALONG WITH THE CLOSING
CALL ALONG SAID EAST LINE, AS SHOWN ON SHEET 2.
Staff has reviewed and agrees with the inclusion of the updated Plat Note
Staff supports a finding that the Amended Final Plat Application meets the requirements and
standards of the Garfield County Land Use and Development Code as amended and is
recommended for Administrative Approval by the Director of the Community Development
Department subject to the following conditions of approval:
Suggested Findings
L. That proper public notice was provided as required for the Director's Decision.
2. Consideration of the Application was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested parties were given an
opportunity to provide input prior to the Director's Decision.
3. That for the reasons stated herein, the proposed amended plat is in the best interest of
the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That the application is in general conformance with the 2030 Comprehensive Plan, as
amended.
5. That with the adoption of conditions and for the above stated and other reasons the
application has adequately met the requirements of the Garfield County Land Use and
Development Code, as amended.
Recommended Conditions of Approval
L. All representations of the Applicant contained in the Application submittals shall be
conditions of approval unless specifically amended or modified by the conditions
contained herein.

2. The following amendments shall be made to the plat prior to obtaining signatures on
the plat. The updated plat shall be provided to, reviewed and accepted by the
Community Development Department, and the County Attorney's Office prior to
creating a Mylar copy of the plat and obtaining any signatures. Additional changes or
modifications to the plat may be required by this additional review.
a. The applicant shall update the County Commissioner's Certificate and the
Certificate of Dedication and Ownership to reflect the approved language in the
County Resource Guide. The Title Certificate shall be updated to include the full
names of the property owners.
b. The applicant shall update the title of the Amended Final Plat to reference Tract
A of the Rose Subdivision Exemption.
c. The applicant shall either provide documentation indicating that there are no
liens on the property or shall update the Plat to include the Lienholder Consent
and Subordination Certificate as referenced in the County Resource Guide.
d. A Boundary Line Adjustment application is not required for the Amended Final
Plat. The Plat shall be updated to remove references to a Boundary Line
Adjustment.
e. The applicant shall update the Plat to document that the property owners
appear to be the Mineral Owners of the property.
f. The applicant shall update Plat Note #2 as follows:

Upon review of the Schard Parcel and BOCC Right-oÊWay Parcel Amended Final Plat, I have no comments
or corrections to be made prior to approval for survey content and form.
Once all final comments from Community Development have been completed, the Mylar may be prepared for
recording. The Mylar shall be delivered to the Community Development office with all private party signatures
no later than Monday the week prior to the next commissioner meeting day in order to make that meeting.
