HomeMy WebLinkAbout3.0 Director's Determination 12.01.2020Gørfield County RË December t,2O2O Doug Pratte 365 River Bend Way Glenwood Springs, CO 81601 DTRECTOR DETERMINATION - Amended Final Plat - Rose Subdivision Exemption Tract A FPAA-09-20-8810 Dear Mr. Pratte, This letter is provided to you, as the authorized representative for Garfield County File FPAA-O9- 20-8810 pertaining to an Amended Final Plat to adjust a lot line between Tract A of the Rose Subdivision Exemption and the County Road 109 Right-of-Way. This letter is notification that your request to amend thè final plat has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request. The findings are as follows: 1. That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's Decision. 3. That for the reasons stated herein, the proposed amended plat is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in general conformance with the 2030 Comprehensive PIan, as amended. I 5. That with the adoption of conditions and for the above stated and other reasons the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. The application has been Conditionally Approved. The following list outl¡nes the conditions of approval, some of which need to be completed before the Plat is forwarded to the Board of County Commissioners for a final signature. 1. All representat¡ons of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The following amendments shall be made to the plat prior to obtaining signatures on the plat. The updated plat shatl be provided to, reviewed and accepted by the Community Development Department, and the County Attorney's Office prior to creating a Mylar copy of the plat and obtaining any signatures. Additional changes or modifications to the plat may be required by this additional review. a. The applicant shall update the County Commissioner's Certificate and the Certificate of Dedication and Ownership to reflect the approved language in the County Resource Guide. The Title Certificate shall be updated to include the full names of the property owners. b. The applicant shall update the title of the Amended Final Plat to reference Tract A of the Rose Subdivision Exemption. c. The applicant shall either provide documentatíon indicating that there are no liens on the property or shall update the Plat to include the Lienholder Consent and Subordination Certificate as referenced in the County Resource Guide. d. A Boundary Line Adjustment application is not required for the Amended Final Plat, The Plat shall be updated to remove references to a Boundary Line Adjustment. e. The applicant shall update the Plat to document that the property owners appear to be the MineralOwners of the property. t. The applicant shall update Plat Note #2 as follows: . THAT DOCUMENT RECORDED AUGUST 23, 7984IN BOOK 655 AT PAGE 108 AS RECEPTION NO. 355047 CONTAINS APPARENT MATHEMATICAL ERRORS IN THE DESCRIPTION. IN ORDER TO RESOLVE THE ERRORS, THIS SURVEYOR HELD THE POINT OF BEGINNING, STATED AS THE INÏERSECTION OF THE EAST LINE OF SECTION 35, TOWNSHIP 6 SOUTH, RANGE 89 WEST AND THE EASTERLY BOUNDARY LINE OF RIVER RIDGE SUBDIVISION, ALONG WITH THE CLOSING CALL ALONG SAID EAST LINE, AS SHOWN ON SHEET 2. 3. The Applicant shall submit the following documentation for BOCC signature and recordation: 2 a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any mortgagees; Notice of this decision will be provided to the Board of County Commissioners who have the ability to'call-up'the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10-day notice period.
