I. GENERAL PROJECT DESCRIPTION
The property owner is proposing a Minor Subdivision to split the existing 6.099 acre parcel into
two separate lots. The applicant should note that the minimum lot size in the Rural Zone District
is 2-acres. The existing parcel is improved with an existing single-family residence and several
other structures, and is served by an existing well and Onsite Wastewater Treatment System
(OWTS). The applicant will need to provide a demonstration that the existing OWTS is adequate
to serve the existing use. The applicant is proposing that the new lot would be served by a new
well and an additional OWTS, and as such, the applicant will need to demonstrate that a new
OWTS is feasible on the proposed new parcel.
The Subdivision requires a demonstration of legal and adequate water for both of the proposed
parcels. Staff encourages the applicant to discuss the subdivision with the Division of Water
Resources (DWR) (Contact Dwight Whitehead at the DWR at 970-945-5665 ext. 5011) prior to
submitting an application for subdivision with the County. A water quality test and 4-hour pump
test will need to be conducted for each well (including the existing well) prior to the application
submittal in accordance with Section 4-203.M.1.b.5 of the LUDC. The applicant may request that
water quality and quantity tests be conducted as conditions of approval. All conditions of
approval must be completed within 90 days of approval. The subdivision cannot be finalized
until all necessary conditions of approval are satisfied.

Primary access for both parcels will be from County Road 227. All proposed and existing access
roads and driveways need to conform to the dimensional requirements in Section 7-107 of the
LUDC. The applicant will need to provide an access report from an engineer indicating that the
access is adequate for the proposed new lot and meets County requirements. A Waiver from
this standard may be requested in accordance with section 4-202 of the Land Use and
Development Code (LUDC). Additionally, any access easements for shared driveways need to be
shown on the plat and the application should indicate where existing access points to the County
Road are located.
A site plan for the subdivision is needs to meet the criteria outlined in Section 4-203.D of the
LUDC, including showing any geologic hazards, wetlands, topography, plans for utilities and
associated easements, and other significant on-site features. Article 7, Section 7-106.C of the
LUDC states that:
“All utilities except major power transmission lines, transformers, switching and terminal
boxes, meter cabinets, and other appurtenant facilities shall be located underground
throughout the development unless it is demonstrated to the satisfaction of the BOCC that
compliance is impractical or not feasible and will result in undue hardship.”
As such, the applicant should demonstrate within the application any challenges associated with
installation of utilities. Further, the applicant may request that installation of utilities be
completed as a condition of approval, to remove potential risks associated with application
approvals and early installation by the applicant. If the applicant intends to install above-ground
utilities, a hearing with the Board of County Commissioners will be required.
The applicant will need to create a plat for the subdivision. The applicant’s Surveyor should
insert Certificates as prescribed by the County for the necessary signatures. The plat will need
to include all information as described in Section 5-402(F), including the name and addresses
of the surface owners and mineral estate. The applicant will also need to submit a title
commitment for the subject property and ensure that the plat states that all easements and
encumbrances identified in the commitment are accurately shown on the plat.
Any ditches on the property must be shown on the plat, with the name and mailing address for
the ditch owner. In addition, the applicant will need to provide a list of names and mailing
addresses for all property owners of record within 200ft of the subject property, as well as the
name and addresses of the surface owners and mineral estate.
Proof of ownership is required to process the application. The property owner, per County
assessor records, will need to sign the application or provide a letter of authorization for anyone
else who will be working on the Application.
II. COMPREHENSIVE PLAN
The property is designated in the County Comprehensive Plan as being within the Residential
Medium-High Designation (2-6 Acres per dwelling unit).

III. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
The following Sections of the Garfield Land Use and Development Code are applicable to the
proposed application:

engineering reports for Access, Sanitation, and Groundwater Drainage.

➢ Section 4-103 Administrative Review (public notice)
➢ Section 4-203 Description of Submittal Requirements (as applicable)
➢ Article 7, Articles 1, 2, 3 and 4, as applicable including site planning and subdivision
standards.
IV. SUBMITTAL REQUIREMENTS
Outlined below is a list of information typically required for this type of application. A full
description of each of the required submittal items is available in Table 4-201 and Table 5-402
of the Land Use and Development Code.
• General Application Materials
o Completed application form
o Signed Payment Agreement Form and application fees
o Proof of Ownership (title work and deed) and confirmation of any lien holders.
o Names and mailing addresses of property owners within 200 ft. of the property.
o Mineral rights ownership for the subject properties including mailing address
(see attached memo) and signed Certification of Mineral Ownership Research
form.
o A narrative describing the request and related information.
• A copy of this Pre-application Conference Summary needs to be submitted with the
Application.
• Vicinity Map including areas within approximately 3 miles.
• The Proposed Minor Subdivision Plat showing the proposed lot lines and all easements
existing and proposed, including utility, access, and ditch easements. Final Plat must meet
the standards in Section 5-402(F) and all required Certificates.
• Site Plan and related information (some may be shown on the proposed plat) including
topography, existing improvements, infrastructure, wetlands, utility plan, irrigation
ditches, and other significant features. The site plan should include information on
location of improvements on the property adequate to confirm that no nonconforming
conditions will result from the proposed subdivision.
• Water Supply Plan including information on legal water including well permits, well
pump test along with water quality testing. The plan needs to address the water supply
for all lots. If water quality and quantity testing are requested to be conducted as a
Condition of Approval, then this request needs to be made in the application.

• Wastewater Management Plan needs to include information on the adequacy of the
existing OWTS and information on the feasibility of a future system on the proposed lot
(soils information and any constraints such as ground water).
• Will serve letters from Electric Utility provider. Additional information as necessary to
demonstrate the need to install utilities above-ground.
• Information as applicable to demonstrate compliance with provisions of Article 7
Standards, Divisions 1, 2, 3, and 4. The Application should include representation or
statements that the subdivision will comply with all applicable Article 7 topics.
• Engineering report demonstrating that the existing and proposed access meet the
dimensional standards in Section 7-107 of the Land Use Code.
• Demonstration of compliance with Section 5-301.C Minor Subdivision Review Criteria.
The Application should include representation or specific statements to the review
criteria outlined in Section 5-301.C Minor Subdivision, Review Criteria.
• Form and payment for the Colorado Geological Survey (CGS) review. The payment check
for this referral should be made out to the Colorado Geological Survey.
• A waiver request from submittal of an Improvements Agreement.
• Engineering Reports, as applicable per Table 5-401, Minor Subdivision, A (Roads, Trails,
Walkways, and Bikeways), C (Sewage Collection and Water Supply and Distribution
System), E (Groundwater Drainage), and H (Preliminary Cost Estimates for
Improvements). The applicant should contact Staff to discuss any questions on these
items.
• Copies of existing or proposed covenants on the property, if applicable.
The Application submittal needs to include 3 hard copies of the entire Application and 1 single
Digital PDF Copy of the entire Application (on a CD or flash drive).
V. REVIEW PROCESS
The review process shall follow the steps contained in Table 5-103 and Section 4-103 for an
Administrative Review including:
• Pre-Application meeting (completed)
• Submittal of Application (3 hard copies & one digital copy)
• Completeness Review
• Additional Submittals if determined to be incomplete
• Setting a date for the Director’s Decision, or if the applicant requires above-ground
utilities installation, a hearing with the BOCC will be required.
• Referrals are sent out to reviewing agencies including the Colorado Geological Survey
• Public Notice to Property Owners within 200 ft. and mineral rights owners on the subject
property
• Director’s Decision or BOCC Hearing

Waivers for Roads and Demonstration of Compliance
March 3, 2014
Section 7-107, Access and Roadways, of the Garfield County Land Use and Development Code (LUDC) requires all
roads to be designed to provide for “adequate and safe access” and reviewed by the designated County Engineer. The
LUDC defines “road” as “a County road, State highway, public road, street or alley, or private thoroughfare which affords
primary access to abutting property, excluding a driveway accessing a single property.”
The LUDC defines “private road” as “a right-of-way constructed, established, owned, and maintained by a private party
for access exclusively to private property.” Many of the roads in Garfield County are private roads in that they are gated
and do not serve the general public and they pre -existed the design currently required by the County’s Road Standards as
defined in Table 7-107.
The LUDC allows for the waiver of specific standards provided that the following criteria have been me t: 1) an
alternative design achieves the intent of the subject standard to the same or better degree and 2) the proposed alternative
will impose no greater impacts on adjacent properties than would occur through compliance with the specific standard
(Section 4-118).
In applications that include roads that do not meet current County road standards as outlined in Table 7 -107, the County
has asked that Applicants request a waiver of Section 7-107.F, Design Standards, and include in the Application submittal
sufficient information, prepared by a professional qualified in the specific discipline, to demonstrate that they meet the
criteria outlined in Section 4-118 for granting a waiver. In doing so, the application must include:
A Statement of Adequacy - The evaluation of the existing roadway and waiver will need to include a clear statement that
finds that the road will be adequate for the proposed use. This statement must be signed by a professional engineer
qualified in traffic engineering and licensed by the State of Colorado. To support this evaluation, the following
information will be required to be provided:
o Geometry of the road – A description of how the private road does/does not meet the design standards
in Table 7-107. This should include a chart that compares the private road design to those standards in
Table 7-107, as well as a map that shows the existing road design and highlights those areas that deviate
from the standards. A narrative may also be helpful in describing the characteristics of the road as they
compare to Table 7-107 design standards. Unless available, this is not intended to imply construction -
level drawings.
o Safety/Structural Issues – A description of obvious safety and/or structural issues observed and a
statement about how these issues will be addressed.
o Maintenance – A description of how the road is and/or will be maintained. This should be supported
with the submittal of any existing or proposed maintenance agreements for the road sections.
o Travel Demand – An accurate count of the existing peak travel demand as well as the Average Daily
Traffic on the road. This should also include the types of vehicles that currently use the road as well as
the additional amount and type of traffic that the proposed use will generate th rough all phases of its
development.
Other Evidence of Compliance. In addition, Sections 7-107.A, B, C, D, and E are required to be addressed, which
includes documentation about legal access. Sufficient evidence will be required to be submitted to demon strate
compliance with these sections of the Code.

Mineral interests may be severed from surface right interests in real property. C.R.S. § 24-6S .S-101, et seq,
requires notification to mineral owners when a landowner applies for an application for development from a

The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4 -10l{E)(l)(b)(4) requires

CGS LAND USE REVIEWS
Geological studies are required by Colorado counties for all subdivisions of unincorpo-
rated land into parce ls of less than 35 acres, under State s tatute C.R.S. 30-28-136 (1) (i)
(Senate Bill 35, 1972). Some Colorado municipalities require geological studies for sub-
division of incorporated land. In addition, local governments are empower ed to regu-
late development activities in hazardous or mineral-resource areas under C.R.S. 24-65.1-
101 et seq. (House Bill 1041, 1974) and C.R.S. 34-1-301 e t seq. (House Bill 1529, 1973),
respectively.
Local-government agencies s ubmit proposed s ubdiv ision applications and supporting
technical r e ports to the Colorado Geol ogical Survey " ... for evaluation of those geologic
factor s which would have significant impact on the proposed use of the land," in accor-
dance with Stat e s tatutes . The CGS reviews the submitted documents and serves as a
technical advisor to local-governme nt planning agencies during the planning process.
Since 1984, the CGS has been required by law to r ecover the full direct cost of perform-
ing such reviews.
The adequat e knowledge of a site's geology is essential for any development project. It

CBO Inc. has visited the property and evaluated onsite wastewater treatment system (OWTS)
alternatives for the proposed development. A Minor Subdivision is proposed for the 6.099-acre property
located outside of Silt.
Legal Description: Section: 5 Township: 6 Range: 92 TR IN THE SWSW
Parcel ID: 2179-053-00-002
EXISTING CONDITIONS The southern portion of the property is currently developed with a residence and several out-buildings.
The residence is served by an existing OWTS. Garfield County Individual Sewage Disposal System
Permit 3300 documents this system.
A subdivision of the property is proposed. Lot 1 to the north will consist of 3.725-acres and is currently
undeveloped. Lot 2 to the south will consist of 2.372-acres and the existing development is on this
portion of the property.
If the subdivision is approved, development on Lot 1 will include a Shop with a 2-bedroom residence and
will be served by the proposed OWTS.
A proposed well on Lot 1 will serve the new Shop. This well will be located approximately 327-feet to the
southwest of the proposed Shop. The well will be located at least 50-feet from the proposed septic tank
and at least 100-feet from the proposed soil treatment area (STA).
A dry gulch, labeled “water channel” bisects Lot 1. The proposed OWTS must be located at least 25-feet
from the dry gulch.
The soil treatment area (STA) is proposed near the proposed Shop. The area surrounding the proposed
Shop slopes to the southwest.

SUBSURFACE
The subsurface was investigated on December 11, 2020 by examining a significant cut between proposed
Lots 1 & 2. A visual and tactile soil analysis was completed by Carla Ostberg.1
The materials observed in the cut bank consisted of light brown silt loam. The cut extends greater than 10-
feet below the elevation of the proposed Shop. No bedrock or groundwater was observed.
A sample of the soil was taken from the cut bank. Soil structure grade moderate. The soil formed a ball
and a ribbon less than 1-inch in length before breaking. Soil structure shape was loose to blocky and
consistence was friable. Soil texture was more smooth than gritty.
STA sizing is based on Soil Type 2, Silt Loam with moderate structure grade. A long term acceptance
rate (LTAR) of 0.6 gallons per square foot will be used to design the OWTS.
Additional test pits will be required in the area of the proposed STA prior to design of the OWTS.

PRELMINARY OWTS DESIGN
A 2-bedroom residence and shop are proposed.
Design Calculations:
2 bedrooms x 75 GPD/person x 2 ppl/bedroom = 300 GPD
300 GPD / 0.6 gal/SF = 500 SF
500 SF x 1.2 (gravity, bed) x 0.7 (chambers) = 420 SF
We are unsure if there will be sufficient area for trenches considering the setback to the dry gulch. Site
and topography may be better suited for a bed configuration; however, we will further consider options at
the time of design.
For purposes of planning, 1000-gallon, two-compartment septic tank with an effluent filer is proposed
followed by a STA consisting of 4 rows of 9 ‘Quick 4’ Infiltrator® chambers is proposed.
Other design alternatives and technologies may be considered.
