COUNTY OF GARFIELD At a regular meeting of the Planning Commission for Garfield County, Colorado, held in the Commissioners' Meeting Room at the Garfield Counfy PlazaBuilding, 108 8th Street, in Glenwood Springs, Colorado, on Wednesday, the 25th day of July, 2018, there were present: when the following proceedings, among others were had and done, to wit RESOLUTION NO. PC-20T8-02 A RESOLUTION CONCERNED WITH A LOCATION AND EXTENT APPLICATION FOR THE TOWN OF CARBONDALE RED HILL ACCESS TRAIL SYSTEM (FrLE NO. LAEA-O7-1 8-86s9) Recitals A. Garfield County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners is authorized to act. B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed the Garfield County Planning Commission (the Commission). C. The Town of Carbondale (the Applicant) applied to the Planning Commission pursuant to File No. LAEA-07-18-8659 for a Location and Extent Review for a proposed Red Hill Access Trail System, a public Mountain Bike and Pedestrian Trail System and related improvements, further described in Exhibit A, Legal Description and Site Plan. D. The proposed Red Hill Access Trail System is planned to allow passive use of the property including biking and hiking trails, and related trailheads. It is located adjacent to the Town of Carbondale on the north side of the Highway 82 and Highway 133 intersection, adjacent to County Road 107. It is located on a portion of a parcel approximately 25.94 acres in size. The property is more fully described on the attached Exhibit "A",Legal Description and Site Plan. E. Pursuant to Section 4-IIl (C) of the Garfield County Land Use and Development Code, as amended, and C.R.S. $ 30-23-110(1)(a) the Commission is required to review the location and extent of the proposed public park or other public way to determine whether the proposed public facility and improvements are in general conformance with the County's Comprehensive Plan of 2030, as amended (the Comprehensive Plan) and its Master Plan. F. In accordance with state law, the Planning Commission has adopted a Master Plan. The Master Plan applicable to this Petition is the Comprehensive Plan. G. The Commission opened a public hearing on July 25, 2018 upon the question of whether the proposal is in general conformance with the Comprehensive Plan. H. The Commission closed the public hearing on July 25,2018 to make a decision on the request. I. The Commission, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard atthat hearing. 3. That for the above stated and other reasons, approval of the Location & Extent request by the Red Hill Access Trail System is in the best interest of the health, safety, and welfare of the citizens of Garfield County. 4. That the Location and Extent request has been determined to be in general conformance with the Comprehensive Plan 2030, as amended. 5. That the Location and Extent request is in conformance with the Review Criteria contained in Section 4-lll, Location and Extent of the Garfield County Land Use and Development Code, as amended. 6. The determination of General Conformance is based on the Applicant's representations in their Application submittals and at the public hearing before the Planning Commission. The foregoing Recitals are incorporated by this reference as part of the resolution. B. Exhibit "A" describes the location of the proposed public facility. C. The Location and Extent request for the public Mountain Bike and Pedestrian Trails System and related improvements known as the Red Hill Access Trail System, is hereby approved subject to the following conditions of approval: 1. That all representations made by the Applicant in the Application shall be conditions of approval unless specifically altered by the conditions of approval contained herein. That the Facility shall be operated in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. That the Applicant shall continue to coordinate with the County Road and Bridge Department and obtain any required permits or approvals for future infrastructure or access improvements. That the Applicant shall continue to coordinate with the BLM and CPV/ regarding any wildlife concerns including potential winter closures of trails to mitigate impacts on wildlife winter range and low impact trail construction practices. That the Applicant shall coordinate with the County Vegetation Manager on any weed control and management issues.
