The property hosts two existing houses, one approved as an ADU in 2006, the other built in 2009. The two houses are served by a shared well with a more than adequate water storage system and each has its own OWTS. I have been in touch with Dwight Whitehead at the Division of Water Resources and Janet at West Divide Water Conservatory and it is agreed that the current well permits provide for the proposed property split. The well permit and water contracts are included in this submittal. This parcel does conform to the dimensional requirements in Section 7-107 of the LUDC per the attached engineer’s assessment from Deric Walters. The plat with necessary Certificates and info as described in Section 5-402 F is attached for signature. The names of all adjacent surface and mineral owners are included. A title commitment for the subject property is also included and ensures that all easements and encumbrances identified in the commitment are accurately shown on the plat. Some Colorado municipalities require geological studies for sub- division of incorporated land. In addition, local governments are empowered to regu- late development activities in hazardous or mineral-resource areas under C.R.S. 24-65.1- 101 et seq. (House Bill 1041, 1974) and C.R.S. 34-1-301 et seq. (House Bill 1529, 1973), respectively. Local-government agencies submit proposed subdivision applications and supporting technical reports to the Colorado Geological Survey " ... for evaluation of those geologic factors which would have significant impact on the proposed use of the land," in accor- dance with State statutes. The CGS reviews the submitted documents and serves as a technical advisor to local-government planning agencies during the planning process. Since 1984, the CGS has been required by law to recover the full direct cost of perform- ing such reviews. The adequate knowledge of a site's geology is essential for any development project. It is needed at the start of the project in order to plan, design, and construct a safe devel- opment. GENERAL PROJECT DESCRIPTION February 12, 2021 Update: The applicant met with Staff to update the pre-application conference summary. No updates to the Land Use and Development Code that would affect the Subdivision application were noted. The applicant is proposing a minor subdivision to split the 5.35 acre property into two lots. The site is zoned Rural. The applicant should note that the minimum lot size in the Rural zone district is 2-acres. The property is currently improved with an existing single -family residence and accessory dwelling unit, which are both served by a shared well and OWTS (on-site wastewater treatment system). The applicant is proposing to serve the new lot with a shared well and separate OWTS. The Subdivision requires a demonstration of legal and adequate water for both of the proposed parcels, Staff encourages the applicant to discuss the subdivision with the Division of Water Resources (DWR) (Contact Dwight Whitehead at the DWR at 970 -945-5665 ext. 5011) prior to submitting an application for subdivision with the County. In addition, a water quality test and well production test will need to be conducted prior to application submittal in accordance with Section 4-203(M)(1)(b)(5). The applicant may request that water quality and quantity tests be conducted as conditions of approval. All conditions of approval must be completed within 90 days of approval. The subdivision cannot be finalized until all necessary conditions of approval are satisfied. Both the existing parcel and the proposed new parcel have existing access. The primary home is accessed by a driveway off of County Road 233, while the proposed new parcel and ADU has existing access directly off of County Road 233. The Applicant will need to demonstrate evidence of existing legal access through an easement on adjacent properties or a driveway access from County Road 233. All driveways and access roads need to conform to the dimensional requirements in Section 7 -107 of the LUDC. The applicant will need to create a plat for the subdivision. The applicant’s Surveyors should insert Certificates as prescribed by the County for the necessary signatures. The plat will need to include all information as described in Section 5 -402(F), including the name and addresses of the surface owners and mineral estate. The applicant will also need to submit a title commitment for the subject property and ensure that the plat states that all easements and encumbrances identified in the commitment are accurately shown on the plat. Proof of ownership is required to process the application. The property owner, per County assessor records, will need to sign the application or provide a letter of authorization for anyone else who will be working on the Application. II. SUBMITTAL REQUIREMENTS As a convenience, a summary of the submittal requirements for a Minor Subdivision Application is outlined below. These items are fully described as referenced in Table 5 -401 of the Land Use and Development Code. The Application shall demonstrate that it meets the Review Criteria requi rements set forth in Section 5-301 (section attached). Names and mailing addresses of property owners within 200 ft. of the subject property. Vicinity Map. The Proposed Minor Subdivision Plat showing the proposed lot lines, all easements and required certificates. Final Plat will need to meet the standards in Section 5-402(F) and all required certificates. Site Plan and related information (some may be shown on the proposed plat) including topography, existing improvements, infrastructure, irrigation ditches, and significant features. The site plan should include information on location of improvements on the property adequate to confirm that no nonconforming conditions will result from the proposed subdivision. Water Supply Plan needs to include details on legal water (well permit and/or draft contracts with Water Conservation District), well production tests and water quality tests. A waiver may be requested to complete the water production and quality tests as a condition of approval (completed upon approval). Demonstration from a qualified professional that both of the existing OWTS are functioning and are adequate to serve the properties. A waiver request from submittal of an Improvements Agreement , with reference to section 4-202.C of the LUDC. Copies of any covenants affecting the property need to be provided, if applicable. Information as applicable to demonstrate compliance with provisions of Article 7 Standards. The Application should include representation or statement that the subdivision will comply with all applicable Article 7 topics. Provide a demonstration from a qualified professional that the existing access meets Roadway requirements as detailed in Article 7-107 of the Land Use Code. Form and payment for the Colorado Geological Survey (CGS) review. The payment check for this referral should be made out to the Colorado Geological Survey (form attached). Zone District Use Regulations: The proposed application complies with the current zoning, Rural. 7-102. Comprehensive Plan and Intergovernmental Agreements: The property is not located in either the Town of Silt or City of Rifle growth boundaries. The proposed application is in general conformance with the Garfield County Comprehensive Plan land use designation Residential Medium High (RMH). No known intergovernmental agreements are affected. 7-103. March 12, 2021 Grading & Drainage Plan The Drainage Plan is provided in accordance with Article IV Section 4 -203.E of the Garfield County Unified Land Use and Development Code and follows the outline provided therein. E1. Site Map: The purpose of this document is to provide a basic engineered analysis for grading and drainage on the proposed Collins Subdivision in Garfield County, Colorado. The 5.35 Ac. property is owned by Betty J Collins and was previously developed with single-family home and an ADU. The property is currently accessed from County Road #233. The Applicant proposes to subdivide the property into two lots, one for the single-family home and one for the ADU. The Colorado River flows east to west approximately 1.1 miles south of the property. The property does not contain any wa terbodies, hydrologic features, intermittent water features or wetlands that might be adversely impacted by the proposed division of land. According to the Garfield County FEMA Floodplain Mapping database, the site was located and does not fall in the Colorado River Floodplain. Please see the attached Site Plan (Sheet C.1) for existing conditions and the proposed lot configuration. E2. Drainage Structures: Existing drainage structures include roadside ditches and site swales. Since the property is already developed, no additional storm water facilities are necessary for the proposed division of land. The shared gravel access drive along the east property boundary may need to be widened from 10’ to 12’ (barring an approved Variance Request), but the minor amount of additional runoff can be infiltrated and/or filtered by the adjacent agricultural fields and grasses. E3. Topography: In general, The site slopes from northwest to southeast at 4%-8%. 2-foot contours are represented on Sheet C.1. E4. Grading Plan: As discussed, the property is already developed and the shared gravel driveway along the east property boundary will need to be widened unless a variance is granted. Soil Stockpile and Snow Storage Area: As discussed, the property is already developed and no significant subdivision improvements are proposed with this division of land which would require soil stockpiles. By execution of this Contract and the attached Application, Applicant hereby agrees to the following terms and conditions: Water Rights: Applicant shall own water rights at the point of diversion herein lawfully entitling Applicant to divert water, which will be supplemented and augmented by water leased herein. If Applicant intends to divert through a well, it must be understood by Applicant that no right to divert exists until a valid well permit is obtained from the Colorado Division of Water Resources. 2. Quantity: Water applied for by the Applicant in the amount set forth above sh~II be diverted at Applicant's point of diversion from the District's direct flow water rights, and when water is unavailable for diversion pursuant to administration by the Colorado State )Engineer during periods when said direct flow water right is not in priority, the District shall release for the use of Applicant up to said quantity in acre feet per year of storage water owned or controlled by the District. It is understood that any quantity allotted from direct flow, storage or otherwise, to the Applicant by the District will be limited by the priority of the District's decrees and by the physical and legal availability of water from District's sources. Any quantity allotted will only be provided so long as water is available and the Applicant fully complies with all of the terms and conditions of this Contract. The District and the Applicant recognize that some of the District's decrees may be in the name of the Colorado River Water Conservation District, and the ability of the District to allot direct flow right to the Applicant may be dependent on the consent of the Colorado River Water Conservation District. If at any time the Applicant determines it requires less water than the amount herein provided, Applicant may so notify the District in writing, and the amount of water allotted under this Contract shall be reduced permanently in accordance with such notice. Rates shall be adjusted accordingly in following water years only. 3. Beneficial Use and Location of Beneficial Use: Any and all water allotted Applicant by the District shall be used for the following beneficial use or uses: industrial, municipal, domestic and related uses, or commercial (except for commercial use from Alsbury Reservoir and except to the extent that Ruedi Reservoir water may not be available for commercial as that term is defined on Page 5 of Contract No. 2-07-70-WO547 between the United States and the West Divide Water Conservancy District). Applicant's beneficial use of any and all water allotted shall be within or through facilities or upon land owned, leased, operated, or under Applicant's control. 4. Decrees and Delivery: Exchange releases made by the District out of storage from Ruedi Reservoir, Green Mountain Reservoir, Alsbury Reservoir, or other works or facilities of the District, or from other sources available to the District, shall be delivered to the ) Applicant atthe outlet works of said storage facilities or at the decreed point of diversion for said other sources, and release or delivery of water at 1 such outlet or points shall constitute performance of the District's total obligation. Delivery of water by the District from Ruedi Reservoir or Green Mountain Reservoir shall be subject to the District's lease contracts with the United States Bureau of Reclamation. Releases from other facilities available to District shall be subject to the contracts, laws, rules, and regulations governing releases therefrom. Furthermore, the District hereby expressly reserves the right to store water and to make exchange releases from structures that may be built or controlled by the District in the future, so long as the water service to the Applicant pursuant to this agreement, is not impaired by said action. Any quantity of the Applicant's allocation not delivered to or used by Applicant by the end of each water year (October 1 ), shall revert to the water supplies of the District. Such reversion shall not entitle Applicant to any refund of payment made for such water. Water service provided by the District shall be limited to the amount of water available in priority at the original point of diversion of the District's applicable water right, and neither the District, nor those entitled to utilize the District's decrees, may call on any greater amount at new or alternate points of diversion. The District shall request the Colorado Division of Water Resources to estimate any conveyance losses between the original point and any alternate point, and such estimate shall be deducted from this amount in each case. Water service provided by the District for properties located within the Bluestone and Silt Water Conservancy Districts is provided pursuant to Agreements with said Districts. The Intergovernmental Agreement between the District and the Silt Water Conservancy District, dated January 25, 2001, is recorded as Reception No. 575691, Garfield County Clerk and Recorder's Office. The Intergovernmental Memorandum of Understanding between the District and the Bluestone Water Conservancy District, dated April 26, 2001, is recorded as Reception No. 584840, Garfield County Clerk and Recorder's Office. 5. Alternate Point of Diversion and Plan of Au gmentation : Decrees for alternate points of diversion of the District's water rights or storage water may be required in order for Applicant to use the water service contemplated hereunder. Obtaining such decree is the fXclusive responsibility of Applicant. The District reserves the right to review and approve any conditions which may be attached to judicial approval of said alternate point of diversion as contemplated or necessary to serve Applicant's facilities or lands. Applicant acknowledges and agrees that it shall be solely responsible for the procedures and legal engineering costs necessary for any changes in water rights contemplated herein, and further agrees to indemnify the District from any costs or losses related thereto. Applicant is solely responsible for providing works and facilities necessary to obtain/divert the waters at said alternate point of diversion and deliver them to Applicant's intended beneficial use. Irrespective of the amount of water actually transferred to the Applicant's point of diversion, the Applicant shall make annual payments to the District based upon the amount of water allotted under this Contract. In the event the Applicant intends to apply for an alternate point of diversion and to develop an augmentation plan and institute legal proceedings for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates its own augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to pay any amount under Paragraph 19 below. In any event, the District shall have the right to approve or disapprove the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the water court in the adjudication thereof. 6. Contract Paym ent: Non-refundable, one time administrative charge, in the amount determined by the Board of Directors of the District from time to time, shall be submitted with the application for consideration by the District. 2 Annual payment for the water service described herein shall be determined by the Board of Directors of the District. The initial annual payment shall be made in full, within thirty (30) days after the date of notice to the Applicant that the initial payment is due. Said notice will advise the Applicant, among other things, of the water delivery year to which the initial payment shall apply and the price which is applicable to that year. Annual payments for each year thereafter shall be due and payable by the Applicant on or before each January 1. If an annual payment is not made by the due date a flat $50 late fee will be assessed. Final written notice prior to cancellation will be sent certified mail, return receipt requested, to the Applicant at such address as may be designated by the Applicant in writing or set forth in this Contract or Application. Water use for any part of a water year shall require payment for the entire water year. Nothing herein shall be construed so as to prevent the District from adjusting the annual rate in its sole discretion for future years only. If payment is not made within fifteen (15) days after the date of said written notice, Applicant shall at District's sole option have no further right, title or interest under this Contract without further notice, and delivery may be immediately curtailed. The allotment of water, as herein made, may be transferred, leased, or otherwise disposed ofat the discretion of the Board of Directors of the District. Upon cancellation of this water allotment Contract with the District, the District shall notify the Division of Water Resources offices in Denver and Glenwood Springs. The Division of Water Resources may then order cessation of all water use. 7. Addi tio na l Fees a nd Costs : Applicant agrees to defray any expenses incurred by the District in connection with the allotment of water rights hereunder, including, but not limited to, reimbursement oflegal and engineering costs incurred in connection with any water rights and adjudication necessary to allow Applicant's use of such allotted water rights. 8. Ass ignm e nt: This Contract shall not inure to the benefit of the heirs, successors or assigns of Applicant, without the prior written consent of the District's Board of Directors. Any assignment of Applicant's rights under this Contract shall be subject to, and must comply with, such requirements as the District may hereafter adopt regarding assignment of Contract rights and the assumption of Contract obligations by assignees and successors. Nothing herein shall prevent successors to a portion of Applicant's property from applying to the District for individual and separate allotment Contracts. No assignment shall be recognized by the District except upon completion and filing of proper forms for assignment and change of ownership. In the event the water allotted pursuant to this Contract is to be used for the benefit ofland which is now or will subsequently be subdivided or held in separate ownership, the Applicant may only assign the Applicant's rights hereunder to: 1) No more than three separate owners all of whom shall be party to a well sharing agreement satisfactory to the District; or 2) A homeowners association, water district, water and sanitation district or other special district properly organized and existing under the laws of the State of Colorado, and then, only if such parties, association or special district establishes to the satisfaction of the District that it has the ability and authority to perform the Applicant's obligations under this Contract. In no event shall the owner of a portion, but less than all, of the Applicant's property to be served under this Contract have any rights hereunder, except as such rights may exist pursuant to a well sharing agreement or through a homeowners association or special district as provided above. Upon the sale of the real property to which this Contract pertains, Applicant shall make buyer aware of this Contract and proper forms for assignment and change of ownership must be completed. 3 9. Other Rule s: Applicant shall be bound by the provisions of the Water Conservancy Act of Colorado; by the rules and regulations of the Board of Directors of the District; and all amendments thereof and supplements thereto and by all other applicable law. I 0. Operation and Maintenance Agreement: Applicant shall enter into an "Operation and Maintenance Agreement" with the District under terms and conditions determined by the board of Directors of the District, if and when, the Board of said District determines in its sole discretion that such an agreement is required. Said agreement may contain, but shall not be limited to, provisions for additional annual monetary consideration for extension of District delivery services and for additional administration, operation, and maintenance costs; or for other costs to the District which may arise through services made available to the Applicant. 11. Change of Use: The District reserves the exclusive right to review, reap prove or disapprove any proposed change in use of the water allotted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted hereunder without the prior written approval of the District shall be deemed to be a material breach of this Contract. 12. se and Place of Use: Applicant agrees to use the water in the manner and on the property described in the documents submitted to the District at the time this Contract is executed, or in any operation and maintenance agreement provided by Applicant. Any use other than as set forth thereon or any lease or sale of the water or water rights herein, other than as permitted in paragraph 8 above, shall be deemed to be a material breach of this agreement. 13. Title: It is understood and agreed that nothing herein shall be interpreted to give the Applicant any equitable or legal fee title interest in or to any water or water rights referred to herein. 14. onservation: Applicant shall use commonly accepted conservation practices with respect to the water and water rights herein, and hereby agrees to be bound by any conservation plan adopted hereafter by the District for use of District owned or controlled water or water rights. 15. Restrictions: Applicant shall restrict actual diversions to not exceed the contract amount, which provides water ( on the formula of one acre foot per dwelling) for ordinary household purposes inside one single family dwelling, the watering of domestic livestock, fire protection, and the irrigation of lawn and garden as specified in the Application. Applicant shall also comply with all restrictions and limitations set forth in the well permit obtained from the Colorado Division of Water Resources. Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial purposes unless Applicant obtains approval from the Colorado Division of Water Resources for commercial use/livestock watering, provided that in no event shall actual diversions exceed the amount of water provided by this Contract. Violation of this paragraph 15 shall be deemed to be a material breach of this Contract. 16. Well Permit: If Applicant intends to divert through a well, then Applicant must provide to District a copy of Applicant's valid well permit before District is obligated to deliver any water hereunder. 4 17. Measuring Device or Meler: Applicant agrees to provide, at its own expense, a measuring device deemed acceptable by the District's Engineer after consultation, or a totalizing flow meter with remote readout to continuously and accurately measure at all times all water diverted pursuant to the tenns of Applicant's waterright and the terms of this Contract. Applicant agrees to provide accurate readings from such device or meter to District upon District's request. Applicant acknowledges that failure to comply with this paragraph could result in legal action to terminate Applicant's diversion of water by the State of Colorado Division of Water Resources. By signing this Contract, Applicant hereby specifically allows District, through its authorized agent, to enter upon Applicant's property during ordinary business hours for the purposes of determining Applicant's actual use of water. 18. Representations: By executing this Contract, Applicant agrees that it is not relying on any legal or engineering advice that Applicant may believe has been received from the District. Applicant further acknowledges that it has obtained all necessary legal and engineering advice from Applicant's own sources other than the District. Applicant further acknowledges that the District makes no guarantees, warranties, or assurances whatsoever about the quantity or quality of water available pursuant to this Contract. Should the District be unable to provide the water contracted for herein, no damages may be assessed against the District, nor may Applicant obtain a refund from the District. 19. Costs of Water Court Filing and Augmentation Plan: Should the District, in its own discretion, choose to include Applicant's Contract herein in a water court filing for alternate point of diversion or plan of augmentation, then Applicant hereby agrees to pay to the District, when assessed, an additional fee representing the District's actual and reasonable costs and fees for Applicant's share of the proceedings. Applicant shall be assessed a pro-rata share of the total cost incurred by the District in preparing, filing and pursuing to decree the water court case. The pro-rata share shall be calculated by dividing such total cost by the number of contractees included in the filing. To the extent that the District is caused additional costs because of objection filed specifically due to the inclusion of Applicant's Contract in the filing, such additional costs may be charged specifically to Applicant and not shared on a pro-rata basis by all contractees. 20. 8 inding Agreement: This agreement shall not be complete nor binding upon the District unless attached hereto is the fonn entitled "Application to Lease Water From West Divide Water Conservancy District" fully completed by Applicant and approved by the District's engineer. The legal description of the 1.05-acre property is as follows: Subdivision: Section: 5 Township: 6 Range: 92 TR IN LOTS 3 & 4 Parcel ID: 2179-052-00-359 ALL SERVICE septic, LLC designed this system, and the installation observations are documented in a letter dated December 28, 2016. The OWTS is documented by Garfield County Permit SEPT-10-16- 4468. The system consists of a 1250-gallon, two-compartment Precast Concepts® concrete septic tank with an Orenco® ProPak pumping system and PF5005 pump in the second compartment. Effluent is pressure dosed through a 1.5-inch diameter pump line from the septic tank to an Orenco® model 6402 automatic distributing valve (ADV), which was installed at the high point in an insulated riser, and accessible is from grade. The STA consists of two beds, each with 4 rows of 8 ‘ARC ADS’ chambers, for a total of 64 chambers and 960 square feet of infiltrative area. The chambers were installed at native grade in order to maintain the required 4-foot separation to high seasonal groundwater. Sand filter material was added to level the bed, where needed. Chamber rows in each bed are connected with level, 1.5-inch diameter manifolds. In May 2020 we were notified of some saturation issues in the eastern bed. Along with Altitude Septic, we did trouble-shooting to assure there were no broken pipes or issues with cycling of the ADV. We took the eastern bed off-line temporarily in hopes to alleviate saturation. After a month of only the western bed being on-line, we checked and saturation in the eastern bed remained. The western bed remained dry, despite being the only portion of the STA on-line. We believe the saturation was the result of upgradient drainage from irrigation and/or ditches. We recommended installation of an interceptor trench drain to divert up-gradient drainage around the STA. While an interceptor trench was recommended to mitigate the issues, changes to upgradient irrigation practices, including an irrigation ditch to the north being placed in a culvert, there have been no saturation issues since the changes. Both mounded STA beds have been online since Fall 2020. Photos below were taken July 22, 2021 with intermittent monitoring of the mounded STA through the spring and early summer 2021 with no saturation observed. This evaluation is not a guarantee of future system performance. Disclaimer: This inspection is intended only as an evaluation of the present condition of the OWTS based upon what was observed and the Licensed Inspector’s expertise in onsite wastewater technology. The Inspector has not been retained to warrant or guarantee the proper functioning of the system for any period of time in the future. Because of numerous factors which may affect the operation of an OWTS, as well as the inability of the Inspector to supervise or monitor the use or maintenance of this OWTS, this report shall not be construed as a warranty by the Inspector that the system will function properly for any particular prospective buyer, and the Inspector disclaims any warranty, either expressed or implied, arising from the inspection of the OWTS or this report. Reports Page 12 OWTS MAINTENANCE AND MANAGEMENT PLAN Fix It To o Subdi v is ion Garfield County, Colorado October 9, 2020 The Subswface Investigation and Onsite Wastewater Treatment System Design, prepared by All Service Septic dated April 18, 2016, for 5352 County Road #233, Garfield County, Colorado, indicated that the soil conditions of the property consist of dark brown, moist silty clay loam to a maximum depth explored of 4.5-feet. No bedrock or groundwater was encountered, although the moisture content in the soil increased with depth. No mottling of the soils was observed. A tactile analysis of the soils was taken from the Test Pit at approximately 1-foot below grade. The soil formed a ball and a ribbon 1 to 2-inches in length before breaking. Soil structure shape was blocky, soil structure grade was moderate, and consistence was firm. The texture of the soil was very smooth. Any new Onsite Wastewater Treatment System (OWTS) installed within the Subdivision shall comply with current Garfield County OWTS Regulations and the following additional requirements: A. each system shall be designed by a professional engineer registered in the State of Colorado pursuant to Colo. Rev. Stat. §12-25-111 (1999); B. each system design shall adequately address the soil conditions present at the Lot site, which shall be verified through appropriate on-site testing by a professional engineer; C. each system shall be designed to adequately service the anticipated wastewater demand; D. the tops of all tanks or risers extending there-from shall be surface accessible to facilitate system maintenance, monitoring and inspections; E. absorption fields or trenches shall adhere to minimum setbacks as regulated by the Colorado Department of Health, Regulation No. 43 On-Site Wastewater Treatment System Regulation, most recent edition, or as established by Garfield County; F. proper mitigation (diversion) of drainage and flood irrigation for the absorption field or trench areas shall be included in the design and construction; G. each system shall be designed with sufficient area specifically allocated for a reserve leach field to ensure that a future replacement is possible. The reserve leach field shall meet the same design criteria as the primary field and shall not be constructed over with driveways, buildings or other permanent structures; and H. septic tanks shall be fitted with an effluent filter. Following OWTS installation, each Lot Owner shall provide the Association (if one exists) and the Garfield County Community Development Department with as-built drawings in relation to the other improvements on the Lot, to scale, depicting the location and dimensions of the OWTS Page 11 of 3 facilities including the absorption field and monitoring pipes, all applicable design, operation and maintenance specifications of the system's manufacturer and written certification from the design engineer that the OWTS was installed in conformance with the requirements above stated and all applicable design specifications of the manufacturer. In the event no Association exists or that the Association fails to properly implement and enforce the design and performance standards set forth in this paragraph, the Board of County Commissioners for Garfield County, Colorado and its duly authorized representatives and agents, shall have all the right to enter upon the property and implement and enforce such standards at the expense of the affected Lot Owner or exercise any other right or power afforded under this Restatement including, but not limited to, the initiation of appropriate proceedings in the District Court for Garfield County, Colorado, to compel enforcement of the same. The provisions of this paragraph shall not be amended or repealed by the Homeowners Association or Lot Owners without the written consent of the Board of County Commissioners for Garfield County, Colorado. In order to ensure that each OWTS installed within the Subdivision is inspected on a regular basis and properly maintained, the responsibility and authority for such inspection and maintenance shall be vested exclusively within the Association. This management plan is not intended to provide for common ownership of the OWTS(s) or to provide common funding for the construction, repair or replacement thereof. Such ownership and responsibility for construction, repair and maintenance shall remain with the Lot Owner. A In accordance with the above, the Association and Lot Owner shall : 1. retain at all times, the services of qualified personnel to inspect the OWTS(s) and to perform all maintenance and repairs necessary to ensure that same are installed properly, remain in good operating condition and comply with the performance requirements set forth within; 2. inspect the operating components of each OWTS within (30) days of being placed into operation; thereafter, each OWTS shall be inspected every year and the septic tank pumped at the time that the solids (settled and floating) accumulate to a level of 20 percent of the effective capacity of the tank; and 3. maintain at all times written or other permanent records documenting the date each OWTS was inspected or tested, the results of such inspections or tests and the extent of all maintenance and/or repairs performed. All documents maintained by the Association and Lot Owner pursuant to this provision shall at all times be available for inspection by other lot owners and/or authorized representatives of Garfield County. B. The following provisions shall apply in the event the estimated maintenance or repair costs required of any OWTS exceed $1000.00 in total during any one calendar year: 1. the Association shall give the Lot Owner and the Garfield County Community Development Department written notice of the nature and extent of the work necessary, to return the OWTS to good operating condition and/or bring the OWTS System within the performance requirements set forth within; Page 12 of 3 2. within (10) days of receipt of such notice, the Lot Owner shall at his or her own expense submit an application for an OWTS Permit to Garfield County to repair or replace the OWTS; 3. within (30) days of receipt of such Permit, the Lot Owner shall at his or her own expense, cause to be completed, the repairs set forth within the notice. In the event the Lot Owner fails to complete such repairs within this the period to the satisfaction of the Association, the Association shall have the authority, in addition to any other remedy provided within this Restatement, to take any of the following actions: a. to impose against the Lot Owner, a fine not to exceed $200.00 for each day in which the OWTS System remains unrepaired; b. to complete on behalf of the Lot Owner the required repairs to the OWTS. All costs included by the Association in connection with the restoration shall be reimbursed to the Association by the Lot Owner of the Lot, upon demand. All un- reimbursed costs shall be a lien upon the Lot until reimbursement is made which may be enforced in accordance with the provisions of this Restatement; and/or C. The property is located in Garfield County, in an area where OWS are necessary. SITE CONDITIONS There is an existing residence and a storage barn on the subject site. A 5-bedroom single-family residence with a garage is proposed. The property slopes approximately 5% to the southeast. SUBSURFACE The subsurface was investigated by HP Geo-tech by excavating one Profile Pit and three percolation holes as indicated on Figure 1. HP Geo-tech indicated the test has a 6-inch topsoil layer, underlain by sandy, silty clay to the maximum depth explored of 8 feet. Groundwater was encountered at 5.5 feet. Percolation rates ranged from 15 to 180 minutes per inch (MPI). A 72 MPI rate will be used to design theOWS. DESIGN SPECIFICATIONS The OWS design is based on 5-bedrooms and an average sewage load of 750 GPD. The installation must include a 1500-gallon, two-compartment, precast concrete septic tank, with the addition of an effluent filter in the second compartment. Tank alternatives may be considered. Five gravelless chamber trenches must be installed as indicated on plans provided. Four of the trenches must have 20 'Quick-4' chambers and one row must has 18 'Quick-4' chambers, for a total of 98 chambers, equaling 968 square feet (SF) of infiltrative area. A distribution box should be used to distribute effluent. The trenches must be installed at a maximum depth of 1.5 feet beneath existing grade. Partial mounding will be necessary to maintain 1-foot of soil cover on chambers. If this depth cannot be achieYed a pump may be necessary to direct effluent to trenches. OPERATION INFORMATION AND MAINTENANCE The surface of the drain field should be seeded upon completion. Vegetation is an important factor in drain field performance. Erosion control should be practiced during and prior to re-vegetation. Geo- fabrics or plastics should not be used over the drain field. No heavy equipment, machine1y, or materials should be placed on backfilled drain field. Livestock should not graze on the drain field. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWS. For Example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and harm a drain field. The homeowner should pump the septic tank every two years and clean the effluent filter as needed. Garbage disposal use should be minimized, and non-biodegradable materials should not be placed into the OWS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWS. No hazardous wastes should be directed into the OWS. Mechanical room drains should not discharge into the OWS. The OWS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, air release valves and weep holes should be installed to allow pump lines to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain field due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be used, unless plastic or fiberglass is required. Septic tank risers should extend to grade. Access to all tank compartments and distribution devices is optimal. INSTALLATION OBSERVATIONS ALL SERVICE septic, LLC, and the county must view the OWS during construction. The OWS observation should be performed before backfill, after placement of chambers and distribution pipes. Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must also be observed. The OWTS is documented by Garfield County Permit SEPT-10-16- 4468. The system consists of a 1250-gallon, two-compartment Precast Concepts® concrete septic tank with an Orenco® ProPak pumping system and PF5005 pump in the second compartment. Effluent is pressure dosed through a 1.5-inch diameter pump line from the septic tank to an Orenco® model 6402 automatic distributing valve (ADV), which was installed at the high point in an insulated riser, and accessible is from grade. The soil treatment area (STA) consists of two beds, each with 4 rows of 8 'ARC ADS' chambers, for a total of 64 chambers and 960 square feet of infiltrative area. The chambers were installed at native grade in order to maintain the required 4-foot separation to high seasonal groundwater. Sand filter material was added to level the bed, where needed. Chamber rows in each bed are connected with level, 1.5-inch diameter manifolds. In May 2020 we were notified of some saturation issues in the eastern bed. Along with Altitude Septic, we did trouble-shooting to assure there were no broken pipes or issues with cycling of the ADV. We took the eastern bed off-line temporarily in hopes to alleviate saturation. After a month of only the western bed being on-line, we checked and saturation in the eastern bed remained. The western bed remained dry, despite being the only portion of the STA on-line. It is possible the saturation is a result of up gradient drainage from irrigation and/or ditches. In the Fall of 2020, the eastern bed was turned back on-line and inspection ports were dry with no evidence of saturation at that time . You noted that there has been a change to up gradient irrigation practices. We recommend monitoring the STA in the spring/ early summer. If any saturated ground is observed along the eastern bed , we recommend the installation of an interceptor trench drain to divert up-gradient drainage around the ST A . INTERCEPTOR TRENCH DRAIN RECOMMENDATIONS We suggest this interceptor trench drain be installed approximately 5-feet upgradient of the eastern bed. The interceptor trench drain must extend approximately 1-foot below the elevation of the bottom of the bed, which is at grade. The interceptor trench drain must be 18-inches wide with clean aggregate material surrounding the pipe. Aggregate material to be installed within 1-foot of native grade, covered with a mirifi or soil separation fabric, and capped with native materials (low permeation). A 20 mil PVC liner must be installed on the downhill side of the trench . See Interceptor Trench Drain Section Detail. The trench running parallel with the ST A bed should be 4-inch diameter perforated pipe, and the outlets to the east and west of the STA should be 4-inch diameter solid pipe ~ -. . C 1205 ALL SERVICE septic, LLC observed the installation of the onsite wastewater treatment system (OWTS) on November 15 , 2016 for the subject property. Deidrich Construction installed the system. The existing septic tank and soil treatment area (STA) were abandoned in place. The septic tank was pumped, collapsed and remaining void filled with on-site materials . We verified the new septic tank is 60-feet from the existing well, which is located to the east of the existing residence . The new system installation included a 1250-gallon, two-compartment Precast Concepts® concrete septic tank with an Orenco® ProPak pumping system and PF5005 pump in the second compartment. There is filter in the second compartment of the septic tank. This must be cleaned annually, or as needed. The control panel for the pumping system was installed within line of sight of the septic tank. Effluent is pressure dosed through a 1.5-inch diameter pump line from the septic tank to an Orenco® model 6402 automatic distributing valve (ADV), which was installed at the high point in an insulated riser, and accessible is from grade. The STA consists of two beds, each with 4 rows of 8 'ARC ADS' chambers, for a total of 64 chambers and 960 square feet of infiltrative area. The chambers were installed at native grade in order to maintain the required 4-foot separation to high seasonal groundwater. Sand filter material was added to level the bed, where needed. Chamber rows in each bed are connected with level, 1.5-inch diameter manifolds. Effluent is pressure dosed to 1.5-inch diameter laterals , which are suspended with zip ties from the underside of the chambers. Laterals have 5/32-inch diameter orifices facing up, with the exception of the first and last holes facing down for drainage. The orifices were placed 3-feet on center. Each lateral ends in a 90 degree ell facing up with a ball valve for flushing. Inspection ports were placed at the corners of each bed. The OWTS was generally installed according to specifications. This observation is not a guarantee of workmanship and/or parts and materials. ALL SERVICE septic, LLC should be notified if changes are made to the OWTS in the future . Any additional OWTS construction must be according to the county regulations. LIMITS: Observations are limited to components that are visible at the time of the inspection . The property is located in Garfield County, in an area where OWS are necessary. SITE CONDITIONS There is an existing residence and a storage barn on the subject site. A 5-bedroom single-family residence with a garage is proposed. The property slopes approximately 5% to the southeast. SUBSURFACE The subsurface was investigated by HP Geo-tech by excavating one Profile Pit and thre e percolation holes as indicated on Fi gure 1. HP Geo-tech indicated the test has a 6-inch t op soil layer, underlain by sandy, silty clay to the maximum depth explored of 8 feet. Groundwater was encountered at 5.5 feet. Percolation rates ranged from 15 to 180 minutes per inch (MPI). A 72 MPI rate will be used to design theOWS. DESIGN SPECIFICATIONS The OWS design is based on 5-bedrooms and an average sewage load of 750 GPD. The installation must include a 1500-gallon, two-compartment, precast concrete septic tank, with the addition of an effluent filter in the second compartment. Tank alternatives may be considered. Five gravelless chamber trenche s must be installed as indicated on plans provided. Four of the trenches must have 2 0 'Quick-4' chambers and one row must has 18 'Quick-4 , chamb er s, for a total of 98 chambers, equaling 968 square feet (SF) of infiltrative area. A distribution box should be used to distribute effluent. The trenches must be installed at a maximum depth of 1.5 feet beneath existing grade, Partial mounding will be necessary to maintain 1-foot of soil cover on chambers. If this depth cannot be achieved a pump may be necessary to direct effluent to trenches. Our office should be contacted for specific pump details if a pump is necessary. OWS Design Project No. 1464 3/24/08 Page2 Construction must be according to the county ISDS regulations, the septic permit provided by Garfield County Environmental Health Department~ and this design. OPERATION INFORMATION AND MAINTENANCE The surface of the drain field should be seeded upon completion. Vegetation is an important factor in drain field performance. Erosion control should be practiced during and prior to re-vegetation. Geo- fabrics or plastics should not be used over the drain field. No heavy equipment, machinery, or materials should be placed on backfilled drain field. Livestock should not graze on the drain field. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWS. For Example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and hmm a drain field. The homeowner should pump the septic tank every two years and clean the effluent filter as needed. Garbage disposal use should be minimized, and non-biodegradable materials should not be placed into the OWS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWS. No hazardous wastes should be directed into the OWS. Mechanical room drains should not discharge into the OWS. The OWS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, air release valves and weep holes should be installed to allow pump lines to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain field due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be used, unless plastic or fiberglass is required. Septic tank risers should extend to grade. Access to all tank compartments and distribution devices is optimal. INSTALLATION OBSERVATIONS ALL SERVICE septic, LLC, and the county must view the OWS during construction. The OWS observation should be performed before backfill, after placement of chambers and distribution pipes. Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must also be observed. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the installation. LIMITS: The design is based on information submitted. If soil conditions encountered are different from conditions described in report, ALL SERVICE septic, LLC should be notified. All OWS construction must be according to the county regulations. Requirements not specified in this report must follow county regulations. The installation included a 1500-gallon, two-compartment precast concrete septic tank with an effiuent filter, followed by S rows of' ARC 36' ADS chambers. Four trenches have 16 chambers and one trench has 14 chambers for a total of 78 chambers. The total infiltrative area installed was 965 SF. Serial distribution wiJl distribute effluent. The installed chamber area is 3 SF feet less than the proposed area per pur design letter dated March 24th 2008. This difference will not affect drain field performance. The OWS was installed according to specifications. This observation is not a guarantee of workmanship and/or parts and materials.
