An Application for a Special Use Permit for a Temporary Surface Pipeline Development was submitted to the Board of County Commissioners (File No. PDPA-03-16-8429) as turther described in Exhibit "A'r, Overall Pipeline Alignment and Property Ownership, and Exhibit "B", Pipeline Survey. B. The Pipeline Development is known as the Ursa Battlement Mesa PUD Temporary Surface Fresh Water and Recycled Water Pipeline and is located on approximately 4.5 acres of pipeline easements within the Battlement Mesa PUD. The pipeline alignment is located east of County Road 3008, north of County Road 354, and south of and adjacent to County Road 302. The Applicant is Ursa Operating Company LLC and the properties are subject to easements and surfâce use agreements with Battlement Mesa Metropolitan District and Battlement Mesa Land Investments which authorize the Applicant to use the pipeline right of way. The property ownership is shown in Exhibit "A". C. The subject property is located within unincorporated Garfield County in the PflD zone district within the Battlement Mesa Planned Unit Development (PUD). D. The Director of the Community Development Department made a determination at the time of the Pre-Application conference that pursuant to the Battlement Mesa PUD Guide a Special Use Permit is required. That portion of the pipeline crossing the PUD requires a Special Use Permit under the PUD guidelines for Extraction and Processing Uses of which a pipeline is an ancillary and accessory use. E. The Board of County Commissioners (Board) is authorized to approve, deny or approve with conditions Special Use Permits pursuant to the Garfield County Zoning Resolution of 1978, as amended, that is applicable to Special Use Permits within the Battlement Mesa PUD and pursuant to the Land Use and Development Code, as amended. F. The Board opened a public hearing on the lSth day of April, 2016, for consideration of whether the proposed Special Use Permit should be approved, denied or approved with conditions, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. G. The Board closed the public hearing on the 18ù day of April, 2016, to make a final decision. H. The Board, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Board. 2. The hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interestedparties were heard at athe meeting. 3. For the above stated. and other reasons, the proposed Special Use Permit for the Ursa Battlement Mesa PUD Temporary Surface Freshwater and Recycled Water Pipeline is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoptions of conditions described below, the application has adequately met the Special Use Permit Criteria contained in the Garfield County Land Use Resolution of 1978, as amended and the Pipeline Review Criteria contained in Section 9- 104 of the Land Use and Development Code, as amended. RESOLUTION NOW TIIEREX'ORE, BE IT RESOLVED by the Board of County Commissioners of Garfield Count¡ Colorado, that: A. The forgoing Recitals are inco¡porated by this reference as part of the resolution. B. The Special Use Permit for the Ursa Battlement Mesa PUD Temporary Surface Fresh lVater and Recycled Water Pipeline Development is hereby approved subject to compliance with the following conditions: 1. That all representations made by the Applicant in the application shall be conditions of approval unless specifically altered by the conditions of approval of the Board. 2. That the Ursa Battlement Mesa PUD Temporary Surface Freshwater and Recycled Water Pipelines shall be operated in accordance with all applicable Federal, State and local regulations goveming the operation of this type of facility. 3. Prior to issuance of the Special Use Permit, the Applicant shall provide updated technical information to address the referral comments from the County's Consulting Engineer, Chris Hale dated April T, 2016. 4. Prior to the issuance of the Special Use Permit, the Applicant's representations for monitoring of the pipeline during operation shall be included in the operations plan for the pipeline and attached as an addendum or supplement to the Emergency Responsc Plan for the pipeline. The Applicant shall comply with all provisions of the SPCC Plan including spill response and clean-up. 5. Prior to the issuance of the Special Use Permit, the Applicant shall provide additional details on fuse welding of the pipeline and fire protection provisions during constn¡ction. 6. Prior to the issuance of the Special Use Permit, the Applicant shall obtain a Watershed Protection Area Permit approval from the Town of Parachute. 7. Prior to initiating construction, the Applicant shall obtain all required utility permits frorn the County Road and Bridge Department. Installation of the pipeline crossing and cleaning of culverts shall be subject to coordination with the Road and Bridge Department. The Applicant shall be responsible for repair of any damage to roadways or curbs. 8. Prior lo initiating construction the Applicant shall submit for approval by the Road and Bridge Supervisor traffic control plans. 9. The Applicant shall maintain compliance with the Weed Management Plan for the site and shall treat all noxious weeds along the alignment no later than l0l3ll 16 with treatment records to be provided to the County Vegetation Manager in accordance with the Vegetation Managers referral comments dated 418116. 10. The Applicant shall install postslmarkers at the PUD boundary and at roadway crossings indicating the pipeline operator, the freshwater and recycled water use, and emergency contact information. 11. the pipeline shall maintain compliance with CDPIIE Storm Water Managgment Permits, Drainage and Soil Erosion Protection, BMP's, Reclamation and Re-vegetation Plans, and V/eed Management Plans. 72.The Applicant shall comply with all State and Federal rules and regulations regarding the pipeline operation including but not limited to reclamation and decommissioning. 13. The Applicant shall maintain compliance with COGCC Rules and Regulations in regards to noise abatement and C.R.S. Article 12 of Title 25, noise standards as appropriate. Any pumping stations required for operation of the pipeline shall utilize noise mitigation to ensure compliance with the COGCC residential noise standards. 14. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan - Agreement between Ursa Operating Company and CPW including any wildlife protection or mitigation requirements. The Applicant shall comply with recommendations of the Sensitive Areas Survey completed by W'estWater Engineering Inc. dated July 2015. 15. In accordance with Section 9-lO3 (J), upon completion of the pipeline the Applicant shall submit an operator's statement certifying compliance with the conditions of the Special Use Permit. 16.
