PIPELINE DEVELOPMENT
for
A pipeline alignment approximately 4.5 acres ìn size within the Battlement Mesa PIJD
located east of County Road 300E, north of County Road 354; and south of and
adjacent to County Boad 302, in Seetion I and Section 17, Township 7 South, Range
95 West of the dh P.M., Garlield County, and more fully described in Exhibit "A" Overall
Pipeline Alignment and Exhibit "B'Pipeline Suruey.

ln accordance with and pursuant to prov¡sions of the Gadield County Zoning Resolution
of 1978, as amended, the Garfield County Land Use and Development Code, as
amended, and Resolution No. 2016-34 of the Board of County Commissioners of Garfield
County, Siate of Cotorado, the following activity ís hereby authorized by Special Use
Permit:
A Temporary Surface Fresh Water and Recycled Water Pipeline Development
also known as the Ursa Battlement Mesa PUD Temporaty Su¡'Íace Fresh Water
and Recycled Water Pipeline (PDPA-0?-| 6-8429)
This Specíal Use Permit is issued subject to the conditions contained in Resolution No.
2016- 34 and set forth in Exhibít "C" and shall be valid only during compliance with such
condítions and other applicabfe provisions of the Garfield County Zoning Resolution of
1978, as amended and the Garfield County Land Use and Development Code, as
amended, Building Code, and other regulations of the Board of County Commissioners
of Gadield Gounly, Colorado.

1. That all representations made by the Applicant in the application shall be
conditions of approval unless specifically altered by the conditions of approval of the
Board.
2. Thalthe Ursa Battlement Mesa PUD Temporary Sudace Freshwaterand Flecycled
Water Pipelines shall be operated in accordance with all applicable Federal, State and
tocal regulatíons governing the operation of this type of facility.
3. Príor to issuance of the Special Use Permit, the Applicant shall provide updated
technical information to address the referralcomments from the County's Consulting
Engineer, Chris Hale dated April 7, 2016.
4. Priorto the issuance of the Special Use Permit, the Applicant's representations for
monitoring of the pipeline during operation shall be included in the operations plan for
the pipeline and attached as an addendum or supplement to the Emergency
Response Plan for the pipeline. The Applicant shall comply with all provisions of the
SPCC Plan including spill response and elean-up..
5. Prior to the issuance of the Special Use Permit, the Applicant shall provide
additional detaifs on fuse welding of the pipeline and fire prolection provisions during
construction.
6. Prior to the issuance of the Special Use Permit, the Applicant shall obtain a
Watershed Protection Area Permit approvalfrom the Town of Parachute.
7. Prior to initiating construction, the Applícant shall obtaiñ all required utility permits
from the County Road and Bridge Department. Said permits shall confirm that the
culverts to be utilized for the pipeline crossing are adequate to accommodate the
pípeline and any storm water drainage. lnstallation of the pipeline crossing and
cleaning of culverts shall be subject to coordination with the Road and Bridge
Department. The Applicant shall be responsible for repair of any damage to roadways
or curbs.
8. Prior to initiating construction the Applicant shall submit for approval by the Road
and Bridge Supervisor traffic control plans.

9. The Applicant shall maintain cornpliance with the Weed Management Plan for the
site and shall treat all noxious weeds along the alignment no later than 10/31116 with
treatment records to be provided to the County Vegetation Manager in accordance
with the Vegetation Managers reÍerral comments dated 418116.
10.The Applicant shall install posts/markers at the PUD boundary and at roadway
crossings indícating the pipeline operator, the freshwater and recycled water use, and
emergency contact information.
11.The pipeline shall maintain compliance with CDPHE Storm Water Management
Permits, Drainage and Soil Erosion Protection, BMP's, Reclamatíon and Re-
vegetation Plans, and Weed Management Plans.
12.The Applicant shall comply with all State and Federal rules and regulations
regarding the pipeline operation including but not limited to reclamation and
decommissioning.
13.The Applicant shall maintain compliance with COGCC Rules and Regulations in
regards to noise abatement and C.R.S. Article 12 ol Title 25, noise standards as
appropriate. Any pumping stations required for operation of the pipeline shall utilize
noise mitigation to ensure compliance wíth the COGCC residential noise standards.
14.The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Pfan -
Agreement between Ursa Operating Company and CPW including any wildlife
protection or mitigation requirements. ïhe Applicant shall comply with
recommendations of the Sensitive Areas Suruey completed by WestWater
Engineering lnc. dated July 2015,
15. ln accordance with Section 9-1 03 (J), upon completion of lhe pipeline the Applicant
shall subrnit an operator's statement certifying compliance with the conditions of the
Special Use Permit.
16. Potable water and sanitation shall be addressed during construction by provision
of portable facilities in compliance with OSHA requirements.
17.The pípeline pennit shall be effective forthree years from the first date of operation.
The pipeline shall be removed and the sÍte recla¡med within 90 days of lhe expiration
of the three year time period.
