PC-2018- O I A RESOLUTION CONCERNED WITH A LOCATION AND EXTENT APPLICATION FOR THE CITY OF GLENWOOD SPRINGS SOUTH CANYON MOUNTAIN BIKE TRAIL SYSTEM (FrLE NO. LAEA-03-1 8-8629) Recitals A. Garheld County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners is authorized to act. B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed the Garfield County Planning Commission (the Commission). C. The City of Glenwood Springs (the Applicant) applied to the Planning Commission pwsuant to File No. LAEA-03-18-8629 for a Location and Extent Review for a proposed public Mountain Bike Trails System and related improvements. D. The propoçed Mountain Bike Trail System is planned to include amenities for passive use of the property including bike trails, parking areas, and trailheads. The Mountain Bike Trail System is located on City owned property with one section of trail crossing Bweau of Land Management Property. It is located on a portion of a parcel approximately 1,896 acres in size and more fully described on the attached Exhibit "A", Legal Description and Site Plan. E. Pursuant to Section 4-1 11 (C) of the Garfield County Land Use and Development Code, as amended, and C.R.S. $ 30-2S-110(1)(a) the Commission is required to review the location and extcnt of thc proposetl public park or other public way to detennine whether the proposed public facility and improvements are in general confonnance with the County's Comprehensive Plan of 2030, as amended (the Comprehensive Plan) and its Master Plan. F. In accorclance with state law, the Planning Commission has adopted a Master Plan. The MasLer Plarr appliuablu f.o this Petition is the Comprehensive Plan. G. The Commission opened a public hearing on April I l, 2018 upon the question of whether the proposal is in general conformance with the Comprehensive Plan. H. The Commission closed the public hearing on April 11, 2018 to make a decision on the request. L The Commission, on the basis of substantial êompetent evidence produced at the aforementioned hearing, has macle the following determinations of fact: l. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent factso matters and issues were submitted or could be submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons! approval of the Location & Extent request by the City of Glenwood Springs for the South Canyon Mountain Bike Trail System is in the best interest of the health, safety, and welfare of the citizens of Garfield County. 4. That the Location and Extent request has been determined to be in general confomtance withthe Comprehensive Plan 2A30,as amended. 5. That the Location and Extent request is in conformance with the Review Criteria contained in Section 4-lll, Location and Extent of the Garfield County Land Use and Development Code, as amended. 6. The foregoing Recitals are incorporated by this reference as part-of the resolution. B. Exhibit A describes the location of the proposed public facility. C. The Location and Extent request for the public Mountain Bike Trails System and related improvements known as the City of Glenwood Springs, South Canyon Mountain Bike Trail System is hereby approved subject to the following conditions of approval: 1. That atl representations made by the Applicant in the Application shall be conditions of apprwal unless specifically altered by the conditions of approval contained herein. Z. That the Facility shall be operated in accordance with all applicable Federal, State, and local regulations governing the operation ofthis type of facility. 3. That the Applicant shall obtain all required permits from the County Building Department ana nóáA and Bridge Deparhnent. Additional restrictions may be applied by the County Road and Bridge Deparhnent. 4. That the Applicant shall provide ongoing maintenance for the Trail System including trash coiléction and provision of portable toilets at the trailheads when wananted based on use and demand.
